09-08-2016 VC WS-MMINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA SEPTEMBER 8, 2016 Present: David B. Norris, Mayor Doug Bush, Vice Mayor Darryl C. Aubrey, Sc.D., President Pro Tern Robert A. Gebbia, Councilmember Mark Mullinix, Councilmember James P. Kelly, Village Manager Melissa Teal, Village Clerk ROLL CALL Mayor Norris called the meeting to order at 9:30 p.m. All members of Council were present. All members of staff were present. NORTH PALM BEACH COMMONS MEMORY CARE Discussion was held regarding applications for rezoning, Commercial Planned Unit Development (CPUD) with waivers, and site plan for North Palm Beach Commons Memory Care on a 2.72 acre parcel of property located at 639 U.S. Highway One. Community Development Director Denise Malone gave a presentation summarizing the project and detailing the requested waivers. Mrs. Malone stated the applicant's request includes rezoning from CA Commercial Zoning District to C -1 A Limited Commercial Zoning District, approval of a CPUD with waivers, and site plan approval. Mrs. Malone reported the requested waivers involve changes in tree spacing, a reduction in parking spaces, and increasing the fence height. Mrs. Malone detailed the public meetings and staff meetings that were held regarding the proposed project and stated the Planning Commission recommended denial of the applications as submitted. Mrs. Malone reviewed staff recommendations for modification of the project, as discussed at the August 2016 meeting between the applicant, Village staff, and Treasure Coast Regional Planning Council ( TCRPC), which included: moving the memory care facility to the west part of the site; adding two outparcel buildings to activate the street and create a more mixed -use site; and a possible courtyard or open area that could be used by memory care residents and patrons of the two outparcel buildings. Landowner Marty Perry addressed the Council. Mr. Perry and his partner own the larger of the two parcels that would comprise the land for the proposed project. Mr. Perry displayed three site plans: the original site plan with the prototype building that has been constructed throughout the country; an alternative site plan that includes one outparcel building; and the TCRPC site plan, which proposes two outparcel buildings totaling approximately 18,000 square feet, as well as 12 on- street parking spaces with two outparcel buildings. Mr. Perry noted the challenge to accommodate additional parking for mixed -use retail spaces. Civil engineer Rob Rennebaum discussed constraints related to providing water, sewer, fire protection, and drainage to multiple buildings with separate owners. Mr. Rennebaum supported E one outparcel building on the site, with underground water storage beneath the parking area. Mr. Perry stated a memory care facility is needed in the north county area and would be a good use for the site. Mr. Perry requested direction and input from Council and staff concerning the alternative site plan. Mr. Perry stated there are presently only four properties in the Village with C -lA zoning, none of which work for this project. Discussion tools place regarding flexibility in building design. The Council expressed interest in seeing a project that includes elements suggested in TCRPC's draft Master Plan. Mr. Perry noted the additional investment required in order to try to accommodate TCRPC's proposed site plan, due to engineering and other costs. Mr. Perry stated his willingness to set aside an area for retail use and market the space; however, he did not want to be required to construct the retail space without having identified potential tenants. Mark Ambach, President, Silver Capital Development Company, addressed the Council on behalf of the applicant, Silver Companies. Mr. Ambach described the building and amenities and explained why the facility will be limited to one story. Regarding the building's design, Mr. Ambach advised the only modifications possible would involve a slight reduction to the dining room area. Mr. Ambach expressed willingness to incorporate some elements of the TCRPC plan, and suggested the two parking areas depicted in the alternative plan could be made less visible if separated from U.S. Highway One with low walls, pilasters, lights, and benches on the street side. Mr. Ambach stated two parking areas would make the retail component more marketable, while providing the necessary water treatment area in compliance with water management codes. Members of the public addressed the Council regarding the project. The Council was generally in favor of the TCRPC site plan; however, if that plan proves to be impossible, councilmembers would be willing to consider the applicant's alternative site plan. Because the Planning Commission had not yet received the draft Master Plan when it reviewed the original site plan for the memory care facility, it was suggested that any alternative site plans be presented to the Planning Commission for review prior to further consideration by the Council. ADJOURNMENT With no further business to come before the Council, the meeting adjourned at 10:42 p.m. Melissa Teal, MMC, Village Cleric
