09-12-1985 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 12, 1985 Present: Tom Valente, Mayor Al Moore, Vice Mayor Harriet Nolan, President Pro Tem V. A. Marks, M. D., Councilman Craig Mundt, Councilman Raymond J. Howland, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Mayor Valente called the Regular Session to order at 7:32 p.m. All members of the Council were present except Councilman Mundt who arrived at 8:15 p.m. All members of the staff were present. Councilman Marks gave the invocation and President Pro Tem Nolan led the Council and the public in the Pledge of Allegiance to the Flag. The Minutes of Regular Session held Thursday, August 22, 1985 were approved as written. Mayor Valente, on behalf of the Village, presented a Proclamation to Iva Perry Ramsay, Vice Regent, DAR Seminole Chapter, proclaiming the week of September 17 through 23, 1985 as "Constitution Week" in the Village of North Palm Beach. The following minutes stand as prepared: Minutes of Regular Meeting of Board of Adjustment held August 6, 1985 Minutes of Regular Meeting of Planning Commission held August 6, 1985 Minutes of Library Advisory Board Meeting held August 27, 1985. The following minutes stand as corrected: Minutes of Regular Meeting of North Palm Beach Country Club Advisory Board held August 20, 1985 Concerning the recommendation of the Country Club Advisory Board that Council consider the system of Electrical Savings Program, Inc. to reduce the cost of electricity at the North Palm Beach Country Club, Vice Mayor Moore moved that we send this recommendation back to the Village Manager and Village staff far further study. The motion was seconded by President Pro Tem Nolan and passed unanimously. Councilman Marks moved that Bill No. 470 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ANMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY LIMITING THE LOCATION OR PLACES OF BUSINESS WHERE SUCH ALCOHOLIC BEVERAGES MAY BE 50LD IN RELATION TO CHURCHES, SCHOOLS, HOSPITALS, PARKS AND PLAYGROUNDS, RESTAURANTS AND PUBLIC LICENSED RETAIL SELLERS OF ALCOHOLIC BEVERAGES ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES PRESENTATION OF PROCLAMATION - "CONSTITUTION WEEK" ACCEPTANCE OF MINUTES CC AD. The motion was seconded by Vice Mayor Moore ADOPTED AS and passed unanimously. ORD. 15-85 Vice Mayor Moore moved that Bill No. 473 entitled: BILL 473 PLACED ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, FIRST READING AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1984-85 & READ IN FULL BY APPROPRIATION TRANSFERS be placed on first reading and read in full. The motion was seconded by President Pro Tem Nolan and passed unanimously. Vice Mayor Moore moved that Bill No. 473 be placed on second BILL 473 PLACEQ reading and read by title alone. The motion was seconded by ON SECOND REA NG President Pro Tem Nolan and passed unanimously. & READ BY TITLE ALONE Councilman Marks moved that Bill No. 473 be adopted as Ordinance BILL 473 No. 16-85. The motion was seconded by President Pro Tem Nolan ADOPTED AS and passed unanimously. ORD. 16-85 The reason for this ordinance being adopted on an emergency basis REASON FOR is that we have a leaky roof at the North Palm Beach Library ADOPTING ORD. which is damaging valuable property and which needs to be ON EMERGENCY replaced immediately. BASIS Vice Mayor Moore moved that Bill No. 472 entitled: BILL 472 PLACED ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, FIRST READING ' ADOPTING BUDGETS FOR THE FISCAL YEAR OCTOBER 1, 1985, TO SEPTEMBER 30, 1986, BOTH INCLUSIVE FOR THE VILLAGE OF NORTH PALM BEACH GENERAL FUND, INCLUDING DEBT RETIREMENT, AND FOR THE NORTH PALM BEACH COUNTRY CLUB REVENUE FUND TOGETHER WITH THE FEDERAL REVENUE SHARING FUND: AND REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE be placed on first reading and read by title alone. The motion was seconded by Councilman Marks and passed unanimously. Councilman Marks moved that Resolution No. 