04-25-1996 VC PH3-MMINUTES OF PUBLIC HEARING • OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, APRIL 25, 1996 Present: V. A. Marks, M. D., Mayor Tom Valente, Vice Mayor Larry Kelley, President Pro Tem Gail Vastola, Councilman Charles O'Meilia, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, Village Clerk ROLL CALL Mayor Marks called the meeting to order at 7:34 p.m. All members of Council were present. All members of staff were present. PURPOSE OF THE PUBLIC HEARING The purpose of the Public Hearing was to hear comments from the Public concerning Bill 819, a proposed ordinance of the Village of North Palm Beach, Florida, creating a Planned Unit Development called Sanctuary Cove Phase II, upon certain lands comprising 29.8 acres, more or less, within the Village. COMMENTS FROM THE PUBLIC Warren Avis, Jr., 1201 U. S. Highway One, Suite 435, representing Regents Investment Development Corporation, developers of the property immediately to the north side of Monet Road (Millings Cay), objected not only to the P.U.D., but also to the zoning request. Mr. Avis told the Council that his company has made a substantial investment in their property that is being developed there, and that their investment was based on relatively lower zoning that what is being considered. He further stated that they have sold properties to people based on a certain zoning and made investments based on a certain density, all of which is seemingly up for grabs now. Susan Adams, 729 Pelican Way, reiterated her comments of fhe April 11th meeting, wherein she told the Council that she objected to the granting of a proposed P.U.D. for Sanctuary Cove Phase II. Ms. Adams told the Council that what makes the Village unique is its small-town atmosphere, and that there is already an adequate number of rental apartments within the Village's boundaries. To allow the P.U.D. of Phase II, she • said, would be creating an apartment district. She feels that Village residents want to keep the majority of the Village single-family dwellings. Minutes of Public Hearing • Held Thursday, April 25, 1996 Mr. Johannes Rummeny, 2225 Monet Road, representing Regents Investment Development Corporation, objected to the P.U.D., as he feels it is not desirable for this area. Mr. Rummeny asks that a higher density not be allowed. Martin Stelljes, 729 Osprey Way, stated his opposition to the proposed P.U.D., and feels that there is plenty of multi-family dwellings east of U. S. One. He said that the Prosperity Farms Road area has always been single-family, and he feels the building of Sanctuary Cove Phase I is adequate and that we don't need any more density in the area. Manny Grinn, 536 Greenway Drive, referred to Page 6, Section 10 of the proposed P.U.D. ordinance, wherein it is stated that if this particular development does not go through, it will revert back to the R-2. Mr. Grinn told the Council that this is spot zoning, and spot zoning is illegal. Scott Studer, 2596 Palm Lane, agreed with all previous speakers who disagreed with adding more rentals in that area. Tom Eton, 517 Marlin Road, told the Council that he is against the building of Phase II and more density in the area.
