03-14-1985 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MARCH 14, 1985 Present: Tom Valente, Mayor Al Moore, Vice Mayor ' Harriet Nolan, President Pro Tem V. A. Marks, M. D., Councilman Craig Mundt, Councilman Raymond J. Howland, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Mayor Marks called the Regular Session to order at 7:30 p.m. All members of the Council and the staff were present. Councilman Valente gave the invocation and Vice Mayor Moore led the Council and the public in the Pledge of Allegiance to the flag. The organization of the Council is required by the Village Charter to be done at the next regular meeting of the Council following the election of any Councilman. Therefore, Council proceeded with its organization in accordance with Article III, Section 3, of the Village Charter. President Pro Tem Nolan nominated Al Moore for the office of ' Mayor of the Village of North Palm Beach. Mayor Marks nominated Craig Mundt. Vice Mayor Moore declined the nomination for Mayor and nominated Tom Valente for the office of Mayor. Council then voted by ballot on the nominations for Mayor. Tom Valente received three votes and Craig Mundt received two votes; therefore, Tom Valente was elected Mayor. Vice Mayor. Moore nominated Harriet Nolan for the office of Vice Mayor for the Village of North Palm Beach. Mayor Marks nominated Craig Mundt. President Pro Tem Nolan nominated Al Moore. Council then voted by ballot on the nominations for Vice Mayor. Al Moore received three votes and Craig Mundt received two votes; therefore, Al Moore was elected Vice Mayor. ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE COUNCIL ORGANIZATION TOM VALENTE ELECTED MAYOR AL MOORE ELECTED VICE MAYOR Vice Mayor Moore nominated Harriet Nolan for the office of HARRIET NOLAN President Pro Tem for the Village of North Palm Beach. Mayor ELECTED PRESIDENT Marks nomianted Craig Mundt. Council then voted by ballot on the PRO TEM nominations for President Pro Tem. Harriet Nolan received three votes and Craig Mundt received two votes; therefore, Harriet Nolan was elected President Pro Tem. The ballots shall be spread upon the minutes of the Council. The Village Manager placed the names of Tom Valente as Mayor, Al PLACEMENT Moore as Vice Mayor, and Harriet Nolan as President Pro Tem on OF NAMES ON ' proposed Resolution No. 9-85. RES. 9-85 President Pro Tem Nolan moved that Resolution No. 9-85 entitled: RES. 9-85 ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING CERTAIN OFFICERS FOR SUCH VILLAGE be adopted. The motion was seconded by Vice Mayor Moore and passed unanimously. Minutes of Regular Session Held Thursday, March 14, 1985 Page 2 The Village Clerk administered the Oath of Office to Mayor OATHS OF Valente, Vice Mayor Moore and President Pro Tem Nolan. These OFFICE oaths are in accordance with Section 2-41 of the Village Code and ADMINISTERED shall be spread upon the minutes of the Council. Former Mayor Marks turned the gavel over to Mayor Valente. GAVEL TURNED OVER TO MAYOR ' VALENTE The following minutes were approved as written: APPROVAL OF MINUTES Minutes of Regular Session held Thursday, February 28, 1985 Minutes of Special Session held Wednesday, March 13, 1985 The following minutes stand as prepared: ACCEPTANCE OF MINUTES Minutes of Regular Meeting of North Palm Beach Country Club Advisory Board held February 19, 1985 Minutes of Pension Board Meeting for General Employees held February 25, 1985 Minutes of Code Enforcement Board Meeting held March 4, 1985 The following minutes are to be redone and returned to Council in condensed form: ' Minutes of Pension Board Meeting for Police/Fire Employees held January 31, 1985 Councilman Marks moved that we accept the recommendation of the CC AD. BD. Country Club Advisory Board to resurface the pool areas damaged RECOMMENDATION by the removal of the Tiki Hut and the southeast corner of the APPROVED pool deck at a cost of $1,350.00, the funds to be expended from the ROF when they are available. The motion was seconded by Councilman Mundt and passed unanimously. President Pro Tem Nolan moved that Bill No. 459 entitled: BILL 459 PLACED ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, FIRST READING AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1984-85 BY APPROPRIATION TRANSFERS be placed on first reading and read by title alone. The motion was seconded by Councilman Mundt and passed unanimously. Vice Mayor Moore moved that Resolution No. 10-85 entitled: RES. 10-85 ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF ADEL CONSTRUCTION, WEST PALM BEACH, FL, FOR SLURRY SEAL IN THE AMOUNT OF $18,800.00 FROM t ACCOUNT N0. 10-541-034-34681 (R & M SLURRY SEAL) be adopted. The motion was seconded by President Pro Tem Nolan and passed unanimously. President Pro Tem Nolan moved that we authorize the Village TENNIS COURT Manager to go out for bids for resurfacing of tennis court RESURFACING numbers 3, 4, 5 and 6 at the North Palm Beach Country Club. The motion was seconded by Councilman Marks and passed unanimously. 3 Minutes of Regular Session Held Thursday, March 14, 1985 Page 3 Councilman Marks moved that we authorize the Mayor to sign the Contract between the Village and Forbes Labor Relations Service Inc. for the purpose of employing Forbes as the exclusive labor relations firm for the Uillage and to serve as our Chief Negotiator with the PBA and NAGE. The motion was seconded by ' Councilman Mundt. President Pro Tem Nolan moved to amend the motion as follows: that the contract price not exceed $5,000. The motion was seconded by Vice Mayor Moore. Vice Mayor Moore moved that we table the contract (until our Village Attorney reviews it). The motion was seconded by President Pro Tem Nolan and passed 4-1, with Councilman Marks opposed. Councilman Marks moved that we authorize the Mayor to sign the contract between the Uillage and Charles E. Grant for operation of the restaurant at the North Palm Beach Country Club. The motion was seconded by President Pro Tem Nolan. MOTION TO AUTHOR- IZE MAYOR TO SIGN CONTRACT WITH FORBES FOR LABOR NEGOTIATIONS MOTION TO AMEND LABOR NEGOTIATOR CONTRACT TABLED MOTION TO AUTHOR- IZE MAYOR TO SIGN CONTRACT WITH CHARLES GRANT Vice Mayor Moore moved to amend the motion under 2. B., Price MOTION AMENDED Changes, as follows: "Village Manager or designee shall be notified prior to increase. Lessee and Village representative shall discuss price increase and reasons prompting it, but Lessee shall have the final say on prices." The motion was seconded by President Pro Tem Nolan and passed unanimously. Uice Mayor Moore moved to amend the amendment under 11. AMENDMENT ' Maintenance and Equipment, as follows: "The Village will AMENDED maintain that major equipment necessary for the operation of the restaurant for the initial sixty (60) days of the contract. After this period of time, the Lessee will be responsible for repairs to all equipment, and his percentage of the air conditioning and heating unit repair." The motion was seconded by President Pro Tem Nolan and passed 3-2, with Councilman Marks and Councilman Mundt opposed. President Pro Tem Nolan moved to amend the amendment as follows: AMENDMENT that we authorize the Mayor to sign the Contract between the AMENDED Village and Charles E. Grant for operation of the restaurant at the North Palm Beach Country Club commencing May 15th or earlier if the present Lessee agrees to vacate prior to May 15th. The motion was seconded by Councilman Mundt, and President Pro Tem Nolan stated this motion did not require a call for the vote since it is to be incorporated in the main motion. Thereafter Council voted on the main motion, as amended, which MAIN MOTION passed unanimously.
