10-27-1983 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, OCTOBER 27, 1983 r--~ ~: Minutes of Regular Session held Thursday, October 13, 1983 Present: Tom Valente, Mayor V. A. Marks, M.. D., Vice Mayor Craig D1undt, President Pro Tem Al Moore ,Councilman Harriet Nolan, Councilwoman Raymond J. Howland, Village Manager Herbert L. Gildan, Villlage Attorney Joan C. Bernola, Finance Director Dolores R. Walker, Village Clerk Mayor Valente called the Regular Session to order at 7:30 p.m All members of the Council and the staff were present. Mayor Valente gave the invocation and Councilwoman Nolan led the Council and the public in the Pledge of Allegiance to the Flag. The following minutes were approved as written: ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES Minutes of Special Session held Monday, October 24, 1983 Councilman Moore moved that we add items 11 b and 11 c to the agenda to repeal Resolution No. 40-83.and Resolution No. 41-83, which were improperly adopted at the last Regular Session of this Council. The motion was seconded by Councilwoman Nolan and passed 3-2, with Vice Mayor Marks and President Pro Tem Mundt opposed. MOTION TO ADD ITEMS TO THE AGENDA J Vice Mayor Marks moved that Resolution No. 42-83.and Resolution No. 43-83 be placed. back on the agenda to be voted on to award the bids. The motion was seconded by President Pro Tem Mundt. During the discussion, Vice Mayor Marks withdrew his motion and President Pro Tem Mundt withdrew his second. President Pro Tem Mundt made~the.following statement for the record: "I would like to read into the record Councilman Moore's comments that were made at a.Regular Session on October 13, 1983. 'I think the people did quite a good job. They came here on 9/8 to try to ask us to postpone voting on that building being destroyed, and they ignored them. They came back on the 22nd and asked for time to make a plan. Nobody agreed to it, except Mrs. Nolan said she was willing to think about it. The other three members weren`t willing to hear anything. In fact, they haven`t been willing to hear any- thing from the public -- even at-the public hearing they were ready to tear it down. P4r. Mundt rambled about things that didn't really mean anything, but I think he made an agree- ment somewhere to tear it down to get elected -- and I am not sure what Dr. Marks did.' MOTION WITHDRAbJN PRES. PRO TEM MUNDT'S STATE- MENT FOR THE RECORD Minutes of Regular Session Heid Thursday, October 27, 1983 Page 2 Mayor, Council and Village. residents, two weeks ago this false representation was made in this chamber by Councilman Al Moore, and at the time I chose not to-respond. However, these remarks cannot stand unrefuted. I will publicly state that no agreements were ever_made or existed regarding any vote I have cast while on this Council, or will they in the future. My decisions are reflections of what I feel are the majority desire of our residents and what is in the best ' interests of our Village. I feel it is not fair for this place to be a public forum and to be used as a caucus to plant seeds of doubt, personal attack, or as a political forum, and I sense all of this has happened. I will not tolerate them personally, now or in the future." Councilman Nloore`s remarks to President Pro Tem Mundt's statement for the record are as follows: "Mr. Mayor, to remark to that I said I think he made an agreement. Dr. Marks said at the workshop he wanted an apology from me fora remark I made against him, which the record clearly indicates that I did not. And I think tonight if Mr. Mundt thinks that I hurt his ego or have upset him mentally or have disturbed him, then I think I am sorry for that fact." Vice Mayor Marks comments are as follows: "Mr. Mayor, the statement has already been read into the minutes of this body. I had not really planned on com- menting other than to read .it into the minutes so that people in the future could read this and understand who put them in there, where they came from. I really think ' that the gentleman who I have served with over the years, I am not sure I understand him anymore. I think that for him to publicly attack me as if to say, "I am not sure what Dr. Marks did" -- whether it means anything or whether it doesn't mean anything, I think my record on this Council will speak for being honest with everybody in this Village. My re-elections have been universal throughout the Village. It hasn't been from any one area. I have never been influenced on a vote on this Council and I resent the fact that. Councilman Moore would sit there and insinuate that maybe I did, and I think to insinuate against two members of this Council is very poor taste for any Council- man to sit up on this front place. If he wants to do it in the campaign, someplace outside of this Council Chambers, more power to him, and I feel sorry_for him, the way he handled it." Councilman Moore commented as follows: "Mr. Mayor, to answer Dr. Marks, I will reiterate what I said two weeks ago. I am still not sure about Dr. Marks. He claims that he stands on his voting record. I stand on nlY voting record. In my statement that night, I did not mean to hurt anyone that serves on this Council. All I said was that it seemed awfully funny, and it was said either before or after what Councilman