05-22-1980 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MAY 22, 1980 Present: V. A. Marks, M.D., Mayor Al Moore, Vice Mayor Tom Valente, President Pro Tem ' W. H. Brown, Councilman Harriet Nolan, Councilwoman Herbert L. Gildan, Village Attorney Paul J. Nicoletti, Village Manager Dolores R. Walker, Village Clerk Cheryl S. Collins, Deputy Village Clerk Mayor Marks called the .Regular Session to order at 7:30 p.m. All members of the Council were present. Mayor Marks gave the invocation and Councilman Brown led the Council and the public in the Pledge of Allegiance to the Flag. The Minutes of Regular Session held Thuxsday, May 8, 1980 stand as prepared. ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES Mayor Mark's, on behalf of the Village, presented PRESENTATION OF plaques to former Council members Donald J.. Kazimir PLAQUES and Patsy B. Love in recognition of their community service. ' Mayor Marks, on behalf of the Village, presented a Certificate of Appreciation to Tom Andres, a former member of the Recreation Advisory Board; to Robert L. Hagan for over twenty years .of service with the Village; and to Charles Traxler, former North Palm Beach Country Club Golf Course Superintendent. Certificates of Appreciation will be mailed to the following former members of Village advisory boards who were not present to receive them: Karla Win- sauer, Judith Colbath, Don Kohl, H. Mallory Privett, Jr., Joseph A. Hamzy, Jr., Howard A. Floyd, Arnold Noble, Jack Fogg, Percy Hopkins, Sr., Donald Boese, Vincent Lucido and William LeSerra. PRESENTATION OF CERTIFICATES OF APPRECIATION Mayor Marks read and signed Proclamation on PROCLAMATION - National Public Works Week - May 18-24, 1980 - NATIONAL PUBLIC and presented it to Curtiss Hamilton, Vice Presi- WORKS WEEK dent of Gold Coast Public Warks Association and Len Devine, State Director of Florida Chapter of American Public Works Association. Mayor Marks left the meeting at 8:15 p.m. and passed the gavel to Vice Mayor Moore. 1 The following minutes stand as prepared: ACCEPTANCE OF MINUTES Special Workshop Meeting of Library Advisory Board held May 6, 1980. Commission's recommendation that Chapter 27 of the RECOMMENDATION Landscape Ordinance be accepted as amended. The ACCEPTED motion was seconded by President Pro Tem Valente and all present voted aye. Mayor Marks returned to the meeting at 8:18 p.m. ' and Vice Mayor Moore returned the gavel to him. Councilman Brown moved that Bi11 No. 350 entitled: BzLL 350 PLACED ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM 1ST READING BEACH, FLORIDA, AMENDING CHAPTER 17 OF THE VILLAGE OF NORTH PALM BEACH CODE, LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS, BY REGULATING GARAGE SALES OR OTHER SALES OF MERCHANDISE ON RESIDENTIAL PREMISES AND PROVIDING PENALTY FOR VIOLATION be placed on first reading (as it was corrected at the May 8, 1980 workshop; namely: In Sec. 17-51, in the sixth sentence, change "Village Tax Collector" to"Building Official" and delete everything that follows the word "required.") On motion of Vice Mayor Moore, seconded by Council- RES. 24-80 woman Nolan - 4-1, with Councilman Brown opposed - ADOPTED proposed Resolution No. 24-80 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, COMMENDING GEOFFREY BIRT FOR HIS EXTRAORDINARY DEVOTION TO TRUTH AND FAIRNESS IN REPORTING .NEWS OF THE PROCEEDINGS OF THE NORTH PALM BEACH VILLAGE COUNCIL AND OTHER ACTIVITIES INVOLVING THE GOVERNMENT, CITIZENS, AND RESIDENTS OF THE VILLAGE OF NORTH PALM BEACH was read in full and adopted as read as Resolution No. 24-80. Vice Mayor Moore moved that Resolution No. 25-80 MOTION TO entitled: ADOPT RES. 25-80 A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AMENDING THE PERSONNEL REGULATIONS FOR VILLAGE EMPLOYEES BY CHANGING THE REQUIREMENTS FOR ANNUAL LEAVE be adopted. The