Mayor Aubrey called the meeting to order at 9:25 p.m. All members of Council were present.
All members of staff were present.
DOCK/MOORING REGULATIONS
Mr. Lukasik gave a presentation entitled "Docks and Mooring Policy Information" regarding the
dock and mooring issues that were first raised in March 2017. Mr. Lukasik stated the issue of
compliance with the existing code had been raised regarding homes located at 900 and 904 Shore
Drive, and the mooring of a yacht behind the two properties. Mr. Lukasik gave a brief history of
the existing conditions. Mr. Lukasik reported on discussions with the Waterways Board and
interested parties concerning code provisions related to the use of docks and mooring devices
behind properties in residential areas. Mr. Lukasik read the existing code definition in Section 5-81:
"Private dock, pier, mooring buoy and floating anchor mean those that shall only be used by the
occupant and his family and shall be constructed only in R-1 and R-2 Zoning Districts. A private
dock, pier, mooring buoy or floating anchor shall not be rented or leased." Mr. Lukasik presented
various policy issues for consideration.
Members of the public addressed the Council and expressed their views regarding the code.
Discussion ensued by the Council. Concerns were expressed regarding renting private dock space.
It was suggested that the meaning of the word "occupant" may need clarification. Council
consensus was to make no change to the definition of "Private dock, pier, mooring buoy and
floating anchor" in Section 5-81 of the Village Code of Ordinances.
Mr. Rubin reminded Council of the need to address other pending dock and mooring matters,
including floating docks and extending the prohibition on mooring across property lines to all Village
waterways. As part of that ordinance, Council directed Mr. Rubin to explore defining "occupant."
Boating safety questions were raised regarding the size of the canals, including standards for the
canal width needed to allow two boats to pass and the appropriate turning radius.
