03-28-1996 VC REG-MMINUTES OF REGULAR SESSION • OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MARCH 28, 1996 Present: V. A. Marks, M. D_, Mayor Tom Valente, Vice Mayor Larry Kelley, President Pro Tem Gail Vastola, Councilman Charles O'Meilia, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, Village Clerk ROLL CALL Mayor Marks called the meeting to order at 7:30 p.m. All members of Council were present. All members of staff were present except Village Attorney George Baldwin, who was expected momentarily. INVOCATION AND PLEDGE OF ALLEGIANCE • Mayor Marks gave the invocation, and Councilman O'Meilia led the public in the Pledge of Allegiance to the Flag. Village Attorney George Baldwin arrived at 7:31 p.m. APPROVAL OF MINUTES The following Minutes were approved as read: Minutes of Special Session held 3/13/96 Minutes of Regular Session held 3/14/96 REPORT OF THE MAYOR Mayor Marks proclaimed the week of April 7, 1996 -April 13, 1996 as Building Safety Week in the Village of North Palm Beach. Harold Piscara, President of the Building Officials Association of Palm Beach County, was present to accept the Proclamation. PETITIONS AND COMMUNICATIONS • The following Minutes were received for file: Minutes of Regular Session • Held Thursday, March 28, 1996 Minutes of Code Enforcement Board Meeting held 3/4/96 Minutes of Planning Commission's Public bearing held 3/5/96 Minutes of Planning Commission Meeting held 3/5/96 Minutes of Recreation Advisory Board Meeting held 3/13/96 The following Minutes were returned for correction: Minutes of Library Advisory Board Meeting held 2/27/96 -Attendance of President Pro Tem Kelley was omitted. Minutes of Country Club Administrative Board Meeting held 3/4/96 -Correction or clarification of Last sentence on Page 1 which reads "not due to non participation". REPORTS OF SPECIAL COMMITTEES AND RECOMMENDATIONS • Vice Mayor Valente moved that the following recommendations of the Planning Commission be received for file: 1. Recommended to Council that "the rezoning of 10313 Prosperity Farms Road be denied". 2. Recommended "Council approval of a P.U.D. known as Sanctuary Cove Phase II". 3. Recommended to Council "approval of rezoning of Sanctuary Cove Phase II from R-2, Multiple Family Dwelling District to R-3, Apartment Dwelling District, provided the Planned Unit Development of the same name is approved". Councilman Vastola seconded the motion, and all present voted aye. Vice Mayor Valente moved that the recommendation of the Planning Commission that "no changes be made to distance restrictions for alcoholic beverage sales related to C-3 zoning district" be received for file. Councilman O'Meilia seconded the motion. • 2 Minutes of Regular Session Held Thursday, March 28, 1996 During discussion, it was noted that the Planning Commission did not give any explanation for its recommendation. By consensus, the Village Council agreed to place this recommendation on the workshop agenda of April 11, 1996. VILLAGE MANAGER'S REPORT Village Manager Dennis Kelly reported to the Council that the Palm Beach County Municipal League has requested that the Village of North Palm Beach host the next Municipal League meeting scheduled for April 24, 1996 at 10:30 a.m. The meeting would be held at the Community Center or the Council Chambers, followed by lunch for approximately 80 people following the meeting, to be catered by the Country Club restaurant. Councilman Valente moved that the Village host the meeting and luncheon, with the cost of the luncheon to be taken from the Special Events line item. Councilman O'Meilia • seconded the motion, and all present voted aye. BILL 815 -AMENDING GENERAL EMPLOYEES PENSION PLAN BENEFITS -PLACED ON SECOND READING AND ENACTED AS ORD. 12-96 Vice Mayor Valente moved that Bill 815 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE DEFINITION OF "ACTUARIAL EQUIVALENCE OR ACTUARIALLY EQUIVALENT" SET FORTH IN SECTION 2-146 OF DIVISION 3, PENSION AND CERTAIN OTHER BENEFITS FOR GENERAL EMPLOYEES, OF ARTICLE V OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE VILLAGE; AMENDING THE NORMAL RETIREMENT AGE AND RETIREMENT BENEFIT SET FORTH IN SECTION 2-148(a) AND SECTION 2-148(b), RESPECTIVELY; CREATING A NEW SECTION 2-158 ENTITLED "OPTIONAL BENEFIT PLAN" PROVIDING FOR AN OPTIONAL BENEFIT PLAN FOR EXISTING AND NEW EMPLOYEES OF THE VILLAGE AND EMPLOYEE CONTRIBUTIONS THEREFORE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE 3 Minutes of Regular Session . President Pro Tem Kelley moved that Bill 815 be enacted as Ordinance 12-96. Councilman O'Meilia seconded the motion, and all present voted aye. BILL 816 -BUDGET APPROPRIATION FOR LIBRARY AUTOMATION -PLACED ON SECOND READING AND ENACTED AS ORD. 13-96 Councilman Vastola moved that Bill 816 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR FISCAL YEAR 1995-96 TO APPROPRIATE FUNDS FOR LIBRARY AUTOMATION be placed on second reading and read by title alone. Vice Mayor Valente seconded the motion, and all present voted aye. President Pro Tem Kelley moved that Bill 816 be enacted as Ordinance 13-96. Councilman O'Meilia seconded the motion, and all present voted aye. RESOLUTION 22-96 ADOPTED -LABOR RELATIONS CONSULTANT AGREEMENT Councilman Vastola moved that Resolution 22-96 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO ENTER INTO A LABOR RELATIONS CONSULTANT AGREEMENT WITH PATRICIA I. TAYLOR, P. A., ATTACHED AS EXHIBIT "A"; AND PROVIDING FOR AN EFFECTIVE DATE be adopted. President Pro Tem Kelley seconded the motion, and all present voted aye. • 4 Minutes of Regular Session • Held Thursday, March 28, 1996 JOB RECLASSIFICATION -GENERAL SERVICES CLERK Councilman Vastola moved to approve reclassification of the General Services Clerk position from pay range 07-20 ($17,353-$23,926) to pay range 10-24 ($18,690-$26,409). President Pro Tem Kelley seconded the motion, and all present voted aye. PALM BEACH GARDENS HIGH SCHOOL "PROJECT GRADUATION" DONATION. Vice Mayor Valente moved to approve a donation to Palm Beach Gardens High School for its "Project Graduation" in the amount of $500.00; funds to be expended from A8229-34932 (Special Events).
