03-22-1990 VC REG-MMINUTES OF REGULAR SESSION OF THS VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MARCH 22, 1990 Present: V. A. Marks, M.D., Mayor ' Jerry G. Gardner, Vice Mayor Judy M. Pierman, President Pro Tem Manny Grinn, Councilman Al Moore, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Dolores R. Walker, Village Clerk ROLL CALL Mayor Pierman called the Regular session to order at 7:30 p.m. All members of the Council and the staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Pierman gave the invocation and Vice Mayor Gardner led the Council and the public in the Pledge of Allegiance to the Flag. ORGANIZATION OF COUNCIL The organization of the Council is required by the Village Charter to be done at the next regular meeting of the Council following the election of any Councilman. Therefore, Council proceeded with its organization in accordance with Article III, Section 3, of the Village Charter. Judy Pierman passed the gavel to Jerry Gardner and nominated V. A. Marks for the office of Mayor of the Village of North Palm Beach. Manny Grinn nominated Al Moore. Manny Grinn moved that nominations be closed. The motion was seconded by Jerry Gardner and all present voted aye. After the ballots were counted, it was determined that V. A. Marks received three votes and Al Moore received two votes; therefore, V. A. Marks was elected Mayor. Jerry Gardner returned the gavel to Judy Pierman. V. A. Marks nominated Al Moore for the office of Vice Mayor of the Village of North Palm Beach. Judy Pierman passed the gavel to Jerry Gardner and nominated Jerry Gardner for the office of Vice Mayor. V. A. Marks moved that nominations be closed. The motion was seconded by Manny Grinn and all present voted aye. After the ballots were counted, it was determined that Jerry Gardner received three votes and Al Moore received two votes; therefore, Jerry Gardner was elected Vice Mayor. Jerry Gardner returned the gavel to Judy Pierman. Jerry Gardner nominated Al Moore for the office of President Pro Tem of the Village of North Palm Beach. He declined the ' nomination. Al Moore nominated Manny Grinn for the office of President Pro Tem. He declined the nomination. V. A. Marks nominated Judy Pierman for the office of President Pro Tem. Prior to the vote being taken on the nomination, Al Moore moved that when the vote was taken that it be by acclamation. The motion was seconded by Jerry Gardner and all present voted aye. Therefore, Judy Pierman was elected President Pro Tem. The ballots shall be attached to the minutes of this meeting. Minutes of Regular Session Held Thursday, March 22, 1990 The Village Manager placed the names of V. A. Marks as Mayor, Jerry Gardner as Vice Mayor, and Judy Pierman as President Pro Tem on proposed Resolution No. 8-90. V. A. Marks moved that Resolution No. 8-90 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, ' FLORIDA, APPOINTING CERTAIN OFFICERS FOR SUCH VILLAGE be adopted. The motion was seconded by Jerry Gardner and all present voted aye. OATHS OF OFFICE ADMINISTERED The Village Clerk administered the Oath of Office to Mayor Marks, Vice Mayor Gardner and President Pro Tem Pierman. These oaths shall be attached to the minutes of the meeting. APPROVAL OF MINUTES The following minutes were approved as written: Minutes of Public Hearing held Thursday, March 8, 1990 Minutes of Regular Session held Thursday, March 8, 1990 The following minutes were approved as corrected: Minutes of Special Session held Wednesday, March 14, 1990 REPORT OF THE MAYOR Mayor Marks, on behalf of the Village, presented a proclamation entitled "Building Safety Week" to Dominic Sims, President of the Building Officials Association of Palm Beach County. BILL 593 PLACED ON SECOND READING & ADOPTED AS ORDINANCE NO. 6-90 Councilman Moore moved that Bill No. 593 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 12 OF THE VILLAGE OF NORTH PALM BEACH CODS, THE FIRE PREVENTION CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD FIRE PREVENTION CODE, 1988 EDITION, AND THE LIFE SAFETY CODE, 1988 EDITION, AS PUBLISHED BY THE NATIONAL FIRE PROTECTION ASSOCIATION AND SETTING FORTH AMENDMENTS TO SAID STANDARD FIRE PREVENTION CODS; PROVIDING FOR THS REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE be placed on second reading and read by title alone. The motion was seconded by Vice Mayor Gardner and all present voted aye. President Pro Tem Pierman moved to adopt Bill No. 593 as Ordinance No. 6-90. The