06-26-1997 VC PH2-MLJ C 1 MINUTES OF PUBLIC HEARING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JUNE 26, 1997 Present: ROLL CALL Gail H. Vastola, Mayor Charles O'Meilia, Vice Mayor Larry Kelley, President Pro Tem Tom Valente, Councilman David Norris, Councilman Dennis W. Kelly, Village_Manager George Baldwin, Village Attorney Kathleen F. Kelly, Village Clerk Mayor Vastola called the meeting to order at 7:01 p.m. All members of Council were present. All members of staff were present. The purpose of the Public Hearing was to hear comments from the Public concerning Bill 890, a proposed ordinance rezoning a parcel of land commonly known as the Southwest Neighborhood, located south of Richard Road, north of Northlake Boulevard, west of Prosperity Farms Road and both east and west of Highway A1A within the Village from various Palm Beach County zoning districts to zoning districts of the Village of North Palm Beach. STATEMENTS FROM THE PUBLIC Daniel James, 315 5th Street, West Palm Beach, addressed the Council regarding lots 40 and 41 in the S. W. Neighborhood. Mr. James stated that, as owner of the two lots on Conroy Drive, he wants his property to be included in the CC district zoning. Mr. James requested an explanation as to why they are not being rezoned for commercial use, since Palm Beach County had recommended it at an earlier date. Mr. James further stated that if his lots are not going to be included in the commercial zoning, perhaps the method of committing these 2 lots for commercial use would be in the way of a petition to rezone, with a specific land use or site plan attached, as opposed to placing it in a commercial zone which would permit other uses less compatible with surrounding residential areas. Mr. James was advised to attend the second Public Hearing on this matter, which will be held July 10th, as well as the July 10th Regular Session, at which time the Council will discuss this issue. Minutes of Public Hearing Held Thursday, JUne 26, 1997 Michael Brinkman, 2579 Northlake Blvd., owner of the Bud's Chicken property, told the Council that changing his property to C-1 would lessen the zoning from that which it was under Palm Beach County zoning districts. Mr. Brinkman said that he would become a "non-conforming" use if this occurs, and felt that this would lessen the property value at resale. Mr. Brinkman was assured that the staff would make notes of his concerns prior to the second Public Hearing and Council discussion on July 10, 1997.
