1976-44 Authorizing the Mayor & Village Clerk to Sign a Library Construction Grant Agreement~ e RESOLUTION N0. 44-76 A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO SIGN A LIBRARY CONSTRUCTION GRANT AGREEMENT BETWEEN THE VILLAGE OF NORTH PALM BEAC}{ AND THE DEPARTMENT OF STATE, STATE OF FLORIDA, DIVISION OF LIBRARY SERVICES. BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Mayor and Village Clerk be, and they are hereby, authorized and directed to execute that certain Library Construction Grant Agreement between the Village of North Palm Beach and the Department of State, State of Florida, Division of Library Services, copy of which is attached to this Resolution and by reference made a part hereof. Section 2. The Village Clerk is hereby authorized and directed to affix the Village Seal to said Agreement. Section 3. This Resolution shall take effect immediately ' upon passage. VILLAGE OF NORTH PALM BEACH This agreement, made and entered into this 15th day of April, 1976, by and between the Department of State, Division of Library Services, hereinafter called the DIVISION, and the Village of North Palm Beach, hereinafter called the VILLAGE. W I T N E S S E T H WHEREAS, the DIVISION, administrator of funds provided by the Legislature under Section-257.191, Florida Statutes, has approved an application for library construction funds submitted by the VILLAGE, which application is by reference made a part of this agreement, and; WHEP.EAS, the VILLAGE, acting under the authority vested in them for the establishment and maintenance of a free public library, have applied for construction funds; THEREFORE, the parties hereto agree as follows: 1. The VILLAGE agrees to: a. Provide unobligated funds in the amount not less than $63,500 to be used for public library construction. b. Provide an approved site, and building plans and specifications prepared by a Florida registered architect. Submit the final drawings and specifications to the DIVISION for review before a contract is awarded by the VILLAGE. e; =z- ,. c. Award a lump-sum construction contract with- in 270 days from the date of approval of the application for the grant by the DIVISION and complete the construction within a reasonable time insuring that .the construction conforms to the approved plans and specifications and that independent engineering or architectural supervision is provided. d. Comply with the following requirements: 1) Provide for equal opportunity in employ- ment pursuant to Executive Order 11246 or any subsequent orders or statutes pertaining thereto or any regulations issued thereunder. 2) Provide for payment of liquidated damages in the event the contractor fails to satisfactorily complete the work within the time specified in the contract and that the contractor provide a Performance Payment Bond as required by state law and other financial assurances as to his ability to comply with said contract pro vision. Liquidated damages paid shall be used at the discretion of the owner. 3) Provide for subsurface soil analysis acceptable to the architect.. 4) Comply with the laws governing expendi- tures by the Village of North Palm Beach, 5) Provide assurance .that all laborers and mechanics employed by contractors and sub-contractors shall be paid wages at the rates not less than those prevailing for similar construction in the locality, .. Jys Y~~~T 4 ~ , ~~ ~ ~ t . -?!: 1 as determined by the Division of Labor and Employment Opportunities, Florida Department of Commerce, and shall comply with all provisions of Section 215.19, Florida Statutes. 6) Provide that all construction contracts include labor standards relating to "kickbacks." 7) Maintain inventory records of all equip- ment purchased as a part of the project and submit such records to the DIVISION when required. 8) Provide accounting records that are kept so as to make expenditures readily available, and furnish audit reports in accordance with the DIVISION'S instructions.. . 9) Comply with the President's Order 11296 and such departmental regulations as may be issued relating to the evaluation of flood hazards. 10) Assure construction which complies with Florida Statutes 255.21, regarding the construction of buildings accessible to and useable by handicapped persons. 11) Afford access to the site and to all, records of the project to any authorized representative of the DIVISION. 12) Follow such procedures, submit such reports, maintain such records, and afford access thereto as the DIVISION may require, including but not necessarily limited to the submission of all contracts, addenda, and change orders which may be issued. c 13) Notify the DIVISION of the date~and time of final inspection in order to afford the DIVISION'S participation in such inspection for the purpose of concurring in the final acceptance of the building. 14) Comply with all provisions of Florida Statutes, 257.191, and the regulations governing such Act, the Florida Long- Range Plan for Library Services, and all Florida Statutes applicable to the construction of public buildings. 15) Provide for free use of the library service for all residents of the area served without discrimination. 16) Agree to the use of the building exclu- sively for the public library purposes for which constructed or altered unless a change in its use is approved by the DIVISION. 2. The DIVISION agrees to: a. Furnish funds, in accordance with the terms of this program and to the extent that the appro- priation for this project is released to the DIVISION, in the maximum amount of $63,500. Should the VILLAGE fail to expend the amount of local funds shown herein, the DIVISION will match the local funds on the basis of 50$ State and 50~ Local to a maximum amount of $63,500. Payments will be made upon certification by the ocaner that requirements have been met, on the following schedule: 1st payment of 30 percent (30~) upon 1/3 completion of construction; 2nd payment of 30 percent (30B) upon 2/3 completion of construction; 3rd payment of 30 percent (30$) upon acceptance of building;... Final payment of 10 percent (10$) upon receipt of the audit. b. Conduct a periodic check of project, including participation in the final inspection.
