11-13-1986 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF-NORTH PALM BEACH, FLORIDA HELD THURSDAY, NOVEMBER 13, 1986 Present: Craig Mundt, Mayor Tom Valente, Vice Mayor Kenneth H. Mays, D.M.D., President Pro Tem V. A. Marks, M.D., Councilman Judy M. Pierman, Councilman Raymond J. Howland, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Mayor Mundt called the Regular Session to order at 7:33 p.m. All members of the Council and the staff were present. Vice Mayor Valente gave the invocation and Councilman Marks led the Counci 1 and the publ i c i n the Pledge of Allegiance to the Flag. The Minutes of Regular Session held Thursday, October 23, 1986 were approved as written. Mayor Mundt read and signed a proclamation, proclaiming the week of November 16 through November 22, 1986 to be "Alzheimer"s Disease Public Awareness Week". The following minutes were accepted as written: Minutes of Regular Meeting of Planning Commission held October 7, 1986 Minutes of Code Enforcement Board Meeting held November 3, 1986 Vice Mayor Valente moved that Bill No. 497 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING A COASTAL BUILDING ZONE BUILDING CODE AS REQUIRED BY SECTIONS 161.52 THROUGH 161.58, FLORIDA STATUTES, THE COASTAL ZONE PROTECTION ACT OF 1985, AS AMENDED, ADOPTING THE REQUIREMENTS ESTABLISHED IN SECTION 161.55, FLORIDA STATUTES, AND PROVIDING AN EFFECTIVE DATE FOR THIS ORDINANCE be placed on first reading and read by title alone. The motion was seconded by Councilman Marks and passed unanimously. Councilman Marks moved that Bill No. 491 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 6 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE BUILDING CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD BUILDING CODE, 1985 EDITION, INCLUDING APPENDICES B, C, E, I, 0 AND R THERETO, SETTING FORTH AMENDMENTS TO SAID STANDARD BUILDING CODE. be placed on second reading and read by title alone. The motion was seconded by President Pro Tem Mays and passed unanimously. Councilman Pierman moved that Bill No. 491 be adopted as Ordinance No. 16-86. The motion was seconded by Councilman Pierman and passed unanimously. Councilman marks moved that Bill No. 496 be adopted as Ordinance No. 21-86. The motion was seconded by President Pro Tem Mays and passed unanimously. Vice Mayor Ualente moved that Resolution No. 24-86 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF WIMER-STUBBS, BOCA RATON, FLORIDA, FOR A GYMNASIUM DIVIDER FOR THE COMMUNITY CENTER IN THE AMOUNT OF $7,973.70 FROM CONSTRUCTION ACCOUNT N0. 31-572-888-66213 be adopted. The motion was seconded by Councilman Marks and passed unanimously. Vice Mayor Valente moved that Resolution No. 25-86 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, ' FLORIDA, ACCEPTING THE BID OF MONROE SYSTEMS, HOLLYWOOD, FLORIDA, FOR PUBLIC SAFETY COMPUTER SYSTEM IN THE AMOUNT OF $13,528.00 FROM ACCOUNT N0. 10-021-521-66000 (CAPITAL OUTLAY) be adopted. The motion was seconded by Councilman Marks and passed unanimously. President Pro Tem Mays moved that Resolution No. 26-86 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, APPROVING THE TRANSFER OF CONTROL OF PERRY CABLE TV CORP. TO CENTEL COMMUNICATIONS COMPANY AND THE TRANSFER OF THE COMMUNITY ANTENNA TELEVISION SYSTEM FRANCHISE HELD BY PERRY CABLE TV CORP. TO CENTEL CABLE TELEVISION COMPANY OF FLORIDA be adopted. The motion was seconded by Councilman Pierman and passed unanimously. Councilman Marks moved that we accept the Proposal from Edward Don & Company, Ft. Lauderdale, Florida, for an Aaladin Hot Water Cleaning Unit #1450 in the amount of $3,033.00 to be expended from Account No. 10-514-035-66490 (Other Machinery & Equipment). The motion was seconded by President Pro Tem Mays and passed unanimously. Councilman Pierman moved that we accept the Proposal from Mark E. Snapp Tree Service, Inc., Lantana, Florida, for removal of the Australian Pine trees around the tennis courts at the North Palm Beach Country Club in the amount of $2,600.00, to be expended from Account No. 41-572-131-34620 (R & M Building and Grounds). The motion was seconded by Councilman Marks and passed unanimously. BILL 496 PLACED ON SECOND READING BILL 496 ADOPTED AS ORD. 21-86 RES. 24-86 ADOPTED RES. 25-86 ADOPTED RES. 26-86 ADOPTED EQUIPMENT CLEANING MACHINE - PUBLIC SERVICES DEPT. PROPOSAL - 000NTRY CLUB TREE REMOVAL Minutes of Regular Session Held Thursday, November 13, 1986 Page 4 Uice Mayor Valente moved that we approve retroactive pay for the three retired employees covered by the NAGE contract. The motion was seconded by Councilman Marks and passed unanimously. ' Councilman Pierman moved that we approve Village support of the Christmas in Dixie Parade, which is to be held Sunday, December 14, 1986. The motion was seconded by President Pro Tem Mays and passed unanimously. Councilman Marks moved that we authorize the Mayor to sign the proposed contract between the Village and Forbes Labor Relations Service, Inc. for labor relations service (which shall become effective upon execution for a period of one year). The motion was seconded by Vice Mayor Valente and passed 3-2, with Mayor Mundt, Vice Mayor Valente and Councilman Marks voting aye, and President Pro Tem Mays and Councilman Pierman voting nay. Mayor Mundt passed the gavel to Vice Mayor Valente and moved that the Village of North Palm Beach not level a civil penalty of $100.00 against James Titzel, as recommended by the State of Florida Commission on Ethics. The motion was seconded by Councilman Marks and passed unanimously. Vice Mayor Valente returned the gavel to Mayor Mundt. RETROACTIVE PAY - RETIRED NAGE EMPLOYEES CHRISTMAS IN DIXIE PARADE LABOR RELATIONS CONTRACT - FORBES LABOR RELATIONS SERVICE, INC. VILLAGE NOT TO LEVEL CIVIL PENALTY OF $100 AGAINST JIM TITZEL Councilman Marks moved that the law firm of Nason, Gildan, Yeager NASON, GILDAN, & Gerson is authorized to defend the Village in the law suit YEAGER & GERSON TO against it by Vernon Moore. The motion was seconded by President DEFEND VILLAGE IN ' Pro Tem Mays and passed unanimously.
