R2017-108 Hurricane Payr RESOLUTION NO. 2017-108 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, CORRECTING THE INCONSISTENT APPLICATION OF PRIOR VILLAGE PRACTICES AND APPROVING THE PAYMENT OF OVERTIME COMPENSATION TO NON-EXEMPT VILLAGE EMPLOYEES AND THE ESTABLISHMENT OF AN ADMINISTRATIVE LEAVE BANK FOR EXEMPT EMPLOYEES FOR WORK PERFORMED JUST PRIOR TO, DURING AND IMMEDIATELY AFTER HURRICANE IRMA; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village has engaged in the practice of paying overtime to non-exempt Village employees who work just prior to, during and immediately after a hurricane or other natural disaster; and WHEREAS, Village Administration is recommending certain payments to non-exempt employees to ensure consistent application of this practice for Hurricane Irma, as well as establishing an "administrative leave bank" for exempt employees who were called into work but did not perform actual disaster -related work that would qualify for emergency duty compensation pursuant to Section 8-31 of the Village Code; and WHEREAS, the Village Council determines that that adoption of this Resolution is in the interests of the public health, safety and welfare. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, as follows: Section 1. The foregoing recitals are ratified and incorporated herein. Section 2. The Village Council hereby approves the following payments to non-exempt employees who worked during the emergency period for Hurricane Irma: (1) compensation at a rate of two times their regular rate of pay for those non-exempt employees within the PBA and IAFF bargaining units; and (2) compensation at a rate of two times their regular pay for those non-exempt, non -bargaining unit employees. For Hurricane Irma, the emergency period is defined as the period of time between 5:00 p.m. on September 7, 2017 through 5:00 p.m. on September 12, 2017. Section 3. The Village Council hereby approves the creation of an Administrative Leave Bank for those exempt employees who were called into work during the emergency period for Hurricane Irma. The balance in each employee's leave bank will be the actual hours worked, capped at forty (40) hours. The leave bank hours will not accrue and will be lost if not utilized prior to September 30, 2018. Section 4. All resolutions or parts of resolutions in conflict with this Resolution are hereby repealed to the extent of such conflict. Page 1 of 2 Section 5. This Resolution shall be effective immediately upon adoption, provided, however, that the actual payments for Hurricane Irma referenced in Section 2 above will be retroactive to Fiscal Year 2017.
