2017-16 Comprehensive Plan Text AmendmentORDINANCE NO. 2017-16 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING A TEXT AMENDMENT TO THE FUTURE LAND USE ELEMENT OF THE VILLAGE COMPREHENSIVE PLAN TO REFERENCE THE 2016 CITIZENS' MASTER PLAN REPORT, PROVIDE A TIMEFRAME TO IMPLEMENT PROVISIONS AND GUIDING PRINCIPLES OF SAID REPORT THROUGH REVISIONS TO THE VILLAGE'S LAND DEVELOPMENT REGULATIONS, AND MODIFY AND CLARIFY PROVISIONS RELATING TO LOT COVERAGE AND BUILDING HEIGHT FOR NON-RESIDENTIAL LAND USES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village wishes to amend its Comprehensive Plan to update the Future Land Use Element of its Comprehensive Plan as a housekeeping item to clarify and simplify policy language; and WHEREAS, the Village has initiated a Comprehensive Plan Text Amendment ("Amendment 17-1") to amend the Future Land Use Element by: (1) referencing the adopted Citizens' Master Plan Report and providing a timeframe in which to implement the provisions and guiding principles of the report through revisions to the Village's land development regulations; and (2) revising Policy LAA of the Future Land Use Element to provide that provisions relating to maximum lot coverage and building height for non- residential uses will be regulated through the Village's land development regulations; and WHEREAS, on August 8, 2017, during the course of a duly advertised public hearing, the Village Planning Commission, sitting as the Local Planning Agency, determined that the proposed amendment is consistent with the adopted Village Comprehensive Plan and recommended approval of Amendment 17-1; and WHEREAS, the Village Council determines that Amendment 17-1 is consistent with Chapter 163, Florida Statutes; and WHEREAS, the Village Council, having conducted two duly advertised public hearings and given this matter due consideration, determines that the adoption of Amendment 17-1 to the Village Comprehensive Plan is in the best interest of the residents and citizens of the Village of North Palm Beach. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing whereas clauses are hereby ratified as true and correct and are incorporated herein. Page 1 of 3 Section 2. The Village Council hereby adopts Amendment 17-1 to the Village Comprehensive Plan, as fully set forth in Exhibit "A" attached hereto and incorporated herein by reference. Section 3. If any section, paragraph, sentence, clause, phrase or word of this ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 4. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5. This Ordinance shall be effective thirty-one (3 1) days after the Department of Economic Opportunity notifies the Village that the plan amendment package is complete or, if timely challenged, this Ordinance shall be effective upon entry of a final order by the Department of Economic Opportunity or the Administration Commission determining the adopted amendment to be in compliance. Location shall be in accordance with the Future Land Use Map. Commercial uses shall not be permitted within areas designated for residential development on the Future Land Use Map Series; b. Maximum lot coverage ratio shall be 35ero—governed by qpplicable land development regulations; c. Maximum building height shall be governed by district applicable land development regulations2 in Village Zoning Godei and be based up eensisteney with development trends in thevieinity a*l shall be consistent with the Village of North Palm Beach Citizens' Master Plan Report adopted by Resolution 2016-73 on October 27, 2016; and eempatibi ;t. compatible with neighboring roommer land uses; and d. Adequate off-street parking and loading facilities. e. Maximum Floor -Area -Ratios for non-residential land uses shall be established as follows: 1. Commercial land uses: A maximum of 0.35 along U.S. Highway No. 1, north of the Parker Bridge; a maximum of 1.10 along U.S. Highway No. 1, from the Parker Bridge, south to Northlake Boulevard; a maximum of 0.70 along U.S. Highway No. 1, south of Northlake Boulevard; and a maximum of 0.70 along Northlake Boulevard and S.R. Alternate A -1-A. The Twin City Mall site shall be exempt from this requirement, and subject to the land development regulations of the C-3 zoning district, which was jointly developed by the Village and the Town of Lake Park. 2. Public Buildings And Grounds Uses: A maximum of 0.25. 3. Educational Uses: A maximum of 0.15 4. Other Public Facilities Uses: A maximum of 0.30. 5. Recreation and Open Space Uses: A maximum of 0.05 6. Light Industrial/Business Uses: A maximum of 0.45. NEW Policy 1.A.9: The Village shall revise its land development regulations no later than 2019 to implement the provisions and guiding principles of the Village of North Palm Beach Citizens' Master Plan Report, adopted by Resolution 2016-73 on October 27 2016.
