07-10-1997 VC PH5-Mn ll MINUTES OF PUBLIC HEARING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JULY 10, 1997 1 Present: Gail H. Vastola, Mayor Charles O'Meilia, Vice Mayor Larry Kelley, President Pro Tem Tom Valente, Councilman David Norris, Councilman Dennis W. Kelly, Village Manager George Baldwin, Village Attorney Kathleen F. Kelly, Village Clerk - ROLL CALL Mayor Vastola called the meeting to order at 7:05 p.m. All members of Council were present. All members of staff were present. The purpose of the Public Hearing was to hear comments from the Public concerning Bill 890, a proposed ordinance rezoning a parcel of land commonly known as the Southwest Neighborhood, located south ofi Richard Road, north of Northlake Boulevard, west of Prosperity Farms Road and both east and west of Highway A1A within the Village from various Palm Beach County zoning districts to zoning districts of the Village of North Palm Beach. STATEMENTS FROM THE PUBLIC Daniel James, 315 5th Street, West Palm Beach, addressed the Council regarding lots 40 and 41 on Conroy Drive in the S. W. Neighborhood, which he and his wife owns. Mr. James stated that on prior occasions while under the jurisdiction of Palm Beach County, a recommendation had been made to rezone his property to commercial. Mr. James stated that, at that time, the land was being considered for annexation by the Village of North Palm Beach. Mr. James said that when annexation was complete, the Village staff also proposed rezoning Lot 41 to commercial. Mr. James said he did not understand why this proposal changed, but Lot 41 is not included in the proposed commercial zoning at this time, nor has he been given an explanation as to why. Colleen Schroeder, 2701 Conroy Drive, told the Council that she supports the rezoning as presented, and appreciates the time and consideration that the Village has given to the residents to present their views. Minutes of Public Hearing Held Thursday, June 26, 1997 Mark Brinkman, representing Bud's Chicken on Northlake Blvd., told the Council that none of the zoning districts of the Village permit drive-through windows or drive-through facilities. Because of that, he said, Bud's Chicken becomes anon-conforming use, which brings about many more problems. Mr. Brinkman told said that they want to expand the facility, and will not be able to it as anon-conforming use. He further stated that this would tie their hands when it comes to selling, and that if it didn't sell within six months, they would not be able to sell it for that particular use. Mr. Brinkman told the Council that at some point in time, they would come back to ask for a zoning change that would allow drive-through windows. William Aldrich, 9043 Prosperity Farms Road, Lots 6 and 7, which is Eyeglass World and Aldrich Rentals, opposed any rezoning action which would take away privileges that he had with the County, and which would devalue his property.
