1973-51 Recommending Legislature Sponsor a Minimum Building Code RESOLUTION N0. 51-73 A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, RECOMMENDING THAT THE PALM BEACH COUNTY LEGISLATIVE DELEGATION TO THE 1974 FLORIDA LEGISLATURE SPONSOR LEGISLATION FOR A MINIMUM BUILDING CODE AS PER THE SUGGESTED DRAFT OF THE PALM BEACH COUNTY MUN- ICI PAL LEAGUE. BE IT RESOLVEll BY THI: VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Palm Beach County Legislative Delegation to the 1974 Florida Legislature is hereby requested to adopt legislation incorporating the proposed "Building Code" for Palm Beach County as suggested by the Palm Beach County Municipal League. A copy of said proposal is attached. to this Resolution. Section 2. The Village Clerk is directed to forward copies of this Kesolution to the Chairman of the Palm Beach County Legislative ' Delegation and to the President of the Palm Beach County Municipal League. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA: Section 1. The Southern Standard Baild-- ing Code, 1973 Edition; the Southern Standard Gas Code 1973 Edition; the Southern Standard Plumb- ing Code, 1973 Edition; and the National Electric Code, 1972-73 Edition, hereby are adopted as the several Building Codes for all municipalities and unincorporated areas of Palm Eeach County, Florida. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 2T 28 29 30 31 Section 2. Definitions: (a) "Governmental Unit" as hereinafter used shall mean any one of the Municipal Governing Bodies i.n Palm Beach County or the Palm Beach County Board of Commissioners. (b) "Addendums" as hereinafter used shall mean additional stipulations, rules, regulations and requirements to the aforesaid several Build- ing Codes which are adopted by ordinance by any of the Governmental Units. Section 3. Building Inspections and the enforcement of the several Building Codes adopted in Section 1 of this Act and any Addendums thereto shall be the responsibility of each of the respec- tive Municipal Governing bodies. The Palm Beach ty Board of Coi~unissioiiers shall be responsible for building inspection and the enforcement of the several Building Codes adopted in Section 1 of this Act attd any Addendums thereto in the unin- corporated areas o£ Palm Beach County. Section 4. For the purposes of inspec- tion, qualified building inspectors whose compe- tency shall be determined, by each Governmental Unit shall be employed by each Governmental Unit charged with the responsibility of enforcing this Act. .. ..~ ..--,- ... r. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 Section 5. No residence or 'commercial building or other structure shall be erected within Palm Beach County in violation of the minimum standards and specifications of the several Build- ing Codes adopted in Section 1 of this Act and the Addendums thereto. Section 6. Any laws, ordinances, or resolutions now in existence in the unincorporated areas of Palm Beach County or in any municipality in Palm Beach County in conflict herewith are hereby repealed. Section 7. Neither the Palm Beach County Board of Commissioners nor any municipality shall enact any lava lowering the standards of the sev- oral Building Codes adopted in Section 1 of this Act. However, each Governmental Unit may adopt ordinances providing Addendums to modify the sever- al Building Codes to meet local conditions and to improve the several Building Codes. Said Adden- dums hereby are made a part of this Act to apply only within the jurisdiction of each Governmental Unit where enacted. Section 8. Each Governmental Unit shall have available for public inspection in its prin- cipal office three (3) copies of the several Build- ing Codes together w;_th any Addendums. Such Ad- dendums must be printed or otherwise suitably -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 duplicated and copies must be available for sale at reasonable cost to the public. Section 9. In the event of a dispute in the interpretation of the provisions of the several Building Codes and any Addendums thereto, the Governmental Unit inspector or the builder or con- tractor, may ask for an opinion from the Regional Inspector for that region. Such Regional Inspec- tors shall be appointed within thirty (30) days of the effective date of this Act by the Palm Beach County Board of Commissioners on the basis of one l11 such Regional Inspector for each of the five (5) Palm Beach County Commission Election Dis- tricts. Such Regional inspectors must be employed as a full time Chief. Municipal Inspector in the respective Election District in which they serve as a municipal employee. They shall serve at no addi- tional salary but with expenses paid by their employer. Said opinion shall be given only after telephone verification by the issuing Regional Inspector with any two (2) other Regional Inspectors, all of whom shall maintain a written record of the date and parties to the dispute and shall be bind- inq upon the parties to the dispute subject to final review and adjudication at the next public meeting by the local Board o£ Appeals of the Governmental Unir having jurisdiction of the con- struction. -Q- 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 Section lu. Within sixty (6u) days of the effective date of this Act, the Palm Beach County Board of Commissioners shall appoint a Palm Beach County Building Code Advisory Board and supply it with a meeting place, office supplies including stationery, legal. counsel, mechanical recording of its meetings, wri transcripts of the minutes of its meetings, part- time secretarial service and storage space for its records. Said Advisory Board is to have twelve (12) members composed of the aforesaid five (5) Regional Inspectors, five (5) members appointed from nominees submitted by the Construction Industry Management Council of Palm Beach County, one (1) member who shall be a Registered Architect appointed from nominees submitted by the Palm Beach Chapter of the American Institute of Architects and one (1) member who shall be a Professional Engineer appointed from nominees submitted by the Palm Beach Chapter of the Florida Engineering Society. The terms of all members shall expire on January 1 of each year and each member shall serve until his successor is appoint- ed. This Advisory Board shall hold meetings open to the public at least once in every calendar quay- ,ter, adopt rules of procedure and elect a Chairman land Vice-Chairman. The purpose of this Advisory Roard is to ad.~ise Governmental Units: (a) Ilow to adopt Addendums and adminis- ter the several Building Codes adopted in Section 1 of this Act; (b) Where their Addendums may be amended to unify them with other Addendums in Palm Beach County; (c) How their building inspections can be improved; (d) How to prevent the reoccurrence of disputes; and (e) Concerning products that are ac- ceptable for use in construction. Section 11. The several Building Codes adopted in Section 1 of this Act shall apply to all structures built in Palm Beach County and shall include all public buildings and public schools. Section 12. Should any provision of this Act be declared to be unconstitutional, the re- maining portions of the Act shall remain in full force and effect. Section 13. This Act shall take effect ninety (90) days after becoming law. -6-
