2017-56 PRM Withdrawal NoticeRESOLUTION NO. 2017-56 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING THE VILLAGE MANAGER TO PROVIDE PUBLIC RISK MANAGEMENT OF FLORIDA WITH NOTICE OF THE VILLAGE'S INTENT TO WITHDRAW; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village is currently a member of the Public Risk Management of Florida ("PRM") risk -management and self-insurance pool for property and casualty coverage; and WHEREAS, the Village has directed its agent of record to seek alternative quotes from other property and casualty carriers for the upcoming fiscal year; and WHEREAS, in order to withdraw from PRM, the PRM Trust Agreement requires the provision of written notice at least forty-five (45) days prior to end of the policy year (October 1, 2017); and WHEREAS, because of the potential for withdrawal from PRM, the Village Council wishes to authorize the Village Manager to provide the required written notice; and WHEREAS, the Village Council determines that the adoption of this Resolution is in the best interests of the residents and citizens of the Village of North Palm Beach. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, as follows: Section 1. The foregoing recitals are ratified and incorporated herein. Section 2. The Village Council hereby authorizes the Village Manager to provide written notice to Public Risk Management (PRM) of its intent to withdraw from the risk management and self-insurance pool for property and casualty coverage pursuant to Section 4.2 of the Trust Agreement, and, in the event of the Village's actual withdrawal, to provide written notice in accordance with Section 4.3 of the Trust Agreement. Section 3. This Resolution shall be effective immediately upon adoption. PASSED AND ADOPTED THIS I 01 DAY OF AUGUST, 2017. Myers, Florida 33903 Re: 45 Day Notice of Potential Withdrawal- October 1St, 2017 Dear Ms. Mims, In accordance with the Contract & By -Laws contained in the Intergovernmental Cooperative Agreement (dated December 12, 2012), specifically sections 4.2 and 4.3, The Village of North Palm Beach is hereby providing you the required 45 -day Notice of Potential Withdrawal from the Pool for the fiscal year commencing October 1St, 2017. Please note that accompanying with this notice is a resolution from our governing body (dated August 10, 2017), acknowledging our marketing of the Village's property and casualty insurance program which may potentially lead to an election to withdraw from Public Risk Management of Florida effective October 1St, 2017. We further understand that we must provide you, at least 10 days prior to the beginning of the upcoming policy year, written notice of our actual intent to withdraw.
