R2019-36 Benjamin School AmendmentsRESOLUTION 2019-36 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING MINOR AMENDMENTS TO THE BENJAMIN SCHOOL PLANNED UNIT DEVELOPMENT TO REFLECT AS -BUILT CONDITIONS; MODIFYING THE SITE PLAN, ARCHITECTURAL PLAN AND LANDSCAPE PLAN; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, through the adoption of Ordinance No. 2013-06 ("PUD Ordinance") on March 28, 2013, the Village Council created The Benjamin School Planned Unit Development ("PUD") and provided for the development of the PUD in accordance with the plans, specifications, waivers and conditions referenced therein; and WHEREAS, through the adoption of Ordinance No. 2017-10 ("PUD Amendment Ordinance") on July 27, 2017, the Village Council approved a major amendment to the PUD to reinstate the prior approval of the proposed Maintenance Facility and change its configuration and to add a two-story 13,171 square foot Science, Technology, Engineering and Mathematics Building ("STEM Building") to the existing campus; and WHEREAS, Section 8 of the PUD Ordinance provides that the Village Council may approve minor modifications to the PUD by resolution without necessity of review by the Planning t Commission, advertisement or public hearing; and WHEREAS, Urban Kilday Design Studios, agent, on behalf of The Benjamin Private School, Inc., property owners, is requesting minor modifications to the PUD reflect as -built conditions, specifically: respacing and slightly moving the pedestrian walkway columns; reducing and relocating the building signage; relocating the air handler unit intake louver; correcting the grade adjacent to the STEM Building and adding stairs with a replacement guardrail; replacing Cocoplum shrubs and hedges with African Iris; relocating one Crape Myrtle tree and eliminating another Crape Myrtle tree and two Live Oak trees due to utility conflicts; removing two existing oak trees due to deteriorated health and utility conflicts; adding 282 shrubs and groundcover plantings to compensate for the loss of trees; substituting an African Iris for a Small Leaf Clusia at the request of Seacoast Utility Authority; adjusting landscape locations to accommodate reconfigured sidewalks areas; and revising the landscape plans to include all changes and adjustments; and WHEREAS, the Village Council determines that these requests meet the definition of minor amendments to the PUD and that the adoption of this Resolution is in the best interests of the residents and citizens of the Village of North Palm Beach. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are ratified as true and incorporated herein. As authorized by Section 8 of Ordinance No. 2013-06, the Village Council hereby approves minor modifications to the Benjamin School PUD, as fully outlined above, and adopts the following amended plans to reflect the changes and as -built conditions: A. Architectural Plan for the STEM Building prepared by Harvard Jolly dated March 14, 2017 and last revised on April 4, 2019 and consisting of one page (A3.01). B. Specific Purpose Survey to reflect as -built conditions on March 21, 2019 prepared by Wallace Surveying and consisting of two pages. C. STEM Building As -Built Landscape Plan prepared by Urban Design Kilday Studios dated June 1, 2010 and last revised on April 10, 2019 consisting of one page (LA -1). D. STEM Building Record Site Plan prepared by Urban Design Kilday Studios dated June 1, 2010 and last revised on April 4, 2019 consisting of one page (SP -1). Section 3. To the extent not expressly modified herein, all other provisions of the PUD Ordinance and PUD Amendment Ordinance shall remain in full force and effect. Section 4.