34-85 entitled: RES. 34-85 ADOPTED A RESOLUTION OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF STANDARD ROOFING & SHEET METAL WORKS, INC. FOR REROOFING NORTH PALM BEACH LIBRARY IN THE AMOUNT OF $24,447.00, FROM ACCOUNT NO. 10-571-041-34620 (R&M - BUILDING AND GROUNDS) be adopted. The motion was seconded by President Pro Tem Nolan and passed unanimously. Vice Mayor Moore nominated Carol T. Hurst for appointment to the CAROL HURST Code Enforcement Board. There being no further nominations, APPOINTED TO she was appointed to the Board for a term ending May 1, 1986. CODE ENFORCEMENT BD. President Pro Tem Nolan moved that Resolution No. 35-85 RES. 35-85 entitled: ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING A MEMBER TO THE CODE ENFORCEMENT BOARD OF THE VILLAGE OF NORTH PALM BEACH be adopted. The motion was seconded by Vice Mayor Moore and passed unanimously. The motion was seconded by President Pro ENGINE N0. 2 Tem Nolan and passed unanimously. Vice Mayor Moore moved that we do not authorize the Village MGR. NOT AUTHOR- Manager to search for a "Cable TV Expert" and do not budget any IZED TO SEEK TV money for this. The motion was seconded by Councilman Marks and EXPERT OR BUDGET passed unanimously. $50,000 FOR SAME Councilman Marks moved to add to the agenda reconsideration of ITEM RE PERRY letter of July 11, 1985 from Perry Cable TV (copy of which is CABLE TV ADDED attached to the minutes of this meeting) which we voted on TO AGENDA approximately two weeks ago that the cost for the basic cable outlets be increased as outlined in the letter, and these rates do not go into effect until January 1, 1986, and -that we reconsider the motion and place it back on the floor. The motion was seconded by Councilman Mundt and passed 3-2, with Vice Mayor Moore and President Pro Tem Nolan opposed. Councilman Marks moved that we approve Perry Cable's proposed COUNCIL APPROVED rate increases effective January 1, 1986 as set forth in the July PERRY CABLE TV'S 11, 1985 letter from Perry Cable TV to the Village Council, with PROPOSED RATE the provisos set forth in the letter of July 24, 1985 from INCREASES Herbert L. Gildan, Village Attorney, to Ray Howland, Village Manager, reference Perry Cable TV, as listed below. They (Perry) will: Drop their Circuit Court suit against the Village to seek damages for the lower rates Village residents have paid them for the past several years; They will agree that when deregulation comes, they will not take any action against Village rate payers to recoup the losses they have allegedly suffered as a result of their inability to charge higher rates in North Palm Beach; They will not require the Village to give them the same full rate hearing previously granted; and They will begin an upgrading of cable TV lines within the Village of North Palm Beach in order to provide the best service to Village residents immediately, rather than deferring any upgrading of their equipment in North Palm Beach until deregulation occurs a year later. The motion was seconded by Councilman Mundt and passed 3-2, with Vice Mayor Moore and President Pro Tem Nolan opposed. President Pro Tem Nolan moved that the crossing guard that is at MOTION TO EXTEND the corner of Prosperity Farms Road and Lighthouse Drive have her HOURS OF CROSSING hours extended in the afternoon until 4:00 p.m. This will be one GUARD AT PROSPER- hour per day in the amount of 180 hours x $5.25, for a total of ITY & LIGHTHOUSE $945.00. Mayor Valente passed the gavel to Vice Mayor Moore and seconded the motion for discussion. Mayor Valente amended the motion as follows: that the one guard MOTION AMENDED at Lighthouse Drive and Prosperity Farms Road start at 2:00 p.m. and work unti 1 4:00 p.m. , at a cost of $500.00 per year. The motion was seconded by Councilman Marks for discussion and passed 4-1, with Councilman Mundt opposed. Thereafter Council voted on the main motion, as amended, which MAIN MOTION passed unanimously.
