08-25-1983 VC REG-MMINUTES OF REGULAR SESSION OE THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, AUGUST 25, 1983 Present: Tom Valente, Mayor V.A. Marks, M.D., Vice Mayor ._ Craig Mundt, President Pro Tem _ AI Moore, Councilman Harriet Nolan, Councilwoman Raymond J. Howland, Village Manager Herbert L. Gildan, Village Attorney Absent: Dolores R. Walker, Village Clerk Mayor Valente called the Regular Session to order at ROLL CALL 7c,30 p.m. All members of the Council and staff were - _ present except Dolores R. Walker. Mayor .Valente gave the invocation and Councilwoman Nolan INVOCATION & Ied the Courzcil and the public in the Pledge of Allegiance PLEDGE OF to the Flag. ALLEGIANCE The Minutes of Regular Session held Thursday, August 1I, APPROVAL OF 1983, were approved as written. MINUTES Mayor Valente thanked the Council membe rs .and the staff -REPORT OF THE for their participation and hard work in getting the MAYOR I-983-84 budget together and also for the work involved with the Perry Cable TV Hearings. Mayor Valente reminded everyone of the Public Hearing concerning the 1983-84 budget to be held September 8, 1983 at 7:00 p.m. Councilman Moore stated the Minutes of the Planning REJECTION OF Commission Meeting held August 2, 1983, should be sent MINUTES back for-correction. The correction to include the item added to the agenda under "Agenda Change". President Pro Tem Mundt moved that Bi11 No. 4I9 entitled: MOTION TO PLACE BILL 419 ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, SECOND READING FLORIDA, AMENDING CHAPTER 12 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE FIRE PREVENTION CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO _ . THE STANDARD FIRE PREVENTION CODE, 1982 EDITION, AND SETTING FORTH AMENDMENTS TO SAID STANDARD FIRE PREVENTION CODE. be_ placed on second reading and read by title alone.. The motion was seconded by Vice Mayor Marks. Vice Mayor Marks moved to amend BiII No. 4I9 as follows: In Section 2 (I2-I7), under Section I.08, after the word _ utenciIs_in Line I, add "with which open flames may be -- used to heat or prepare food or from which open flames may occur during the cooking process shall not be used on any balconies or porches of multi-family buildings e excepti-ng two (2) family dwellings." The motion was seconded by Councilman Moore. _ -- The Council then voted on the amendment which passed unanimously. Thereafter Council voted on the main motion, as amended, which passed unanimously. The Village Manager then read Bi12 No. 419 by title alone. On-motion of Councilman Moore, seconded by Vice Mayor Marks, all present voting aye, Bill No. 419 was adopted as Ordinance No. 7-83. MOTION TO AMEND AMENDMENT PASSED 5-0 MAIN MOTION, AS AMENDED, PASSED 5-0 BILL 419 READ BY TITLE ALONE BILL 419 ADOPTED AS ORD. 7-83 Minutes of Regular Session Held Thursday August 25, 1983 page 2 Bill 420 Standard Housing Code Bill 421 Gas Code Bill 422 Plumbing Code Bill 423 Mechanical Code Mayor Marks Minutes of Regular Session Held Thursday, August 25, 2983 Page 3 On motion of President Pro Tem Mundt, seconded by Councilman Moore, a1I present voting aye, Bill No. 424 entitled: - AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 6 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE BUILDING CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD BUILDING CODE, 19$2 EDITION, INCLUDING APPENDICES A, B, C, E, F, G, O AND P, THERETO AND SETTING FORTH AMENDMENTS TO SAID STANDARD BUILDING CODE. was placed on second reading and read by title alone. On motion of Councilwoman Nolan, seconded by President Pro Tem Mundt, alI present voting aye, Bill No. 424 was adopted as Ordinance_NO. 12-83. Vice Mayor Marks moved that Resolution No. 37-83 en- titled: BILL 424 PLACED ON SECOND READING BILL 424 ADOPTED AS ORD. NO. 22-83 MOTION TO ADOPT RES. 37-83 R RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, DEFINING THE °RESIDEN2" REQUIREMENTS FOR' CLUB MEMBERSHIP AT THE NORTH PALM BEACH COUNTRY CLDB; THE NORTH PALM BEACH RECREATION DEPARTMENT; THE NORTH PALM BEACH LIBRARY AND THE NORTH PALM BEACH MARINA, AND REPEALING ALL RESOLU- TIONS, ORDERS AND RULES AND REGULATSONS IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. be adopted. The motion was seconded by President Pro Tem Mundt.. Councilman Moore moved to amend the motion by rewording paragraph R of Section 1, end of paragraph to read as follows: "Proof of ownership in residency shall provide a deed of ownership or a tax bill". Motion seconded by Vice Mayor Marks. The Council then voted on the amendment which passed unanimously. Thereafter Council voted on the main motion, as amended, which passed unanimously. Councilman Moore moved that authorization be given the Mayor to execute those certain agreements between the _ Village and Peter Finlayson, Golf Professional; Raymond Keldie, Tennis Professional and Richard Cavanah, Pool Manager. The motion was seconded by Vice Mayor Marks and alI present voted aye. Councilman Moore moved that we retain the trash bag sales by the Public Service Department, at no profit. Motion was seconded by Councilwoman Nolan and passed unanimously. After discussion, Vice Mayor Marks moved that we.im- plement the program for the Library of Youth Help put on by the State. Motion seconded by Councilwoman Nolan and vassed unanimously.