Mundt read into the statement, that two of the people who served on this Council that were in favor of tearing the building (Winter Club) down were tigers not too long ago to save the building. I really don`t know what changed their mind, so we all have the right to change our mind, but nobody has told me why Dr. Marks changed his mind or why the Mayor changed his mind. I am glad .all of this is going COUNCILMAN MOORE`S COMMENTS VICE MAYOR MARKS`S COMMENTS COUNCILMAN MOORE'S COMMENTS Minutes of Regular Session Held Thursday, October 27, 1983 Page 3 1 Minutes of North Palm Beach Library Advisory Board Meeting held September 27, 1983 Minutes of Regular Meeting of North Palm Beach Country Club Advisory Board held October 18, 1983 into the record for people to read. The tapes sometime are hard to understand because we often all talk at the same time up here and I don't think that I have deviated too for from what I originally started on this Council to what I am doing today. I haven`t changed nll' opinion of things in the Village very much. I still think it is a fine place to live. I think it is admirably well known that people who run and serve on this Council give up quite a bit of their time, and a lot of energy is used to serve the people of the Village and there are groups in the Village who would like to run this Council and I hope they never really achieve enough people on it to run it.. But there have been a lot of attempts to do it." The following minutes stand as corrected: Councilwoman Nolan moved. that we, at this time, sever the relationship with Mr. Howard Osterman regarding Seacoast Utilities, Inc. The motion was seconded by Vice Playor Marks and passed unanimously. President Pro Tem Mundt moved. that Bill No. 430 entitled: ACCEPTANCE OF MINUTES RELATIONSHIP WITH H. OSTERMAN RE SEACOAST UTILITIES SEVERED AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1983-84 BY APPROPRIATION TRANSFERS 1 be placed on first reading and read in full. The motion was seconded by Vice Playor Marks and passed 3-2, with Councilman Moore and Councilwoman Nolan opposed.. BILL 430 PLACED ON FIRST READING & READ IN FULL 1 Vice Mayor Marks moved that Bill No. 430 be placed on second reading and read by title alone due to the fact that an emergency exists requiring the passage of this ordinance on two readings tonight because the money is appropriated for a bid, which bid expires prior to another Council meeting, and the Village would lose benefit of the bid if it did not pass the ordinance this evening. The motion was seconded-by President Pro Tem Mundt and passed 3-2, with Councilman Moore and Councilwoman Nolan opposed. President Pro Tem Mundt moved that Bill No. 430 be adopted as Ordinance No. 16-83. The motion was. seconded by Vice Mayor Marks and passed 3-2, with Councilman Moore and Councilwoman Nolan opposed. Councilwoman Nolan moved that we repeal Resolution No. 40-83 The motion was seconded by Councilman Moore and failed 2-3~ with Mayor Valente, Vice Mayor Marks, and President Pro Tem Mundt opposed. President Pro Tem Mundt moved that we ratify Resolution Plo. 40-83 and Resolution No. 41-83, which were passed at the previous Council meeting, and reaward the bid to Delta Demolition, North Palm Beach, Florida, fbr demolition of the Winter Club in the amount of $13,434.00 from Account No. 42-572-34.15 (Contractual Services -Winter Club), and also reaward the bid to Heavy Construction, North Palm Beach, Florida, for fill dirt in the amount of $2.75 per cubic yard (total amount $6,050.00) from Account No. 42-572-34.15 (Contractual Services - Winter Club). The motion was second- ed by Vice h4ayor P1arks and passed 3-2, with Councilman Moore and Councilwoman Nolan opposed. BILL 430 PLACED ON SECOND READING ON AN EP7ERGENCY BASIS & READ BY TITLE ALONE BILL 430 ADOPTED AS ORD. 16-83 MOTION TO REPEAL RES. 40-83 FAILED BIDS REAWARDED TO DELTA DEMOL- ITION & HEAVY CONSTRUCTION Minutes of Regular Session Held Thursday, October 27, 1983 Page 4 The meeting was recessed at 8:40 p.m. and was reconvened at RECESS 8:54 p.m. On motion of Councilwoman Nolan, seconded by President Pro Tem RES. 42-83 Mundt, all present voting aye, proposed Resolution No. 42-83 ADOPTED entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBER TO THE PENSION BOARD FOR GENERAL EMPLOYEES OF THE VILLAGE OF NORTH.APLM BEACH, EXCEPT FIRE AND POLICE was read in full and adopted as read as- Resolution No. 42-83. President Pro Tem Mundt moved that we allow the Florida National Senior Olympics Committee to use. the North Palm Beach Country Club pool for an exhibition and.swim races on November 21 and November 25 at a fee of $200.00. The motion was seconded by Councilwoman Nolan and passed unanimously. Vice Mayor Marks moved that. we accept a utility easement from Seacoast Utilities, Inc. in the northeast corner of the Country Club property, adjacent to the waterway and U-. S. Highway No. 1. The motion was seconded. by President Pro Tem Mundt. Councilman Moore moved that we table this approval for the Mayor to.sign this easement until we have determined the value of the land which is located on U. S. Highway No. 1. The motion died for lack of a second. Thereafter Council voted on the main motion which passed 3-2, with Mayor Valente and Councilman Moore opposed.
