02-22-1990 VC REG-MMINUTES OF REGULAR SESSION OF THS VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, FEBRUARY 22, 1990 Present: Judy M. Pierman, Mayor Jerry G. Gardner, Vice Mayor V. A. Marks, M.D., President Pro Tem Al Moore, Councilman Tom Valente, Councilman Dennis W. Kelly, Village Manager George W. Baldwin, Village Attorney Dolores R. Walker, Village Clerk ROLL CAT.T. Mayor Pierman called the Regular Session to order at 7:30 p.m. .All members of the Council and the staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Pierman gave the invocation and Vice Mayor Gardner led the Council and the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES The Minutes of Regular Session held Thursday, February 8, 1990 were approved as written. REPORT OF THE MAYOR ' Mayor Pierman, on behalf of the Village, presented a Proclamation entitled "45th Anniversary of the Visiting Nurse Association" to Cathy Coleman, Vice President, Community Relations, of the Association. Mayor Pierman, on behalf of the Village, presented a Proclamation, entitled "William E. Carson Day" (March 7, 1990) to Bill Carson in recognition of his thirty years of dedicated volunteer service on the North Palm Beach Volunteer Fire Department. Chuck Eldred, Film Liaison officer for Palm Beach County, gave a brief presentation on One Stop Permitting for the film industry in Palm Beach County. ACCEPTANCE OF MINUTES The following minutes were accepted as written: Minutes of Library Advisory Board Meeting held January 23, 1990 Minutes of Recreation Advisory Board Meeting held January 9, 1990 Minutes of Recreation Advisory Board Meeting held February 13, 1990 The following minutes were accepted as corrected: Minutes of Code Enforcement Board Meeting held February 5, 1990 RECOMMENDATIONS OF ADVISORY BOARDS Vice Mayor Gardner moved that the recommendation of the Recreation Advisory Board that Council reconsider the membership proration policy for tennis on a quarterly basis for first-time members only, be approved. The motion died for lack of a second. Minutes of Regular Session Held Thursday, Feb. 22, 1990 Page 2 Councilman Moore moved to deny the aforementioned recommendation. The motion was seconded by President Pro Tem Marks and passed 4-1, with Vice Mayor Gardner voting nay. BILL 589 PLACED ON SECOND READING AND ADOPTED AS ORDINANCE NO. 3- 90 Councilman Valente moved that Bill No. 589 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR FISCAL YEAR 1989-90 BY APPROPRIATION TRANSFER FROM THE COUNCIL CONTINGENCY FOR LEGAL ADVERTISING be placed on second reading and read by title alone. The motion was seconded by Councilman Moore and all present voted aye. President Pro Tem Marks moved that Bill No. 589 be adopted as Ordinance No. 3-90. The motion was seconded by Vice Mayor Gardner and all present voted aye. BILL NO. 590 PLACED ON FIRST READING Vice Mayor Gardner moved that Bill No. 590 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING THE STANDARD BUILDING, GAS, MECHANICAL AND PLUMBING CODES, 1988 EDITION, AND THS COUNTYWIDE AMENDMENTS THERETO, PROVIDING FOR REPEALS OF LAWS IN CONFLICT; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE be placed on first reading and read by title alone. The motion was seconded by President Pro Tem Marks and all present voted aye. BILL NO. 591 PLACED ON FIRST READING President Pro Tem Marks moved that Bill No. 591 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 15 OF THE VILLAGE OF NORTH PALM BEACH CODS, THE HOUSING CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD HOUSING CODE, 1988 EDITION, AND SETTING FORTH AMENDMENTS TO SAID STANDARD HOUSING CODE be placed on first reading and read by title alone. The motion was seconded by Vice Mayor Gardner and all present voted aye. RESOLUTION NO. 4-90 ADOPTED Councilman Valente moved that Resolution No. 4-90 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, URGING THE BOARD OF COUNTY COMMISSIONERS OF PALM 1 BEACH COUNTY AND THE PALM BEACH COUNTY LEGISLATIVE DELEGATION NOT TO SUPPORT THS TRANSFER OF ALL ASSETS AND LIABILITIES FROM THE SOLID WASTE AUTHORITY OF PALM BEACH COUNTY TO THE BOARD OF COUNTY COMMISSIONERS, AND NOT TO SUPPORT A RESTRUCTURING OF THE SOLID WASTE AUTHORITY BOARD be adopted. The motion was seconded by Councilman Moore and all present voted aye. PUBLIC SAFETY FORFEITURE EXPENDITURE Councilman Moore moved to approve the purchase of a body shield for use in hands-on training and annual recertification of officers in af~_~ Minutes of Regular Session Held Thursday, Feb. 22, 1990 Page 3 baton use, in the amount of $80.00, to be expended from the Fines and Forfeiture Account. The motion was seconded by President Pro Tem Marks and all present voted aye. MaCARTHUR PARK TRAILERS - SEPTIC TANKS ' Councilman Moore moved to allow two trailers to remain with the installed septic tank system at MacArthur Beach State Park per letter of February 9, 1990 from Richard A. Domroski, Manager, District 7 Administration, State of Florida, Department of Natural Resources (copy of which is attached to the minutes of this meeting). The motion was seconded by Councilman Valente and passed 4-1, with Mayor Pierman, Vice Mayor Gardner, Councilman Moore and Councilman Valente voting aye and President Pro Tem Marks voting nay. Comprehensive Plans for both the Village and Palm Beach County designate MacArthur Beach State Park as a Conservation Area, the only area within the village so designated. Farther; the Village plan designates MacArthur Park as a non-urban Service Area. Again, the only such designation within the Village. We request that the Village include in these-designations provisions to ,allow permitting of septic tank systems (no central collection system will be available) and mobile or manufactured housing units: For your general information, the function of the recently approved septic treatment units and a standard septic tank system provide the same basic level of treatment and both discharge to a drainfield. We have discussed septic tank use with the Palm Beach County Health Unit and they have no problems with permitting. Your thoughtful consideration will be appreciated. Sincerely, ~ Richard A.
