06-22-2017 VC WS-MMINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JUNE 22, 2017 Present: Darryl C. Aubrey, Sc.D., Mayor Robert A. Lukasik, Village Manager Len Rubin, Village Attorney Melissa Teal, Village Clerk ROLL CA LL Mayor Aubrey called the meeting to order at 10:20 p.m. All members of Council were present. All members of staff were present. BENJAMIN SCHOOL CPUD MODIFICATION Discussion took place regarding an application for approval of an amendment to the Commercial Planned Unit Development (CPUD), Site Plan, and associated plans for The Benjamin School located at 1100 U.S. Highway One. Councilmember Bickel declared a conflict due to her employment by The Benjamin School, and did not participate in the discussion. Village Planner Erin Sita reported on the CPUD amendment and Site Plan modification requested by Urban Design Kilday Studios on behalf of The Benjamin School (TBE), located on 14.79 acres at 11000 U.S. Highway One. Mrs. Sita stated a CPUD was approved for the entire site in 2013 for the purpose of unifying TBE under one approval, providing a cohesive plan for the existing development, vesting all the existing structures, and approving a 10,000 square foot maintenance building. Mrs. Sita noted the two-year commencement period for the maintenance building had lapsed. Mrs. Sita reported the main purpose of the application is to add a Science, Technology, Engineering and Mathematics (STEM) building, amend the condition of approval for the maintenance building, and modify the site plan. Joni Brinkman, Urban Design Kilday Studios, and Rene Tercilla, Harvard Jolley Architects, addressed the Council on behalf of the applicant. Ms. Brinkman confirmed agreement with the conditions listed in the staff report. Discussion ensued regarding the timeframe for construction. By consensus, the Council forwarded this item to the next Regular Session agenda. Minutes of Village Council Workshop Session held June 22, 2017 Page 2 of 2 BOAT MOORING AND PRIVATE DOCK REGULATIONS Mr. Lukasik discussed issues regarding the use of private docks and the impact on residential areas, in conjunction with concerns raised by residents about the transient use of private docks. Mr. Lukasik reported that the Waterways Board discussed the matter and recommended that the Village allow private docks to be used by "owners, occupants, or tenants and their families" within single-family residential districts. Mr. Lukasik referenced a suggestion that "rent" could be defined as allowing the use of the dock at no charge and noted that staff found such definition to be overly broad. Mr. Lukasik asked for direction regarding a code amendment to eliminate the ability of individuals to moor across property lines. Discussion ensued on these topics: the code provision limiting use of private docks to "occupants" of the property; allowing an owner of two adjoining lots to moor across the property lines; maintaining neighborhood character; restrictions on the size of boats; and amending the code to prohibit mooring past the side property line extended. Consensus of Council was to allow "owner or tenant" to use private docks. The Council declined to consider a further definition of "rent or lease." It was determined that Mr. Rubin would include in the draft ordinance a provision to allow the owner of two adjoining lots to moor across the property lines, subject to further discussion by the Council. Additionally, Mr. Rubin noted the need to address floating docks and floating boatlifts in the proposed ordinance, due to a statutory requirement that they be allowed. BOAT AND RV ORDINANCE IMPLEMENTATION Due to the 11:00 p.m. curfew, this item was not discussed and will be brought back to the next Workshop Session.
