08-08-1985 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, AUGUST 8, 1985 Present: Tom Valente, Mayor Al Moore, Vice Mayor Harriet Nolan, President Pro Tem V. A. Marks, M. D., Councilman Craig Mundt, Councilman Raymond J. Howland, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Mayor Valente called the Regular Session to order at 7:30 p.m. ROLL CALL All members of the Council and the staff were present. Councilman Mundt gave the invocation, and Mayor Valente led the INVOCATION & Council and the public in the Pledge of Allegiance to the Flag. PLEDGE OF ALLEGIANCE The Minutes of Regular Session held Thursday, July 25, 1985 were APPROUAL OF approved as written. MINUTES The following minutes stand as corrected: ACCEPTANCE OF MINUTES Minutes of Regular Meeting of Planning Commission held July 2, 1985 The following minutes stand as prepared: Minutes of Regular Meeting of Board of Adjustment held July 9, 1985 Minutes of Library Advisory Board Meeting held July 23, 1985 Councilman Marks moved that Bill No. 466 entitled: BILL 466 PLACED ON SECOND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 11 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE ELECTRICAL CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE NATIONAL ELECTRIC CODE, 1984 EDITION, AND SETTING FORTH AMENDMENTS TO SAID NATIONAL ELECTRIC CODE be placed on second reading and read by title alone. The motion was seconded by President Pro Tem Nolan and passed unanimously. Councilman Mundt moved that Bill No. 466 be adopted as Ordinance MOTION TO ADOPT No. 13-85. The motion was seconded by Councilman Marks. BILL 466 AS ORD. 13-85 Vice Mayor Moore moved to amend the motion to retain the existing MOTION TO ' permit fees. The motion was seconded by President Pro Tem Nolan AMEND FAILED for discussion and failed 1-4, with Vice Mayor Moore voting aye, 1-4 and Mayor Valente, President Pro Tem Nolan, Councilman Marks and Councilman Mundt voting nay. Thereafter Council voted on the main motion which passed 4-1, MAIN MOTION with Mayor Valente, President Pro Tem Nolan, Councilman Marks and PASSED 4-1 Councilman Mundt voting aye, and Vice Mayor Moore voting nay. Minutes of Regular Session Held Thursday, August 8, 1985 Page 2 Vice Mayor Moore moved that Bill No. 470 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY LIMITING THE LOCATION OR PLACES OF BUSINESS WHERE SUCH ALCOHOLIC BEVERAGES MAY BE SOLD IN RELATION TO CHURCHES, SCHOOLS, HOSPITALS, PARKS AND PLAYGROUNDS, RESTAURANTS AND PUBLIC LICENSED RETAIL SELLERS OF ALCOHOLIC BEVERAGES be placed on first reading and read by title alone. The motion was seconded by President Pro Tem Nolan and passed unanimously. Councilman Marks moved that Bill No. 471 entitled: AN ORDINANCE OF THE VILLAGE AMENDING THE VILLAGE CODE ENFORCEMENT BOARD FOR THE SECTIONS 14-44 AND 14-46 f~ iJ OF NORTH PALM BEACH, FLORIDA, BY SUBSTITUTING THE CODE BOARD OF ADJUSTMENT IN CODE be placed on first reading and read by title alone. The motion was seconded by Councilman Mundt and passed unanimously. President Pro Tem Nolan moved that the Village Manager contact the administrative head of all local governments who use this landfill (Dyer Blvd.) to find alternative ways to reduce the cost of using the landfill. The motion was seconded by Vice Mayor Moore and passed unanimously. Vice Mayor Moore moved that we purchase a Dictaphone Four Channel Dual Cassette Recorder - Model 5842 - on an emergency basis, in an amount not to exceed $4,400.00. The funds are to be expended from Account No. 10-521-064-66000 (Capital Expenditures), with transfers of $3,319.00 from Revenue Account No. 10-369-024-0098 (Law Enforcement Trust Fund), and $1,081.00 from Revenue Account No. 10-000-000-24755 (Crime Prevention funds -BAT). The motion was seconded by President Pro Tem Nolan and passed unanimously.
