A RESOLUTION OF THE VILLAGE COUNCIL, NORTH PALM BEACH, FLORIDA, AUTHORIZING AND
DIRECTING THE VILLAGE ATTORNEY TO INSTITUTE THE NECESSARY LEGAL PROCEDURES TO ENFORCE AND
PROTECT THE LEGAL RIGHTS OF THE VILLAGE OF NORTH PALM BEACH WITH REGARD T'0 A CERTAIN TRACT
OF LAND COMPRISING APPROXIMATELY 4.15 ACRES, LYING IN THE NORTHEAST CORNER OF THE NORTH
PALM.BEACH COUNTRY CLUB, ADJACENT TO U.S. HIGHWAY N0. 1.

WHEREAS, on July 24, 1961, the Village of North Palm Beach entered into an agree-
ment with WILLIAM W. BLAKESLEE, as Trustee, which agreement was recorded in Official Record
Book 668, Page 58, Public Reocrds of Palm Beach Cotulty, Florida, whereby under Paragraph 4
thereof the Village was granted an opi;ion to purchase lands described as Exhibit++C++ to said
agreement, comprising 5.23 acres, at as cost of X6,000.00 per acre, which option: was to be
exercised prior to January 1, 1964, and the full purchase price therefor to be paid prior to
January 1, 1964, and the full purchase price therefor to be paid prior to January 1, 1965;
and
WI~REAS, the Village of Nori;h Palm Beach has previously acquired 1.08 acres of the
' land described in Exhibit ++C++ by partial exercise of this option, which land has been paid
for in full; and
WHEREAS, on December 5, 1963„ the Village Manager gave written notice of its exercise
of said option to purchase the balance; of the land described in Exhibit ++C++ at X6,000.00 per
acre; and
WHEREAS, the Village of Nori;h Palm Beach is and has been ready, willing and able to
pay the remaining purchase price on said option, and all other incidental costs necessary to
transfer the property from H. A. ROSS, Successor in Interest, to WILLIAM W. BLAKESLEE, as
Trustee; and
WHEREAS, The full purchase px•ice of the money has been tendered to H. A. ROSS, Suc-
esssor Trustee to WILLIAM W. BLAIiESLEE:, of the Agreement referred to above; and
WHEREAS, the Village of North Palm Beach has advised H. A. ROSS, Successor Trustee,
of its complete readiness, willingness, and ability to complete all parts of the option
' agreement to be performed by it; and
WHEREAS, said H. A. ROSS, as Trustee, has specifically refused to abide by the terms
of said option agreement and specifically refused to accept the money tendered to him or to
deed the property to the Village of North Palm Beach,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, that;

Section 1, The Village atte~rney be, and he is hereby, authorized and directed to
institute all necessary and proper proceedings to require H. A. ROSS, Successor Trustee to
WILLIAM W. BLAKESLEE, as Trustee, to specifically perform the agreements set forth on his
part to be performed with regard to tlae purchase of the remaining land described in Exhibit nCu
o£ the Agreement recorded in Official Record Book 668, Page 58, Public Records of Palm Beach
County, Florida, dated July 24, 1961, or to recover £or the Village of North Palm Beach such
damages as it may have sustained by virtue of the Failure of the Trustee to abide by the
terms of said agreement, or both.
