09-13-1979 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 13, 1979 Present: W. H. Brown, Mayor Donald J. Kazimir, Vice Mayor Patsy B. Love, President Pro Tem V. A. Marks, Councilman Herbert L. Gildan, Village Attorney ' Paul J. Nicoletti, Village Manager Dolores R. Walker, Village Clerk Absent: Al Moore, Councilman Mayor Brown called the Regular Session to order at 7:33 ROLL CALL p.m. All members of the Council were present except Councilman Moore. Councilman Marks gave the invocation and Vice Mayor INVOCATION & Kazimir led the Council and the public in the Pledge PLEDGE OF of Allegiance to the Flag. ALLEGIANCE The minutes of Public Hearing held Thursday, August 23, APPROVAL OF 1979 stand as prepared; and the minutes of Regular MINUTES Session held Thursday, August 23, 1979 stand as correct- ed. Councilwoman Love moved that we place on first reading, NON AGENDA on tonight's regular session agenda as Item 10 (e) ITEM PLACED under Ordinances, Bi11 No. 337. The motion was second- ON AGENDA ' ed by Vice Mayor Kazimir and all present voted aye. The following minutes stand as prepared: ACCEPTANCE OF MINUTES Regular Meeting of Planning Commission held August 6, 1979 _ Regular Meeting of Planning Commission held September 4, 1979 Regular Meeting of North Palm Beach Country Club Advisory Board held August 21, 1979 The Village Council deferred the recommendations of RECOMMENDATIONS the Planning Commission contained in the minutes of OF PLANNING their meeting of September 4, 1979 concerning the COMMISSION Marine Sanctuary Ordinance until second reading of _ DEFERRED Bill No. 333, which is Item 10 (a) under Ordinances on tonight's regular session agenda. Councilwoman Love moved that we approve the recom- NPBCC AD. On motion of Councilman Marks, seconded by Vice Mayor BILL 336 Kazimir, all present voting aye, Bill No. 336 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, LEVYING A TAX ON REAL AND PERSONAL PROPERTY LOCATED WITHIN THE CORPORATE LIMITS OF THE VILLAGE DF NORTH PALM BEACH ON JANUARY 1, 1979; FIXING THE TOTAL VALUATION THEREON AND THE TAX MILEAGE RATE THEREON FOR SAID TAX YEAR; ADOPTING BUDGETS FOR THE FISCAL YEAR OCTOBER 1, 1979 TO SEPTEMBER 30, 1980, BOTH INCLUSIVE, FOR THE VILLAGE OF NORTH PALM BEACH GENERAL FUND, INCLUDING DEBT RETIRLTIENT AND FOR THE NORTH PALM BEACH COUNTRY CLUB REVENUE FUND; AND REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE was placed on first reading and read by title alone. In compliance with his request, during the discussion COUNCILMAN of Bill No. 336, Councilman MooreTs following state- MOORETS ment for the record was read for incorporation into STATEMENT FOR the minutes of this meeting: THE RECORD 1The Village AttorneyTs discussion regarding the recommendation of the Planning CorrPnission concerning the Marine Sanctuary Ordinance indicated that the ordinance as prepared is clear and, therefore, no changes were necessary. Minutes of Regular Session ' Held Thursday, September 13, 1979 Page 3 1 "I shall vote "No" on the 1979-80 budget because it was a fiasco from the beginning. the original budget contained numerous errors and even after it was updated it was still in error. The first meeting date was postponed with no notice to the general public. The Village made no effort to stay within the 5% increase in millage set by the. State. What we did was find a new way to increase the tax base. How? We increased our utility tazC by 75%. This is an unfair and unjust tax to the Village taxpayers. Where could the budget have been cut? 1. Village salary increases for 1979-80 are excessive; 10.25% to all under $12,500, 10.4% to those over. The total increase based on salary and fringes should have been held to 7%. Most taxpayers do not realize what is included in addition to salary; for example, free insurance and retirement, holidays, sick days, etc., and free uniforms, shoes, gloves, and tools of the trade for nearly all. 2. Department Heads made no real effort to evaluate if the employees they had in 1978-79 were needed for 1979-80. I am sure most of you (Council) still receive comments that we have too many people who-seem to be idle mast of the day. Information we received to evaluate the departmentis needs is often in error, but the Council as a whole doesntt seem interested. Too often the statement is made, "We hired him (Village Manager) to do that job; now, let him do it." But I say it is the responsibility of each elected official to assure that the taxpayers are represented and know that their tax dollars are used for productive purposes. 3. The addition of an assistant to the Director of Public Services was not justified to the Council. We don't have a need for that position. 4. The majority voted to spend $100,000 on an unnecessary relocation and drainage of the ballfield and rebuilding the concession stand at Osborne Park. Later, to balance the already out-of-balance budget, $86,000 of the projected expenditure had to be cut. I contend that the $4,000 for grass at Allamanda Park should still be cut. 5. The book budget for the Library is too high based on the present usage by Village residents and a.few outsiders who pay $15.00 a year membership. 6. The trips proposed and approved by the majority of the Council for the department heads, Village Manager, etc. are too numerous. A suggestion to not pay for out-of- state conventions received little or no support. The Council should consider not only the actual cost for motels, transportation, food, etc., but the man-days lost. Overall,-dollars for these trips are in the thousands. 7. The Assistant Village Manager does not serve the tax- payer as to the part of the salary they (the taxpayers) pay him. Minutes of Regular Session Held Thursday, September 13, 1979 Page 4 8. Other cuts could have, and should have, been made but we arrived at the old statement, 'They need it. Who are we (Council) to question them. Let's move on and get through with the budget." 1 The Country Club budget will be an item for discussion at the September 27, 1979 meeting. The future tax base for North Palm Beach will rise with in- flation, but the tax rate can be lowered if the Council will take a proper look at the Village business. You must be willing to do your homework; then determine productive usage of people and resources. After this has been done, direct the Village Manager to follow these policies!" On motion of Vice Mayor Kazimir, seconded by Council- BILL 337 woman Love, 3-l, with Councilman Marks opposed, Bill PLACED ON No. 337 entitled: 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 26-29 OF THE VILLAGE OF NORTH PALM BEACH CODE BY INCREASING THE TAX LEVIED ON THE PURCHASE OF ELECTRICITY, METERED GAS AND BOTTLED GAS (NATURAL LIQUEFIED PETROLEUM GAS) WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF NORTH PALM BEACH FROM 5% TO 8.75%; REPEALING ORDINANCE IN CONFLICT WITH THIS ORDINANCE, AND SETTING FORTH THE EFFECTIVE DATE OF THIS ORDINANCE 1 i was placed on first reading and read by title alone. Councilman Marks moved that we authorize Pa]Jn Beach Covnty to proceed with the repair to the traffic light at Lighthouse Drive and Prosperity Farms Road in an amount not to exceed $1,700.00 to be expended from Account No. 34-541-46.82. The motion was seconded by Vice Mayor ICazimir and all present voted aye. Councilman Marks moved that we appropriate $2,000.00 from Council Contingency Account No. 61-519-99.11 to Inter-City First Aid Squad, Inc. for an emergency donation with no strings attached'. The motion was seconded by Vice Mayor Kazimir and all present voted aye.