motion was seconded by President Pro Tem Valente. The meeting was recessed at 9:17 p.m. and was RECESS reconvened at 9:28 p~m. Vice Mayor Moore moved to amend Resolution No. RES. 25-80 25-80, Section 1, as follows: AMENDED "7.03 Annual Leave: Following is the vacation po icy. Managers are urged to establish a vacation schedule which will provide for coverage throughout the year and yet permit the scheduling of vacations in accordance with employees' preference whenever possible. a) AMOUNT OF VACATION AND ELIGIBILITY REQUIREMENTS ' 1. Amount of Vacation Days With Pay in 1980 Eligibility Requirements 20 12 years or more of contin- uous service completed by 10/1/80. 15 7 years or more of continuous service completed by 10/1/80. 10 On payroll on or before 5/31/79, n u 1 Minutes of Regular Session Held Thursday, May 22, 1980 Page 4 Amount of Vacation Days With Pay in 1980 5 No vacation Eligibility Requirements On payroll between 6/1/79 and 10/1/79. Hired on or after 10/1/79. 2. In order to be eligible for a vacation, an employee must have been continuously and actively employed by the Village of North Palm Beach. The following guidelines are used to determine eligibility. aa) An employee hired in 1979 must have completed at least 6 months of .continuous service in order to qualify for a vacation and to be entitled to the 1980 vacation pay allowance. bb) An employee must have been actively in the em- ploy of the Village on December 31, 1979. cc) An employee must have worked not less than 75% of the regularly scheduled working days of the Village during 1979. dd) If an employee who-is eligible for a vacation in 1980 should die or terminate for any reason, except discharge, on or after.October 1, 1979 but prior to the time of the employee's 1980 vacation, the vacation pay allowance will be paid. ee) For each month worked in 1980, an employee who retired or dies in 1980 will be paid for 1/12th of the vacation for which he/she would have been eligible in 1981, provided the employee worked 75% of the regularly scheduled work days in 1980 prior to termination. A "month worked" is any month in which the employee worked at least one day. To determine .the amount of pro rata vacation allowance, divide the number of months worked in 1980 by 12, then multiply the resulting percentage by the number of vacation days for which the employee would have been eligible in 1981. The result should be rounded uQ to whole days. 3. Consideration is given where possible to the preference of an employee in the scheduling of a vacation. It may be necessary, however, for the Village to schedule vacations. i~ 4. An employee will be granted an additional day of vacation with pay when a recognized holiday falls within a scheduled vacation period. 5. An employee's vacation period may not be extended nor a subsequent vacation granted to-compensate for days of illness or injury which occur during a scheduled vacation." The motion was seconded by Councilwoman Nolan and all present voted aye. Thereafter Council voted on the main motion which MAIN MOTION passed unanimously. Therefore, Resolution No. PASSED 5-0 25-80 was adopted as amended. Minutes of Regular Session Held Thursday, May 22, 1980 Page 5 Councilman Brown moved that Resolution No. 26-80 MOTION TO entitled: ADOPT RES. 26-80 A RESOLUTION OF THE VILLAGE .COUNCIL OF NORTH PALM BEACH, FLORIDA, URGING THE FLORIDA DE- PARTMENT OF TRANSPORTATION TO PLAN, IMPLEMENT, AND COMPLETE CERTAIN ROAD PROJECTS WITHIN NORTH ' PALM BEACH, FLORIDA be adopted. The motion was seconded by Vice Mayor Moore. President Pro Tem Valente moved to amend Resolution RES. 26-80 No. 26-80 as follows: In Section 1, add the follow- AMENDED ing: "(c) Fenced walkway on Parker Bridge" The motion was seconded by Councilwoman Nolan and all present voted aye. Thereafter Council voted on the main