RESOLUTION N0. 162
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FhORIDA, AUTHORIZING THE ACQUIREMENT BY EMINENT DOMAIN
OF CERTAIN REAL PROPERTY IN THE VILLAGE OF NORTH PALM BEACH.

WHEREAS, Sections 167.65 and 167.66, Florida Statutes, provide
as Follows:
"167.65 Right of eminent domain conferred on
cities and towns: purposes. -- All cities and
• towns in the state may exercise the right and
power of eminent domain, that is, the right to
appropriate property, except state or federal,
for the following uses or purposes: for streets,
lanes, alleys and ways; for public parks, squares
and grounds; for drainage and for raising or fill-
ing in land in order to promote sanitation and
healthfulness; for reclaiming and filling when
lands are low and wet, or overflowed altogether
or at times, and entirely or partly; for the
abatement of any nuisance; for the use of water
pipes and for sewerage and drainage purposes;
for laying wires and conduits under ground;
for city buildings, waterworks, pounds and other
municipal purposes, which shall be co-extensive
with the powers of the municipality exercising
' the right of eminent domain; and the absolute
fee simple title to all property so taken and
acquired shall vest in such municipal corporation,
unless the city or town seeks to condemn a particu-
lar right or estate in such property."
"167.66 Legislative department of city or town
domain. -- The city council or legislative depart-
ment of any city or town, or any board of such
city or town, as the case may be, having authority
and jurisdiction over any of the subject mentioned
in S 167.65 may, by resolution, authorize the ac-
quirement by eminent domain of property, real or
personal, for any of such uses or purposes designat-
ed in such resolution. The procedure in acquiring
said property shall be that prescribed and set forth
in chapter 73."

WHEREAS, by the Charter of said Village, the aforesaid Sections

167.65 and 167.66 are applicable to the Vil7xje of North Palm Beach; and
WHEREAS, with reference to the seal estate hereafter described,
the Village of North Falm Beach has determined i-~ is essential to
acquire the same by eminent domain for the purpose of utilizing said
real estate for public park purposes and for purposes of access to
other public park areas of the Village of North Palm Beach adjoining
said later described real estate;
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED BY THE VILLAGE
1. The Village Council of the Village of North Palm Beach
hereby finds and declares that the following described land located
in said Village and in the County of Palm Beach, Florida, -co-wit:

Beach adjoining said land above described.
2. The Village Council o~f the Village of North Palm Beach
hereby authorizes the acquirement by eminent domain of the fee
simple title to the real estate described in Section 1 above far
the purposes described in said Section 1.

is needed by the Village for public park purposes and for purposes
of access to other public park areas of the Village of North Palm
3. The Village Attorney of the Village of North Palm Beach
