02-22-1979 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, FEBRUARY 22, 1979 Present: Al Moore, Mayor Donald J. Kazimir, Vice Mayor W. H. Brown, President Pro Tem V. A. Marks, Councilman Patsy B. Love, Councilwoman Herbert L. Gildan, Village Attorney Paul J. Nicoletti, Village Manager Dolores R._Walker, Village Clerk Mayor Moore called the Regular Session to order at 7:30 ROLL CALL p.m. All members of the Council were present. Councilwoman Love gave the invocation and Councilman INVOCATION & Marks led the Council and the public in the Pledge of PLEDGE OF Allegiance to the Flag. On motion of Councilman Brown, seconded by Council- BILL 318 woman-Love - 4-l, with Mayor Moore opposed - Bill No. PLACED ON 318 entitled: 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE VILLAGE OF NORTH PALM BEACH CODE BY CREATING THE OFFICE OF ASSISTANT VILLAGE MANAGER AND SETTING FORTH THE DUTIES OF THE ASSISTANT VILLAGE MANAGER was placed on first reading and read by title alone. ORD. 3-79 On motion of Councilman Marks, seconded by Council- RES. 15-79 woman Love, all present voting aye, proposed Resolu- __ ADOPTED tion No. 15-79 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, REQUESTING THE CITY OF WEST PALM BEACH TO INCLUDE THE VILLAGE OF NORTH PALM BEACH AS A PLAINTIFF IN A SUIT TO BE FILED BY THE CITY __ OF WEST PALM BEACH SEEKING DECLI-iRATORY RELIEF CONCERNING THE RESPONSIBILITY OF THE STATE OF FLORIDA TO MAINTAIN SIDEWALKS ABUTTING PRIMARY AND SECONDARY STATE ROADS was read in full and adopted as read as Resolution No. 15-79. Councilman Brown moved that proposed Resolution No. MOTION TO ADOPT 16-79 .entitled:- RES. 16-79 ' A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ADOPTING FOR USE BY THE VILLAGE CERTAIN INTERNAL ACCOUNTING CONTROL PROCEDURES RECOMMENDED BY THE VILLAGE AUDITORS, CARPENTER, MAY & BREMER, IN THEIR LETTER DATED JANUARY 26, 1979 TO THE VILLAGE COUNCIL be adopted as read. The motion was seconded by Vice Mayor Kazimir. Councilman Brocvn moved to amend Resolution No. 16-79 RES. 16-79 as follows: In Section 1 between the words there- AMENDED from and Paragraph IV, add T'the last sentence of". The motion was seconded by Councilman Marks and all present voted aye. Thereafter Council voted on the main motion which passed 5-0. Therefore, Resolution No. 16-79 was adopted as amended. Councilwoman Love moved that we approve payment of $12,090.00 to Seacoast Utilities, Inc. for fire hydrants in service for 1978 to be expended from Account No. 22-522-44.30. The motion was seconded t by Vice Mayor Kazimir and all present voted aye. Councilman Brown moved that we approve an increase in salary for school guards from $3.00 to 53.50 per hour. The motion was seconded by Councilwoman Love and all present voted aye. RES. 16-79 ADOPTED AS AMENDED APPROVAL OF PAYMENT - FIRE HYDRANTS INCREASE IN SALARY APPROVED FOR SCHOOL GUARDS Minutes of Regular Session Held Thursday, February 22,-1979 Page 3 1 Councilwoman Love moved that we approve sending in the form (to the U. S. Department of Commerce, Bureau o£ the Census) appointing the Village Manager as Liaison to the Local Review Program of the Bureau of the Census for the 1980 Decennial Census. The motion was seconded by Vice Mayor Kazimir and all present voted aye. VILLAGE MGR. APPOINTED LIAIS_QN - BUREAU OF THE CENSUS Councilman Brown moved that we place on the agenda at this time discussion of the parking problem at Gemini Condominium. The motion was seconded by Councilman Marks and all present voted aye. Councilman Marks moved that we permit the Village Manager and the Village Attorney to negotiate. with the owner of parking space No. 42 at the Gemini Condominium, and ex- pend the funds for this from Account No. 61-519-99.11, Council Contingency. The motion was seconded by Vice Mayor Kazimir and all present voted aye. NON AGENDA ITEM PLACED ON AGENDA i ~i NEGOTIATIONS WITH OWNER OF PARKING SPACE 42 - GEMINI CONDO Councilman Brown moved that we place on the agenda at NON AGENDA this time discussion of a letter from the Council to ITEM PT~ACED Mr. David Reid about our tax loss or gain. The motion ON AGENDA was seconded by Vice Mayor Kazimir and all present voted aye. Councilman Brown moved that we place on the agenda at NON AGENDA this time that a representative be sent to the Voting ITEM PLACED Equipment Center to certify to the testing of tabulation ON AGENDA equipment to be used for the Village's General Election of March 20, 1979. The motion was seconded by Council- woman Love and all present voted aye. Vice Mayor Kazimir moved that we appoint Mrs. Walker VILLAGE CLERK to certify to the proper operation of the voting machines TO CERTIFY TO to be used for the Village's General Election of March PROPER OPERA- 20, 1979. The motion was seconded by Councilwoman Love TION OF VOTING and all present voted aye.
