11-12-1992 VC PH-MMINUTES OF PUBLIC HERRING ' OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, NOVEMBER 12, 1992 Present: Judy M. Pierman, Mayor Thomas F. Kelsey, Ph.D., Vice Mayor Tom Valente, Councilman Gail H. vastola, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, Village Clerk Absent: ROLL CALL V. A. Marks, M. D., President Pro Tem Mayor Pierman called the Public Hearing to order at 7:15 p.m. All members of Council were present except President Pro Tem Marks, who was out of town. All members of staff were present. PURPOSE OF PUBLIC HEARING ' The purpose of the Public Hearing was to hear comments from the Public concerning Bill 698, a proposed ordinance of the Village o£ North Palm Beach, Florida, rezoning a 17.68 acre parcel of island located in Lake Worth, generally known as Little Munyon Island, from zoning classification C-1A Limited Commercial District to C-oS Conservation and Open Space District. Luther M. Taylor, attorney representing Joan Taylor who has fee simple title to Little Munyon Island, was present to address the Council on behalf of Joan Taylor who was also present. Mr. Taylor stated his client's objection to the proposed rezoning of Little Munyon Island from Limited Commercial to Conservation and Open Space District. Mr. Taylor stated that the Land Use Plan which was adopted in 1989 designates the island as Conservation District, and allows no use of the property by the property owner. Mr. Taylor further stated that Florida Statute 164 allowed the Village one year to resolve the conflict between zoning and the Land Use Plan, and that the Village is two years late, although the statute provides that the Comprehensive Land Use Plan takes precedence over the zoning if the zoning is in conflict. Mr. Taylor's contention is that the 1989 Comprehensive Land Use Plan as adopted allows no beneficial economic use allowed by the ' owner of the property, and therefore constitutes a "taking" of the property without compensation. In summary, Mr. Taylor stated for the record that Mrs. Taylor was present at this Public Hearing and objects on the grounds that Minutes of Public Hearing ' Held Thursday, November 12, 1992 under the Village's Comprehensive Land Use Plan, there has been a taking of her property without compensation. Manny Grinn, 536 Greenway Drive, addressed the Council regarding what he feels is governmental regulatory authority versus individual property rights. Mr. Grinn stated that the Village should not take the responsibility of protecting Little Munyon Island, but should place that burden on other governmental agencies such as county, state or federal authorities, as is being done with the Linpro project.
