09-25-1980 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 25, 1980 1 Present: V. A. Collins, Deputy Village Clerk Mayor Marks called the Regular Session to order at 7:30 p.m. ROLL CALL All members of the Council were present. President Pro Tem Valente gave the invocation and Councilman INVOCATION & Brown led the Council and the public in the Pledge of Allegiance PLEDGE OF to the Flag. ALLEGIANCE The minutes of Regular Session held Thursday, September ll, 1980 stand as prepared. The following minutes stand as prepared: Minutes of Regular Meeting of Recreation Advisory Board held September 9, 1980 1 Minutes of Regular Meeting of North Palm Beach Country Club Advisory Board held September 16, 1980 Vice Mayor Moore moved that we accept the recomsendation of the Recreation Advisory Board that a children`s park be erected on the new grounds at the Delacorte Pavilion and that it be kept within a rustic scheme, but that no action be taken until before plans are made for the entire ten acres at same later date. The motion was seconded by Cotncilman Brown and all present voted aye. APPROVAL OF MINUTES ACCEPTANCE OF MINUTES RECREATION AD. BD. RECONPiQ~IDA ACCEPTID Councilman Brown moved that we reject the recomrendation of the RECREATION AD. BD. Recreation Advisory Board concerlliSlg the erection of a fence RECONIM~'NDATION at the south end of Osborne field, starting at the existing REJECTED retaining wall rmn;ng west arotnd the perimeter of the field. The motion was seconded by Vice Mayor Moore and passed 4-1, with Councilwoman Nolan opposed. On motion of Councilman Brown, seconded by Vice Mayor Moore, all present voting aye, Bill No. 369 entitled: AN ORDII~]ANCE OF THE VILLAGE OF NORTH PALM BEACH, FTARIDA, AMENDING SECTION 2, ARTICLE III, OF THE VILLAGE CHARTER BY CHANGING THE DATE OF THE ~'RAT. ELECTION FROM THE THIRD TUESDAY IDI MARCEI TO THE SECAND TUESDAY IN MARCH OF EACH YEAR; PROVIDING THAT THIS ORDINANCE OF AnTr SHALL BE SUBMITTID `TO THE ELECTORS OF THE VILLAGE AT A SPECIAL ELECTION TO BE HELD IN THE VILLAGE ON THE 4TH DAY OF NOVEMBER, 1980 IN THE FORM OF A PROPOSTTION ON THE REFERENDUM ELECTION BALLOT; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF BILL 369 PLACID ON 1ST READING was placed on first reading and read by title alone. Minutes of Regular Session He1c1 Thursday, September 25, 1980 Page 2 On motion of Vice Mayor Moore, seconded by Councilwoman BILL 370 PLACID Nolan, all present voting aye, Bi11 No. 370 entitled: ON IST READING AN ORDINANCE OF THE VII~.AGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 20 OF THE VILLAGE OF NORTH PALM BEACH CODE, BY REGULATING THE HOURS ' DURING WHICH PUBLIC PARKS AND RECREATION FACILITIES SHALL BE OPEN TO THE PUBLIC was placed on first reading and read by title alone. Vice Mayor Moore moved to amend Bi11 No. 370 as follows: BILL 370 AM~]DID In the caption of Section 20-1, delete the words "residents and guests" and substitute the word "public." The motion was seconded by President Pro Tem Valente and all present voted aye. Vice Mayor Moore moved that Bi11 No. 371 entitled: BILL 371 PLACID ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PATS4 BEACH, FLORIDA, PERMITTING SMOKING IN PUBLIC PLACES AND IN PUBLIC MEETINGS WITHIN THE VILLAGE OF NORTH PALM BEACH be placed on first reading and read in full. The motion was seconded by Councilwoman Nolan and passed 3-2, with Mayor Marks and President Pro Tem Valente opposed. During the discussion between first and second reading PUBLIC DISCUSSION of Bi11 No. 371, there were six members of the public who ON BILL 371 spoke against this bill and one person who spoke in favor of it. Counci7Na]1 Brown moved that Bill No. 371 be placed on BILL 371 PLACID second reading and read in full. The motion was seconded ON 2ND READING