A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, CONFIRMING THE VILLAGE'S
PARTICIPATION IN THE PALM BEACH COUNTY PROPERTY
ASSESSED CLEAN ENERGY (PACE) PROGRAM; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 163.08, Florida Statutes, authorizes local governments to create
individually, or in partnership with other local governments, Property Assessed Clean Energy
("PACE") Programs which allow owners of real property to obtain upfront funding for energy
conservation and efficiency, renewable energy and wind resistance improvements and repay such
funding through voluntary special assessments (or non -ad valorem assessments) levied upon the
improved property; and
WHEREAS, the Village entered into a non-exclusive Agreement with a PACE provider
(Florida Green Energy Works n/k/a RenewPACE) through the adoption of Resolution No. 2015-72
on October 22, 2015, as amended by Resolution No. 2016-38; and
WHEREAS, Palm Beach County recently adopted the Palm Beach County PACE Ordinance
(County Ordinance No. 2017-012) to authorize a county -wide PACE Program in which multiple
providers will participate; and
WHEREAS, the County PACE Ordinance will encourage competition among PACE providers
throughout the County and adds several enhancements to the standards PACE program,
including enhancements for consumer protection; and
WHEREAS, given the widespread energy and economic benefits of the County's PACE Program,
the Village Council desires for the Village of North Palm Beach to participate in the County
PACE Program and determines that such participation will be beneficial to the residents and
business owners of the Village who elect to participate; and
WHEREAS, the Village Council determines that the adoption of this Resolution in the best
interests of the residents and citizens of the Village of North Palm Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and incorporated herein.
Section 2. In accordance with the Palm Beach County PACE Ordinance, the Village Council
confirms the Village of North Palm Beach's participation in the County PACE Program for the
purpose of providing upfront funding for qualifying improvements through participating PACE
agencies, authorities and districts.

Section 3. The Village Council expressly authorizes County -approved PACE agencies, authorities
and districts who have established agreements with the County to provide their PACE Program

sei vices within the Village pursuant to such agreements as of the effective date of this Resolution.
Section 4. All resolutions or parts of resolutions in conflict with this Resolution are hereby
repealed to the extent of such conflict.
Section 5. This Resolution shall be effective immediately upon adoption.
