AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, ESTABLISHING A ZONING IN PROGRESS
ALONG THE COMMERCIAL CORRIDORS WITHIN THE CORPORATE
LIMITS OF THE VILLAGE OF NORTH PALM BEACH; PROVIDING FOR
EXPIRATION; PROVIDING FOR CODIFICATION; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in August 2015, the Village contracted with the Treasure Coast Regional Planning
("TCRPC") Council to develop a master plan for future infill development and redevelopment
within its corporate limits, as well as a community based vision for economic growth; and
WHEREAS, from January 30, 2016 through February 5, 2016, TCRPC conducted a week-long
economic development and urban design charrette to assist the Village in accomplishing its goals; and
WHEREAS, working with members of the public and other interested parties, TCRPC created its
report, and through the adoption of Resolution No. 2016-73 on October 27, 2016, the Village
Council formally adopted "The Village of North Palm Beach Citizens' Master Plan Report dated
October 20, 2016" prepared by the TCRPC, including the recommendations contained therein, as
setting forth the guiding principles for future development within the Village; and
WHEREAS, one of the Master Plan's key recommendations is to develop a form -based code and
land use district for the Village's commercial corridors; and
WHEREAS, the Village has issued a Request for Qualifications for a planner or planning firm to
develop a form -based (or hybrid) code for the Village's commercial zoning districts and wishes
to ensure that proposed development and redevelopment plans that are submitted prior to the
implementation of this code meet the objectives and intent of the Master Plan; and
WHEREAS, based on the foregoing, the Village Council wishes to declare a Zoning in Progress
for the Northlake Boulevard, Prosperity Farms Road, Alternate AIA and U.S. Highway One
commercial corridors to ensure that developers are aware of the goals and objectives of the
Master Plan and, to the greatest extent practicable and feasible, incorporate these principles and
design concepts in any new development or redevelopment applications; and
WHEREAS, the Village Council determines that the adoption of this Ordinance is in the best
interests of the residents and citizens of the Village of North Palm Beach.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein.
Section 2. All commercial and mixed-use projects proposed for the Northlake Boulevard,
Prosperity Farms Road, Alternate AlA and U.S. Highway One commercial corridors, should, to
the greatest extent practicable and feasible, incorporate the following concepts and principles
consistent with the Village's adopted Master Plan:

A. Architectural:
(1) Provide for a mix of building types and a variety of rooflines and facades;
(2) Place buildings close to the street and, where appropriate, add small object buildings
to define the street and create pockets of attractive and desirable urban space;
(3) Create attractive, interactive and functional outdoor spaces through the use of
decorative pavements, materials, extensive landscaping and public amenities; and
(4) Encourage pedestrian activity and active streetscapes through, among other
things, the development of pedestrian facilities to connect buildings and places
along the corridors and the use of decorative and functional street lighting and
street furniture.
B. Parking:
(1) Eliminate or minimize surface parking areas and provide for parking on -street, in
garages or behind buildings; and
(2) Interconnect parking areas.
C. Layout:
(1) Provide for the interconnection of walkable blocks and small streets and
connections to established neighborhoods;
(2) Incorporate public open spaces, plazas, gathering places, and civic greens;
(3) Create shaded pedestrian areas adjacent to storefronts and clearly define and
shade pedestrian routes throughout the development;
(4) Provide for bicycle parking and include bicycle paths and lanes, in addition to
clearly delineated internal and external links for both pedestrians and bicyclists;
(5) Provide opportunities for cross access between properties and multiple
connections to roadways to diffuse traffic volumes; and
(6) Optimize waterfront access and outdoor dining.
D. Uses:
(1) Mixed use projects are encouraged with pedestrian -scaled, active uses along the
sidewalks and a broad mix of residential unit types;
(2) Provide for a diversity of uses and a harmonious transition between uses; and
(3) Incorporate small instances of neighborhood commercial uses to improve the
quality of life for surrounding neighborhoods.

Section 3. Village Staff shall work with applicants to ensure that all proposed projects within
the Village's commercial corridors meet the concepts and principles set forth in "The Village of
North Palm Beach Citizens' Master Plan Report" and Section 2 above, to extent practicable and
feasible, through the use of planned unit developments and waivers. In the event variances may
be necessary for projects that are not included within a planned unit development, the project
will be presented to the Planning Commission for review prior to the applicant seeking any
variance from the Zoning Board of Adjustment.
Section 4. This Zoning in Progress shall expire eighteen (18) months from its effective date
or the date the Village adopts a form -based (or hybrid) zoning code for its commercial zoning
districts, whichever shall first occur. If the Village has not adopted a form -based (or hybrid)
zoning code within eighteen (18) months, the Village may extend the Zoning in Progress by
resolution for an additional six (6) month period.
Section 5. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or void,
such holding shall not affect the remainder of this Ordinance.
Section 6. All ordinances or parts of ordinances and resolutions or parts of resolutions in
conflict herewith are hereby repealed to the extent of such conflict.
Section 7. This Ordinance shall take effect immediately upon adoption.
