10-01-1981 VC SP-M IV UTES OF EMERGENCY MEETING OF THE VIIJAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, OCTOBER 1, 1981 Present: V. A. Marks, M.D. , Mayor Tom Valente, Vice Mayor W. H. Brawn, President Pro Tem Al Moore, Councilman. Harriet Nolan, Councilwoman Herbert L. Gildan, Village Attorney Raymond J. Howland, Village Manager Dolores R. Walker, Village Clerk Mayor Marks called the Emergency Meeting to order at 6:06 p.m. ROLL CALL ' All members of the Council and the staff were present. The reason the Village Council had.to have this Emergency REASON EMERGENCY Meeting was because the business at hand could not wait until MEETING WAS HELD Council's next Regular Session which is scheduled for Thursday, October 8, 1981. The purpose of this Emergency Meeting is to discuss several PURPOSE OF breaches of the lease by Mr. George Danner, the lessee of the MEETING North Palm Beach Country Club Dining Room. Mr. Darner was not present at the meeting, but was represented MR. DANNER NOT by his attorney, Mr. Terry McManus. The Village Manager stated PRESENT AT MEETING that Mr. Danner was notified verbally of the Emergency Meeting at the time the notices were posted, which was yesterday, and today he was served with written notice by the Public Safety Department. The Village Manager presented a packet of lease agreement PRESENTATION OF violations, with a covering letter dated October 1, 1981, PA= OF LEASE perpetrated by Mr. Dormer, to the Village Council, Village AGK1MENT VIOLATIONS Attorney, and Mr. Danner's Attorney, Mr. McManus. He also & LIST OF CREDITORS presented to these individuals a memorandum from Steve Sandusky, Club Administrator, Containing a list of creditors ' of Mr. Danner's. Some of these creditors threatened both the Village and the Country Club with lawsuits. Thereafter there was discussion between Mr. McManus, the DISCUSSION CONCERN- Village Council, Village Manager, and Village Attorney concern- INs MR. DANNER ing Mr. Danner. Vice Mayor Valente moved that we grant Mr. McManus a hearing MOTION TO GRANT on Monday (October 5, 1981) so that he might answer the MR. MC MANUS A questions that we have for Mr. Danner, providing that he will HEARING see that Mr. Danner provides us with receipts and all the other things that we are not getting now within the next four or five days. President Pro Tem Brown seconded the motion for discussion. President Pro Tem Brown amended the motion as follows: Since MUTTON TO AMEND Mr. Darner awes the Village a considerable sum of money, and since Mr. Danner has a key to areas of the Country Club, I move that a Public Safety Officer be stationed at the Country Club twenty-far hours per day until the next meeting to ensure that nothing is removed from the premises. The motion was seconded by Councilwoman Nolan. During the discussion, President Pro Tem Brown withdrew his MOTION TO AMEND amendment and Councilwoman Nolan withdrew her second. WITHDRAW ' Thereafter Council voted on the main motion which failed 2-3, MAIN MDTION FAILED with Vice Mayor Valente and President Pro Tem Brown voting 2-3 aye, and Mayor Marks, Councilman Moore and Councilwoman. Nolan voting nay. Councilman Moore moved that because of his (Mr. Danner's) MOTION TO TFRMiNATF, breaking the lease at this point the Village determined that MR. DANNER'S the lease is terminated due to his breaches of lease which LEASE FAILED have been presented by the Village Manager in memorandums Minutes of Emergency Meeting Held Thursday, October 1, 1981 _ Page 2 won dated September 29, 1981 and October 1, 1981, copies of which are attached to the minutes of this meeting. The motion was seconded by Councilwoman Nolan and failed 2-3, with Mayor Marks and Councilman Moore voting aye, and Vice Mayor Valente, President Pro Tem Brown and Councilwoman Nolan voting nay. President Pro Tan Brown moved that we call a special meeting SPECIAL MEETING for Monday or Tuesday (October 6th or 7th) when most of us can TO BE CALU9) be here, and give Mr. Danner his day in court. The motion was TO GIVE MR. DANNER seconded by Vice Mayor Valente and passed 3-2, with Mayor Marks HIS DAY IN COURT and Councilman Moore opposed. There being no further business to come before the Council, on ADJOURN motion of Councilman Moore, seconded by Vice Mayor Valente, all present voting aye, the meeting was adjourned at 6:45 p.m. Minutes recorded by: Dolores R. Sandusky, Club Administratoro Subject: George Danner As Ray has pointed out in his memo dated September 28, 1981, we are having many problems with creditors of George Danner. - It began mainly in the membership office when we started receiving many calls, mistakenly, for George Danner. Many of the callers would identify themselves and explain their dilemma to us on the telephone. Several were very upset, to say the least, with Mr. Danner . and the stall tactics they had been receiving concerning payment of their bills. Listed below are the companies and/or individuals I have contacted, personally, to confirm these outstanding balances. - 1. Liquor License - October, 1981 - April, 1982 - $875.00 due September 30, 1981. April, 1982 - 1983 - $1,750.00 due in April, 1982. 2. Matter Produce Co. - Outstanding balance as of August 18, 1981 - $5,000.00+. Danner explained to credit manager that he could not pay balance. Set up $250/week payments + 12% interest. Current balance - $3,750 '. Food strictly on a C.O.D. basis. 3. Plantation Sysco (Food Supplier) - outstanding balance - $300+ from June, 1981. Turned over for collection. Will not even deal on C.O.D. basis: 4. Weekday Magazine - Current balance_$264.00. This is from ads placed throughout the month of July. 5. Village of North Palm Beach - Occupational license - $300+. Will be charged for 1981 (has yet to pay) and 1982. 6. Nozzle Nolen - $200+ - Three months in arrears. Disastrous results at restaurant without regular bug and rodent control. 7. Gearhart Sheet Metal Co. - $150.00 - Installation of asbestos heat shield on June 25, 1981, as required by C. O'Meilia. Continued . . . . . Mayor & Village Council Page _2 September 29, 1981 8. Eli Witt Company - $140.29 - Two orders placed in August for cigars. Still outstanding. Orders placed by Danner's bartender, Paul Berlinger. With all the creditors listed above (numbers 2 through 8) I seriously wonder if even the liquor license will be paid for on time. At this writing and after conferring with those finance people responsible for recording daily cash and charge sales, we have yet to see any recording of the $10,000.00 for the Channel 12 party held at the Country Club on the night of September 11, 1981. Joyce, Fire Chief SUL7jECt: Danner Associates On May 5, 1981, while at the North Palm Beach Country Club, I observed a man installing a railing at the exit door, South side of the main Dining Room, on the inside. , Upon questioning this man, he stated that Mr. Danner had contracted him to install a railing, so that Mr. Danner could control persons coming £rom the Pool into the Dining Room. As this installation was in violation of the fire code, I ordered the man to stop this work and informed Mr. Danner of my order. This work was done without my knowledge. ~C.C/ Lawrence E.
