09-08-1983 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 8, 1983 1 Present: V. A: Marks, P1. D., Vice Mayor Craig Mundt, President Pro Tem Al Moore, Councilman Raymond J. Howland, Village Manager Herbert L. Gildan, Village Attorney Joan C. Bernola, Finance Director Dolores R. Walker, Village Clerk Absent: Tom Valente, Mayor Harriet Nolan, Councilwoman Vice Mayor Plarks called the Regular Session to .order at 7:45_p.m. All members of the Council were present except Mayor Valente and Councilwoman Nolan. All members of the staff were present. President Pro Tem Mundt gave the. invocation and Councilman Moore led the Council and the public in the Pledge of Allegiance to the Flag. The following minutes were approved as written: Minutes of Public Hearing on Proposed Usage of FRS Funds held Thursday, August 25, 1983 C 1 Minutes of Public Hearing on Bills 419, 420, 421, 422, 423 and 424 held Thursday, August 25, 1983 Minutes of Regular Session held Thursday, August 25, 1983 President Pro Tem Mundt moved that we move from the workshop agenda the items which are the bid award on fill dirt and the bid award on Winter Club demolition to our regular agenda. Councilman Moore stated that there is no way in the world that we can move those from the workshop agenda to the regular agenda because it is next year`s budget item -- there is no money appropriated this year -- and there can be no approval one way or the other tonight. Vice Mayor Marks passed the gavel to President Pro Tem Mundt and seconded-the motion, and stated he would suggest that it can be moved for discussion and it can be voted on tonight. It could be under a different type of approval. President Pro Tem Mundt returned the gavel to Vice Mayor Marks. Councilman Moore then told Vice Mayor Marks that he would leave the meeting and there would be no quorum. ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES MOTION TO MOVE ITEMS FROM WORKSHOP TO REGULAR COUNCILMAN MOORE'S STATEMENT AS TO WHY THESE ITEMS CANNOT BE MOVED TO REGULAR MOTION SECONDED COUNCILMAN MOORE STATED HE WOULD LEAVE MEETING Vice Mayor Marks stated that the Chair would like to note that CHAIR NOTED THAT at 7:55 p.m. Councilman Moore has left the dais and the meeting COUNCILMAN MOORE apparently is going to be ove r for tonight. He stated we will LEFT DAIS AT have to have another meeting at some other time to discuss the. 7:55 P.M. other items unless the maker of that motion would like to with- draw his motion. n .~ .4 Minutes of Regular Session -- Held Thursday, September 8, 1983 Page two President Pro Tem Mundt stated he would withdraw his motion because we have so many people in the Village who have made an effort to come here this evening. Unfortunately, I wish Mr. Moore would give us the opportunity to find out whether the motion is acceptable and is a legal motion, but he won't give us that opportunity so I will withdraw the motion and we will go ahead with the other business of the Village this evening. ' Vice Mayor Marks withdrew his second. Councilman Moore then stated that Vice Mayor Marks might ask the Village Attorney at this time if you can approve a resolu- tion to spend money which has not been appropriated and, if you can't, then there is no need to have a motion on the floor. Vice Mayor Marks replied that he would not discuss that with Councilman Moore at this point. He stated it is permissible, it can be appropriated from Council Contingency or other funds for this year if it is the desire that we do that. Councilman Moore replied that it can be appropriated from Council Contingency, but it will take two meetings to read it and to get it appropriated, so it still puts you into