03-23-1989 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MARCH 23, 1989 Present: Judy M. Pierman, Mayor Jerry G. Gardner, Vice Mayor V. A. Marks, M.D., President Pro Tem ' Al Moore, Councilman Tom Valente, Councilman Dennis W. Kelly, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Vice Mayor Pierman called the Regular Session to order at 7:30 ROLL CALL p.m. All members of the Council and the staff were present. Councilman Marks gave the invocation and Councilman Gardner led INVOCATION & the Council and the public in the Pledge of Allegiance to the PLEDGE OF Flag. ALLEGIANCE The organization of the Council is required by the Village ORGANIZATION Charter to be done at the next regular meeting of the Council OF COUNCIL following the election of any Councilman. Therefore, Council proceeded with its organization in accordance with Article III, Section 3, of the Village Charter. Councilman Marks nominated Judy Pierman for the office of Mayor J. PIERMAN of the Village of North Palm Beach. There being no further ELECTED nominations, Judy Pierman was elected Mayor. MAYOR Vice Mayor Pierman passed the gavel to President Pro Tem Valente and nominated Jerry Gardner for the offi f Vi M J. GARDNER ce o ce ayor of the ELECTED Village of North Palm Beach. There being no further nominations, VICE MAYOR Jerry Gardner was elected Vice Mayor. Jerry Gardner nominated V. A. Marks for the office of President V. A. MARKS Pro Tem of the Village of North Palm Beach. There being no ELECTED PRES. further nominations, V. A. Marks was elected President Pro Tem. PRO TEM Councilman Moore moved that Resolution No. 12-89 entitled: RES. 12-89 ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING CERTAIN OFFICERS FOR SUCH VILLAGE be adopted. The motion was seconded by President Pro Tem Valente and passed unanimously. President Pro Tem Valente returned the gavel to Vice Mayor Pierman. The Village Clerk administered the Oath of Ofifice to Mayor OATH OF OFFICE Pierman, Vice Mayor Gardner and President Pro Tem Marks. These ADMINISTERED oaths are in accordance with Section 2-41 of the Village Code and ' shall be spread upon the minutes of the Council. The following minutes were approved as written: APPROVAL OF MINUTES Minutes of Regular Session held Thursday, March 9, 1989 Minutes of Special Session held Wednesday, March 15, 1989 Councilman Al Moore read the following statement into the AL MOORE'S record: STATEMENT FOR THE RECORD North Palm Beach Council Members have historically not taken partisan positions in Council-races. This was founded in Minutes of Regular Session Held Thursday, March 23, 1989 Page 2 concepts which were important to good government in the Village. During the last election, one Council Member led a group dedicated to supporting two Council candidates for the apparent purpose of proving that Councilman with support on the Village Council if his election choices were voted in. ' The plan did not work and the support of one Council Member for a candidate went unrewarded; but the problems that it poses for the future do not bode well for the Uillage. Accordingly, I would recommend that as a policy statement the Village Council support a proposition that Village Councilmen do not endorse candidates for the Village Council positions. Some of the reasons for this historic conduct of virtually every Councilperson has been an understanding that Uillage residents are better served by persons who are independent in their thought as they approach the Village problems. This has led to varying majorities on some issues and usually to unanimous votes on others since persons elected to the Village Council have been civic minded and interested in the good of the Village as contrasted with personal gain for themselves. It is suggested that this be merely a policy and something not legally binding on members of the Council. It is hoped, however, that Council Persons, being men and women of integrity and honor, would subscribe to this concept. To the contrary, if the Village Councilmen seek persons who will support them in office, the independence of each Council Person is affected and the work of the Council can turn into ' a personal power play rather than a search for what is in the best interests of Village residents. Our Councils have always been non-partisan and have been remarkably free of cliques which vote together regardless of the merits of issues. This can only continue if members of the council accept the determination of the electorate and do not attempt to personally influence the voters to establish them in positions of power relative to other Council Persons. Finally, this individual attempt to have supporters of a Council Person elected not only robs the new Councilman elected with support of a seated member from being independent, but, if the opponent of that person is elected, then a new Council could begin with personal animosity and ill will that is hardly conducive to the thoughtful and unselfish government which has governed North Palm Beach for these many years. Mayor Pierman, on behalf of the Village Council, presented a PRESENTATION OF proclamation on "North Palm Beach Building Safety Week" to Ken PROCLAMATION - Loihle, Treasurer of the Building Officials Association of Palm. "NPB BUILDING Beach County, and Building Official for Riviera Beach. SAFETY WEEK" Mayor Pierman, on behalf of the Village Council, presented a PRESENTATION OF ' proclamation on "American Red Crass Month" to Bob Landon, a PROCLAMATION - member of the North County Advisory Council of the Red Cross. OF NORTH PALhI BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR FISCAL YEAR 1988-89 BY APPROPRIATION TRANSFER FROPA THE COUNCIL CONTINGENCY FOR THE NEW VILLAGE MANAGER'S AUTO AND P40VING EXPENSES be placed on second reading and read by title alone. The motion was seconded by Vice Mayor Gardner and passed unanimously. Vice Mayor Gardner moved that Bill No. 565 be adopted as Ordinance No. 8-89. The motion was seconded by Councilman Valente and passed unanimously. Vice Mayor Gardner moved that Bill No. 566 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR FISCAL YEAR 1988-89 BY APPROPRIATION TRANSFER FROM THE COUNCIL CONTINGENCY FOR LEGAL ADVERTISING be placed on first reading and read by title alone. The motion was seconded by President Pro Tem Marks and passed unanimously. ' President Pro Tem Marks moved to transfer $18,000.00 from Account No. 10-519-061-49911 (Council Contingency) to Account No. 10-519-035-33120 (Engineering Services) for additional fuhding to complete the testing work and preparation of bid specifications for the Remedial Action Plan for gas tanks at the Public Works Department. The motion was seconded by Councilman Valente and passed unanimously. Councilman Valente moved to approve the purchase of a cable crossover machine for the Public Safety Department's weight room in the amount of $1,095.00, to be expended from the Forfeiture Funds. The motion was seconded by Vice Mayor Gardner and passed unanimously. Councilman Moore moved to review the contract with Kenova Construction Corporation for renovation of the golf course at the North Palm Beach Country Club. Mayor Pierman passed the gavel to Vice Mayor Gardner and seconded the motion. The motion failed 1-4, with Councilman Moore voting aye, and Mayor Pierman, Uice Mayor Gardner, President Pro Tem Marks and Councilman Valente voting nay. Vice Mayor Gardner returned the gavel to Mayor Pierman. There being no further business to come before the Council, the ' meeting was adjourned at 8:10 p.m. Dolores R.