motion was seconded by Vice Mayor Gardner and all present voted aye. ' BILL NO. 594 PLACED ON FIRST READING President Pro Tem Pierman moved that Bill No. 594 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 17 OF THE VILLAGE OF NORTH PALM BEACH CODE, LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS, TO DELETE THE REQUIREMENT FOR AN OCCUPATIONAL LICENSE FOR A CHILDREN'S NURSING HOME AND TO CREATE AN OCCUPATIONAL LICENSE FOR A FAMILY DAY CARE HOME 2 Minutes of Regular Session Held Thursday, March 22, 1990 be placed on first reading and read by title alone. The motion was seconded by Councilman Moore and all present voted aye. BILL NO. 595 PLACED ON FIRST READING Vice Mayor Gardner moved that Bill No. 595 entitled: ' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ARTICLE VI, CODS ENFORCEMENT BOARD, OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE VILLAGE IN ORDER TO BRING SAID ARTICLE VI IN COMPLIANCE WITH CHAPTER 162 OF THE FLORIDA STATUTES; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE be placed on first reading and read by title alone. The motion was seconded by President Pro Tem Pierman with Mayor Marks, vice Mayor Gardner, President Pro Tem Pierman and Councilman Grinn voting aye and Councilman Moore voting nay. COUNTRY CLUB STUDY COMMITTEE NOMINATIONS Council discussed the manner in which the two persons nominated by the Country Club members were to be chosen. Councilman Moore moved that the five people who were nominated by the members of the Country Club be voted on a ballot, listed 1 through 5, and that the top two vote getters are the people who will be appointed. The motion was seconded by President Pro Tem Pierman and passed 3-2, with Vice Mayor Gardner, President Pro Tem Pierman and Councilman Moore voting aye and Mayor Marks and Councilman Grinn voting nay. Council then voted by ballot for the top five nominees; namely John Ridgway, Lucia Traugott, Ross Mitton, Tony Gentile and Arnold Hess. After the ballots were counted, it was determined that John Ridgway and Lucia Traugott were the two persons, chosen by Country Club members, who were appointed by Council to the Country Club Study Committee. COUNTRY CLUB STUDY COMMITTEE APPLICATIONS Council proceeded with the appointment of persons to the Country Club Study Committee who had submitted applications indicating their interest in serving on this committee; however, applications were not necessary for appointment. RECESS The meeting was recessed at 8:45 p.m. and was reconvened at 8:55 p.m. COUNTRY CLUB STUDY COMMITTEE APPLICATIONS (CONT.) Each member of Council placed three names for consideration, with ' the exception of Mayor Marks, who placed one name for consideration, for appointment to the Country Club Study Committee. Council then voted by ballot. upon looking at the results, it was determined that the system of placing three names each for consideration was not workable and the results were not accepted by Council. Thereafter each member of Council agreed to place one name for consideration of appointment, with the exception of Councilman Grinn who placed no name, and Vice Mayor Gardner who placed two names, for a total of five. Councilman Moore moved that nominations be closed. The motion was seconded by Vice Mayor Gardner and all present voted aye. 3 ~"'~ Minutes of Regular Session Held Thursday, March 22, 1990 After the ballots were counted, it was determined that Frank Shone, Chuck Weston and Norman Verdun were appointed to the Country Club Study Committee. The ballots shall be attached to the minutes of this meeting. REVISED AUDIT FOR FISCAL YEAR 1988-89 Vice Mayor Gardner moved to approve the revised Comprehensive Annual Financial Report for year ending September 30, 1989. Mayor Marks passed the gavel to Vice Mayor Gardner and seconded the motion. The motion passed 3-2, with Mayor Marks, Vice Mayor Gardner and President Pro Tem Pierman voting aye and Councilman Grinn and Councilman Moore voting nay. LEASE AGREEMENT - ANCHORAGE PARK BUILDING Councilman Moore moved to authorize the Mayor to sign that Lease Agreement between the Seacoast Utility Authority and the Village of North Palm Beach for the Public safety Department Work Out Room located in the Anchorage Drive wastewater Treatment Plant Building. The motion was seconded by Vice Mayor Gardner and passed 4-1, with Mayor Marks, Vice Mayor Gardner, President Pro Tem Pierman and Councilman Moore voting aye and Councilman Grinn voting nay.