October. ' Vice Mayor Marks replied that we are not going to argue with you, Mr. Moore. Councilman Moore replied that there isn't any argument if you want to ask the Village Attorney. Boa rd Meeting held August 23 , 1983 Minutes of Meeting of Pension Board for Police/Fire Employees held August 25, 1983 On motion of President Pro Tem Mundt, seconded by Councilman Moore, all present voting aye, Bill No. 425 entitled: AN ORDINANCE OF THE VILLAGE OF NDRTH PALM BEACH, FLORIDA, AMENDING SECTION 2-146 OF THE VILLAGE OF NORTH PALM BEACH CODE BY AMENDING THE DEFINITION OF FINAL AVERAGE EARNINGS FOR THE RETIREMENT BENEFIT FOR EMPLOYEES OF THE VILLAGE OF NORTH PALM BEACH ' was placed on second reading and read by title alone. On motion of President Pro Tem Mundt, seconded by Councilman Moore, all present voting aye, Bill No. 425 was adopted as Ordinance No. 13-83. MUNDT WITHDREW HIS MOTION & MARKS WITHDREW HIS SECOND MOORE ASKED MARKS TO CHECK WITH VILLAGE ATTORNEY RE APPROVING A RES. TO SPEND MONEY WHICH HAS NOT BEEN APPROPRI ATED MARKS DECLINED TO DISCUSS THE MATTER WITH MOORE AT THIS POINT SINCE HE FELT IT IS PERMISSIBLE MOORE REPLIED IT CAN BE APPROP-~~ RIATED FROM COUNCIL CONTINGEN- CY BUT WILL TAKE TWO MEETINGS CLOSING STATE- MENTS BY MARKS AND MOORE ACCEPTANCE OF MINUTES BILL 425 PLACED ON SECOND READING BILL 425 ADOPTED AS OR. 13-83 Minutes of Regular Session Held Thursday, September 8, 1983 Page three President Pro Tem Mundt moved that Bill No. 427 entitled: BILL 427 PLACED ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FIRST READING FLORIDA, ADOPTING BUDGETS FOR THE FISCAL YEAR OCTOBER 1, 1983, TO SEPTEMBER 30, 1984, BOTH INCLUSIVE, FOR THE VILLAGE. OF NORTH PALM BEACH GENERAL FUND, INCLUDING DEBT RETIREMENT, AND FOR THE NORTH PALM BEACH COUNTRY t CLUB REVENUE FUND TOGETHER WITH THE FEDERAL REVENUE SHARING FUND; AND RfPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE be placed on first reading and read by title alone. Vice Mayor Marks passed the gavel to President Pro Tem Mundt and seconded the motion. The motion passed 2-1, with Councilman Moore opposed. President Pro Tem Mundt returned the gavel to Vice Mayor Marks. President Pro Tem Mundt moved that Resolution No. 38-83 MOTION TO entitled: ADOPT RES. 38-83 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, PETITIONING THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, PURSUANT TO SECTION 125.01 (6) (a) AND (7), FLORIDA STATUTES (1981), TO PROVIDE RELIEF FROM TAXES UNLAWFULLY LEVIED UPON PROPERTY SITUATE WITHIN THE VILLAGE OF NORTH PALM BEACH TO FINANCE SERVICES RENDERED SPECIALLY FOR THE BENEFIT OF THE PROPERTY OR RESIDENTS OF UNINCORPORATED AREAS OF PALM BEACH COUNTY, BY REMITTING TO THE VILLAGE OF NORTH PALM BEACH THE IDENTIFIED COST OF SUCH SERVICES LEVIED AND COLLECTED DURING THE 1982-83 FISCAL YEAR, AND BY FINANCING SUCH SERVICES. FROM REVENUES DERIVED SPECIFICALLY FROM OR ON BEHALF OF A MUNICIPAL SERVICE TAXING UNIT, SPECIAL DISTRICT, UNINCORPORATED AREA, SERVICE AREA OR PROGRAM AREA, OR BY ANY OTHER LAWFUL METHOD, DURING THE 1983-84 FISCAL YEAR be adopted. Councilman Moore seconded by motion for discussion. Councilman Moore moved to amend the Resolution as follows: MOTION DIED FOR In Section 1, delete Paragraphs 2 and 3. The motion died for LACK OF A SECOND lack of a second. Thereafter Council voted on the main motion which passed 2-1, MAIN MOTION with Councilman Moore opposed. PASSED 2-1 President Pro Tem Mundt moved that we approve the 1983-84 7983-84 Village Employees' Holiday Schedule, copy of which is attached VILLAGE EMPLOY- to the minutes of this meeting. The motion was seconded by EES' HOLIDAYS Councilman Moore and passed unanimously.