motion which MAIN MOTION passed unanimously. Therefore, Resolution No. PASSED 5-0 26-80 was adopted as amended. On motion of Vice Mayor Moore, seconded by Council- RES. 27-80 man Brown, all present .voting aye, proposed Resolu- ADOPTED tion No. 27-80 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ADOPTING AN INVESTMENT POLICY FOR THE VILLAGE was read in full and adopted as read as Resolution No. 27-80. On motion of Councilwoman Nolan, seconded by Council- RES. 28-80 man Brown, all present voting aye, proposed Resolu- ADOPTED tion No. 28-80 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF ZAMBELLI INTERNATIONALE FOR FIREWORKS DISPLAY, JULY 4, 1980, IN THE AMOUNT OF $2,800.00, FROM ACCOUNT N0. 403- 572-49.32 was read in full and adopted as read as Resolution No. 28-80. Councilman Brown moved that we close the North Palm MOTION TO CLOSE Beach Country Club on Mondays, with the exception NPBCC ON MON- . of the Golf Driving Range and Tennis.Courts. The DAYS motion was seconded by Councilwoman Nolan. President Pro Tem Valente moved to amend the MOTION AMENDED motion as follows: That the North Palm Beach ' Country Club pool be open to Village residents on Mondays for a fee of $1.00 for students or children and $1.50 for adults. The motion was seconded by Councilwoman Nolan and all present voted aye. Vice Mayor Moore moved that the motion be amended MOTION TO AMEND as follows: that nine holes o£ the golf course be WITHDRAWN open on Mondays from 7 a.m, to 11 a.m. The motion was seconded by President Pro Tem Valente. During the discussion, Vice Mayor Moore withdrew his motion and President Pro-Tem Valente withdrew his second. Minutes of Regular Session Held Thursday, May 22, 1480 Page 6 Vice Mayor Moore moved .that nine holes of the .golf MOTION TO course be open on Mondays between 7 a.m, and 11 a.m. AMEND for golfers who desire to play the course in a walking mode, with no services being provided by the country club other than a starter to register and charge fees of those who are not members. The motion was second- ed by President Pra Tem Valente. (There was no vote taken on this motion, nor was it withdrawn). Mayor Marks passed the gavel to Vice Mayor Moore MOTION and moved to amend the above motion as follows: WITHDRAWN that one nine of the golf course be open every Monday to be played between the hours of 7 a.m. and 12 noon. The motion was seconded by Pres- ident Pro Tem Valente. During the discussion, Mayor Marks withdrew his motion and President Pro Tem Valente withdrew his second. Vice Mayor Moore returned the gavel to Mayor Marks. Vice Mayor Moore moved to amend the motion as MOTION AMENDED follows: that the golf course be open for nine holes from 7:00 a.m. to 11:00 a.m. for walkers only and if, after thirty days, it is not being used by ten percent of the golfers or greater, we will close it on Mondays (for the rest of the summer). The motion was seconded by President Pro Tem Valente and passed .4-1, with Councilman Brown opposed. Thereafter Council voted on the main motion MAIN MOTION which passed as amended by unanimous vote. PASSED 5-0 ' Councilman Brown moved that we transfer the amount ITEM WITH- of $6,281.00 to fund the position of Project Co- DRAWN FROM ordinator, Stu Taber. The motion was seconded AGENDA by President Pro Tem Valente. During the dis- cussion, this item was withdrawn from the agenda. Vice Mayor Moore moved that we do not sign the MOTION DIED agreement between the Village and the Urban League FOR LACK OF A of Palm Beach County for Title IV - CETA employees SECOND for twelve weeks summer program. The motion died for lack of a second. Councilman Brown moved that we sign the agreement MOTION DIED between the Village and the Urban League of Palm FOR LACK OF Beach County for Title IV - CETA employees for A SECOND twelve weeks summer program.
