02-23-1984 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, FEBRUARY 23, 1984 Present: Tom Valente, Mayor V. A. Marks, M.D., Vice Mayor Craig Mundt, President Pro Tem Al Moore, Councilman Harriet Nolan, Councilwoman C. R. O'Meilia, Acting Village Manager t Herbert L. Gildan, Village Attorney Joan BernoLa, Finance Director Dolores R. Walker, Village Clerk Mayor Valente called the Regular Session to order at 7:30 p.m. ROLL CALL All members of the Council were present except Vice Mayor Marks, who arrived at 7:40 p.m. President Pro Tem Mundt gave the invocation and Councilwoman INVOCATION Nolan led the Council and the public in the Pledge of Allegiance & PLEDGE to the Flag. OF ALLEGIANCE The following minutes were approved as written: APPROVAL OF MINUTES Minutes of Public Hearing on Bill No. 535 Held Thursday, February 9, 1984 Minutes of Regular Session held Thursday, February 9, 1984 Minutes of Special Session held Monday, ' February 20, 1984 Mayor Valente asked the Village Attorney to bring the Council up MARCH 13 to date regarding what is to be placed on the March 13th ballot BALLOT concerning the Winter Club. Mr. Gildan stated that the court has ordered the ordinance to be ORD TO BE PLACED placed on the ballot, and he has not only ordered the Village ON BALLOT Council to do so but has ordered Jackie Winchester to put it on the ballot. The meeting was recessed at 8:05 p.m. so that attorneys Gildan RECESS and Babbitt could draft the wording for the March 13th ballot concerning the Winter Club, and was reconvened at 8:20 p.m. Councilwoman Nolan moved that the Village seek through LANGUAGE FOR stipulation a court order that the language previously read to BALLOT you will constitute the ballot question and the substance of the proposed ordinance in our best attempt to comply with the court order, and if this is not acceptable to the court, that we offer the entire ordinance to be placed on the ballot with Jackie Winchester. The motion was seconded by Councilman Moore and passed 4-1, with Vice Mayor Marks opposed. ' President Pro Tem Mundt moved that we remove the "yes, "no" question from the ballot. The motion was seconded by Councilwoman Nolan and passed 4-1, with Vice Mayor Marks opposed. On motion of Vice Mayor Marks, seconded by Councilwoman Nolan, BILL 435 PLACED all present voting aye, Bill No. 435 entitled: ON SECOND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA ADOPTING AN AMENDMENT TO THE COMPREHENSIVE PLAN FOR THE VILLAGE OF NORTH PALM BEACH IN ACCORDANCE WITH THE REQUIRE- MENTS OF THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT OF 1975 (CHAPTER 163, FLORIDA STATUTES) was placed on second reading and read by title alone. ' On motion of Councilwoman Nolan, seconded by President Pro Tem Mundt, all present voting aye, Bill No. 435 was adopted as Ordinance No. 4-84. On motion of President Pro Tem Mundt, seconded by Vice Mayor Marks, all present voting aye, Bill No. 437 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1983-84 BY APPROPRIATION TRANSFERS was placed on first reading and read by title alone. On motion of Vice Mayor Marks, seconded by Councilman Moore, all present voting aye, Bill No. 439 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1983-84 BY APPROPRIATION TRANSFERS was placed on second reading and read by title alone. On motion of Councilwoman Nolan, seconded by Vice Mayor Marks, all present voting aye, Bill No. 439 was adopted as Ordinance No. ' 5-84. On motion of Councilman Moore, seconded by Vice Mayor Marks, all present voting aye, Bill No. 440 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1983-84 was placed on second reading and read by title alone. On motion of Vice Mayor Marks, seconded by Councilman Moore, all present voting aye, Bill No. 440 was adopted as Ordinance No. 6-84. On motion of President Pro Tem Mundt, seconded by Vice Mayor Marks, all present voting aye, Bill No. 441 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1983-84 BY APPROPRIATION TRANSFERS was placed on first reading and read by title alone. Councilman Moore moved to amend Bill No. 441 as follows: In the ' section where it says "Increase Computer Hardware and Software, Account No. 13-513-63.15", eliminate the letter quality printer and reduce the amount from $18,500 to $16,500. The motion was seconded by Councilwoman Nolan and passed unanimously. BILL 435 ADOPTED AS ORD. 4-84 BILL 437 PLACED ON FIRST READING BILL 439 PLACED ON SECOND READING BILL 439 ADOPTED AS ORD. 5-84 BILL 440 PLACED ON SECOND READING BILL 440 ADOPTED AS ORD. 6-84 BILL 441 AMENDED -2- President Pro Tem Mundt moved that we approve the annual audit for Fiscal Year 1982-83. The motion was seconded by Councilwoman Nolan and passed unanimously. President Pro Tem Mundt moved that we transfer $3,000 from Accounting-Village (31.1-572-32.20) to Computer (31.1-572-63.15). The motion was seconded by Vice Mayor Marks and passed unanimously. Vice Mayor Marks moved that we transfer $4,930 from Account No. 13-513-64.95 (Lease-Purchase Computer) to Account No. 13-513-46.30 (R & M Office Equipment). The motion was seconded ' by Councilman Moore and passed unanimously. Councilman Moore moved that we award the bid to Wood Business Products, Inc., Fort Lauderdale, Florida, for a Wordplex word processor for the Village Clerk's office in the amount of $9,800 to be expended from Federal Revenue Sharing Account No. 100-14-512-64.10. The motion was seconded by Councilwoman Nolan and passed unanimously.
