1961-120 Mutual Police Aid and Protection with Town of Lake Park RESOLUTION N0. 120 ' A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, CONCERNING MUTUAL POLICE AID AND PROTECTION WITH THE TOWN OF LAKE PARK, PALM BEACH COUNTY, FLORIDA. ~ ~ ~ WHEREAS, the Village of North Palm Beach and the Town of Lake Park, Palm Beach County, Florida, are desirous of extending mutual police aid and protection to each other in time of emergency need so long as the same shall not jeopardize the interests of each governmental unit; • NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVID BY THE VILLAGE COUNCIL OF THE VILLAGE OF NCRTH PALM BEACH, FLORIDA, AS FOLTAWS: Section 1. The Village of North Palm Beach shall render emergency police assistance to any point within the Town of Lake Park requested. Section 2. Each unit shall provide compensation for their own employees and there shall be no charges from one unit to another for the assistance. Section 3. The equipment shall be dispatched to a police emergency as follows; (a) In the event the Village of North Palm Beach receives the first notice of a police emergency in the Town of Lake Park, the Village may dispatch North Palm Beach personnel at once to the scene if it is deemed expedient due to proximity or nature of the emergency. The Village of North Palm Beach shall forthwith notify the Town o£ Lake Park Police Department of the emergency and of the fact that North Palm Beach personnel has been dispatched. Upon the Town of Lake Park personnel arriving at the scene, the Lake Park police official in charge shall decide whether North Palm Beach personnel shall remain upon the scene to assist or shall be relieved. Once the Lake Park police arrives at the scene, the direction and control of all police activities shall be under the supervision of the Lake Park police official. n Resolution #120 Page 2 • (b) In the event of any police emergency in Lake Park, the first call of which shall have been answered by Lake Park police, the Lake Park Police Ghief or, in his absence, the Lake Park police officer in charge, shall decide whether it will be helpful to obtain the assistance of the Village of North Palm Beach Police Department and request the same, (c) Upon receiving the request, the North Palm Beach ' Police Chief or the person then in charge of the North Palm Beach Police Department shall have full discretion to decide whether granting the request for aid will jeopardise the police protect- ion of the Village, and, if in his opinion it will, the request • shall be denied. (d) When in the opinion o£ the North Palm Beach Police Chief, or police officer in charge, police assistance from Lake Park will be helpful in an emergency within the North Palm Beach corporate limits, he shall telephone or radio the Lake Park Police Department and request aid. Any Lake Park police assistance sent to the Village shall be under the control and direction of the North Palm'Beach police officer in charge. (e} Upon receiving the above request, the Lake Park police chief or the person then in charge of the Lake Park Police Department shall have furl discretion to decide whether granting the request for aid will jeopardize the police protection of Lake Park, and, if in his opinion it will, the request shall be denied, Section 1~. It is hereby expressly understood that any emergency equipment furnished by the Village of North Palm Beach shall be operated exclusively by North Palm Beach personnel but under the direction of the Lake Park police officer in charge. • Section 5. Each of the parties hereto shall arrange their liability and workman~s compensation insurance coverage so that their personnel will be covered although acting beyond the boundries of the municipality. ii Resolution #120 Page 3 Section 6. The members of the Police Force of the Town of Lake Park shall be sworn in as policemen by the Village of North Palm Beach and shall have all the powers and duties of the policemen of the Pillage of North Palm Beach whenever they are officially acting within the borders of the Village of North Palm Beach according to the terms of this resolution; and the policemen of the Village of North Palm Beach shall be sworn in as regular policemen of the Town of bake Park and shall have all the powers and duties of the policemen of the Town of Lake Park whenever they are officially acting within the borders of the Town of Lake Park according to the terms of this resolution. Section 7: This resolution shall not be repealed without first giving ten days prior notice to the Town Commission of the Town of Lake Park. PASSED AND ADOPTED this 1ltth day of Novembers 1961.