by Vice Mayor Moore and passed 3-2, with Mayor Marks and President Pro Tem Valente opposed. Vice Mayor Moore moved that Bi11 No. 371 be adopted as BILL 371 ADOPTED Ordinance No. 21-80. The motion was seconded by Council- AS ORD. 21-80 man Brown and passed 3-2, with Mayor Marks and President Pro Tem Valente opposed. The meeting was recessed at 8:45 p.m. and was reconvened RECESS at 8:55 p.m. On motion of Councilwoman Nolan, seconded by Vice Mayor RES. 45-80 Moore, all present voting aye, proposed Resolution No. ADOPTID 45-80 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NOP.TH PAIPQ BEACH, FLORIDA, SETTING FORTH TRAVEL REGULATIONS FOR OFFICIALS AND EMPLOYEES OF THE VLLIGE OF NORTH PALM BEACH; AND REPEALING RESOLUTION N0. 3-78 was read in full anal adopted as read as Resolution No. 45-80. On motion of Councilman Brown, seconded by President Pro Tem RES. 48-80 Valente, all present voting aye, proposed Resolution No. ADOPTID 48-80 entitled: A RESOLUTION OF THE VILLAGE COUNCII. OF NORTH PATS~I BEACH, FLORIDA, ACCEPTING THE BID OF PAVII~III~]T MAIN- TENANCE CORPORATION FOR RESURFACING TENNIS COURTS NO. 5 AND 6 AT THE NORTH PALM BEACH COUNTRY CLUB IN THE ANIDUNT OF $3,998.00 FROM ACCOUNT N0. 61.1- 581-63.73 (TENNIS COURT RENOVATION) was read in full and adopted as read as Resolution No. 48-80. On motion of Vice Mayor Moore, seconded by Councilm~m Brown, RES. 49-80 all present voting aye, proposed Resolution No. 49-80 ADOPTID entitled: A RESOLUTION OF THE VTTTAI;F. COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF PAVEMENT MA7NTII~IANCE COR- PORATION FOR RESURFACING TENNIS COURTS N0. 7 AND 8 AT THE NORTH PALM BEACH COUNTRY CLUB IN THE ANAUNT OF $3,998.00 FROM ACCOUNT NO. 61.1-581-63.73 (TENNIS COURTS RESURFACING) 1980-81 BUDGET was read in full and adopted as read as Resolution No. 49-80. On motion of Vice Mayor Moore, seconded by Councilman Brawn, RES. 50-80 all present voting aye, proposed Resolution No. 50-80 ADOPTID entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTIlVG THE BID OF PAVEMELT MAIIVTENANCE CORPORATION FOR RESURFACING TLuA TENNIS COURTS AT ANCHORAGE PARK IN THE ANAUNT OF $3,998.00, FROM ACCOUNT N0. 36-572- 46.24 (RESURFACE 2 COURTS - ANCHORAGE) 1980-81 BUDGET was read in full and adopted as read as Resolution No. 50-80. FESSIONALS Vice Mayor Moore moved to amend the agreea~nts with the NATION TA AP~iID professionals as follows: AGREQ~NTS Minutes of Regular Session Held Thursday, September 25, 1980 Page 4 Amend the Tennis Professional, Ray Keldie`s agreement on page two, Section 2 c (Rent) from $1,248.00 per year to $1,320 per year, and fry $104.00 per month to $ll0.00 per month. Amend the Pool Manager, Richard Cavanah's agreement on age two Section 2 c (Rent) from $1 560.00 per year to p$1,608.00 per year, and from $130.00 per month to $134.00 ' per month. Amend the Golf Professional, Peter Finlayson's agreement on $age two Section 2 c (Rent) from $3,744.00 per year to $3,972.00 per year and from $312.00 per month to $331.00 per month. The motion was seconded by Councilwoman Nolan and failed 0-5, with the entire Council opposed. Thereafter Council voted on the main motion which passed MA.Il~T MOTION PASSID 5-0. 5-0 Councilman Brown moved that we authorize the Village Manager to NCR. AUTHORIZID seek bids for the purchase of a greensmower for the North TO_SEEK BIDS Palm Beach Country Club. The motion was seconded by Council- FOR PURCHASE OF woman. Nolan. and passed 5-0. GREIIQSN~[7ER Councilman Brown moved that we approve the emergency purchase APPROVAL FOR of ten tons of fertilizer for the Country Club in the amount F~IERGE~iICY PURCIASE of $1,911.20 to be expended from Account No. 11.1-572-52.23 OF FERTILIZER (Fertilizer and Insect). The motion was seconded by Council- warnan Nolan and passed 5-0.
