01-25-1990 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JANUARY 25, 1940 Present: Judy M. Pierman, Mayor Jerry G. Gardner, Vice Mayor V. A. Marks, M.D., President Pro Tem ' Al Moore, Councilman Tom Valente, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Dolores R. Walker, Village Clerk ROLL CALL Mayor Pierman called the Regular Session to order at 7:30 p.m. All members of the Council and the staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Gardner gave the invocation and President Pro Tem Marks led the Council and the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES The following minutes were approved as written: Minutes of Regular Session held Thursday, January 11, 1990 The following minutes were approved as corrected: ' Minutes of Special Workshop Session held Monday, January 16, 1990 REPORT OF THE MAYOR Bruce Sekeres, Director of Public Safety, was out of town and could not be present at the meeting to accept his Fifteen Year Service Award or his Graduation Certificate from the FBI Academy. Therefore, Mayor Pierman displayed the Service Award and the Graduation Certificate so that the audience was aware of what will be presented to Bruce at a later date. Mayor Pierman, on behalf of the Village, presented a plaque to George W. Baldwin in recognition of his service on the Code Enforcement Board. ACCEPTANCE OF MINUTES The following minutes were accepted as written: Minutes of Code Enforcement Board Meeting held January 8, 1990 Minutes of Public Hearing on Application of a PUD for Milling ' Marina held January 9, 1990 Minutes of Public Hearing on Application for Platting Milling Marina held January 9, 1990 Minutes of Regular Meeting o£ Planning Commission held January 9, 1990 PLANNING COMMISSION RECOMMENDATION POSTPONED Councilman Valente moved to postpone the recommendation of the Planning Commission concerning the approval of the PUD of Harbour Point Marina until the next Regular session of the Village Council (February 8, 1990). ORDINANCE NO. 29-90 PLACED ON SECOND READING - (ROBALO COURT) Councilman Valente moved that ordinance No. 29-90 entitled: ' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ANNEXING TO THE VILLAGE CERTAIN AREAS OF PROPERTY; PROVIDING A LEGAL DESCRIPTION OF THE PROPERTY PROPOSED TO BE ANNEXED; REDEFINING THE BOUNDARIES OF THE VILLAGE TO INCLUDE SAID PROPERTY; CALLING FOR A REFERENDUM ELECTION IN THE VILLAGE AND WITHIN THE AREA PROPOSED TO BE ANNEXED; DIRECTING THE VILLAGE CLERK TO PUBLISH NOTICE OF THE REFERENDUM; AND PROVIDING AN EFFECTIVE DATE be placed on second reading and read by title alone. The motion was seconded by President Pro Tem Marks and passed 4-1, with Mayor Pierman, Vice Mayor Gardner, President Pro Tem Marks and Councilman Valente voting aye and Councilman Moore voting nay. ORDINANCE NO. 29-90 ADOPTED Councilman Valente moved to adopt Ordinance No. 29-90. The motion was seconded by Vice Mayor Gardner and passed 4-1, with Mayor Pierman, Vice Mayor Gardner, President Pro Tem Marks and Councilman Valente voting aye and Councilman Moore voting nay. BILL NO. 587 PLACED ON FIRST READING Councilman Valente moved that Bill No. 587 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR FISCAL YEAR 1989-90 BY APPROPRIATION TRANSFER FROM THE COUNCIL CONTINGENCY FOR CONTRIBUTION TO INTER-CITY FIRST AID SQUAD be placed on first reading and read by title alone. The motion was seconded by President Pro Tem Marks and passed 4-1, with Mayor Pierman, Vice Mayor Gardner, President Pro Tem Marks and Councilman Valente voting aye and Councilman Moore voting nay. RESOLUTION NO. 1-90 ADOPTED AS AMENDED councilman Moore moved that Resolution No. 1-90 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF WORRYBIRD ENTERPRISES, LAKE PARK, FL, FOR LAWN MAINTENANCE IN THE AMOUNT OF $3,984.00 LUMP SUM FOR THE PERIOD FEBRUARY 1, 1990 THROUGH SEPTEMBER 30, 1990. THE FUNDS ARE TO BE EXPENDED AS FOLLOWS: $2,285.23 FROM GENERAL SERVICES ACCOUNT NO. A5509-33490, LAWN MAINTENANCE, AND $1,698.77 FROM LIBRARY, ACCOUNT NO. A7927-33490, LRWN MAINTENANCE Minutes of Regular Session Held Thursday, January 25, 1990 Page 3 be adopted. The motion was seconded by Vice Mayor Gardner. Vice Mayor Gardner moved to eliminate the term "lump sum" from the title of the resolution. The motion was seconded by Councilman Moore and all present voted aye. ' Thereafter Council voted on the main motion, as amended, which passed unanimously. 5~ INCREASE FOR BILL REINERT FOR ADDITIONAL JOB RESPONSIBILITIES Councilman Moore moved to compensate Mr. Bill Reinert retroactively for the, six weeks he performed double duty as both Street Maintenance Supervisor and Golf Course Maintenance Superintendent at 5~ above his base salary, for a total of $167.88. The motion was seconded by President Pro Tem Marks and all present voted aye. DONATION OF NEW RADAR UNIT - PUBLIC SAFETY President Pro Tem Marks moved to declare the old radar unit (HR12) as surplus, and to authorize to exchange it with Mr. Ed. Ashton in return for the donation of a Kuston Trooper F Radar Unit in the amount of approximately $1,000.00, to be transferred by bill of sale, as is, with no warranty other than title. The motion was seconded by Councilman Moore and all present voted aye. MAC ARTHUR PARK TRAILERS - SEPTIC TANKS Councilman Moore moved to table the extension of mobile home permit until the letter from Florida Park Service is received, as was requested by the Village Council at their January 11, 1990 meeting. The motion was seconded by Vice Mayor Gardner and all present voted aye. BUDGET TRANSFER - GOLF COURSE MAINTENANCE OVERTIME PAYMENTS Councilman Valente moved to transfer $6,000.00 from Account No. L8045-35223 (Fertilizers) to Account No. L8045-11400 (Regular Overtime Pay) for purposes of offsetting the approximately $4,000.00 incurred in addition to re-establishing a $2,000.00 overtime account for the remainder of the fiscal year. The motion was seconded by President Pro Tem Marks and all present voted aye. DESIGNATION OF VILLAGE'S REPRESENTATIVE FOR L & A TESTS President Pro Tem Marks moved to designate Mrs. Jackie Winchester, supervisor of Elections, or her designee, as the Village's representative for the Logic and Accuracy testing of the tabulating equipment for Friday, March 9, 1990, at the Palm Beach Governmental Center, for the Village 8lection of March 13, 1990 and the Runoff Election, should there be one. The motion was seconded by Vice Mayor Gardner and all present voted aye. BUDGET TRANSFER - 1% SALARY INCREASE Councilman Moore moved to transfer $3,189.00 from Reserve - COLA and Benefit to various accounts in the Country Club Fund; and to transfer $15,981.00 from Reserve - COLA and Benefit to various accounts in the General Fund to cover the additional 1~ salary increase.
