07-19-1979 VC SP-MMINUTES OF SPECIAL SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JULY 19, 1979 1 1 Present: W. H. Brown, Mayor Donald J. Kazimir, Vice Mayor Patsy B. Love, President Pro Tem V. A. Marks, Councilman Al Moore, Councilman Paul J. Nicoletti, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Mayor Brown called the Special Session to order at 7:32 ROLL CALL p.m. All members of the Council were present. The purpose of this Special Session is a one item PURPOSE OF Special Session to express the position of the Village SPECIAL SESSION Council concerning public acquisition of Seacoast Utilities,. Inc. After Council discussed this matter at great length, Vice Mayor Kazimir moved that we send the letter drafted by the Mayor, dated July 20, 1979, (to the Mayor and City Council of Palm Beach Gardens and the Mayor and Town Commission of Lake Park) with the following correc- tions: (1) Change the salutation to "Dear Council Members and Commission Members; (2) In paragraph four of page two, change "sixty days" to "thirty days"; and (3) After the word "status" in paragraph three of page two, the letter shall read "to date and on no less than a monthly basis in the future." The motion was seconded by Councilman Marks and all present voted aye. Mayor Brown read the letter in total for the edification of the public. A copy of this letter will be attached to the minutes of this Special Session. Resolution No. 19, 1979 Dear Council Members and Commission Members: This will acknowledge receipt of Mayor Lauriets letter of July , 16th (Ref. A) in which we are assured that the City of. Palm Beach Gardens intends to pursue the acquisition of Seacoast Utilities, Inc. 'rwithout hesitancy." - This letter still leaves some nagging doubts in our minds which we believe should be clarified as soon as possible. These are as follows: 1-. We believe Resolution 19, 1979 (Ref. C) did not express the oral agreements reached at the Tri-City Meeting of February 12, 1979. Therefore; we urge that a binding caritten agreement setting forth the intent and meehan- ics for an equitable sharing of investigative expenses and equal consumer rates throughout the system be successfully concluded by the •three municipalities. This must be done before we can continue to agree that the City of Palm Beach Gardens assume the leadership role in this endeavor. W ' ... 2 - 2. Too much `careful, deliberate movement" can raise costs as significantly as plunging headlong. It has been approximately five months since the Tri-City Meeting of February 12, 1979 during which the price of the utility has undoubtedly increased due to inflation, Bold steps are necessary to assure the "acquiring` of this system as soon as we are certain that con- sumer rates will not rise. 3. The City of Palm Beach Gardens has been less than diligent in keeping Lake Park and North Palm Beach advised of its progress. It is. imperative that each municipal governing body be informed of the status to date and on no less than a monthly basis in the future. 4. In view of current and previous communication failures (both ways) plus the likelihood of our governing bodies changing members over the coming months and years, it is imperative that our Managers and Attorneys start to negotiate an interlocal agreement acceptable to all three municipalities. This agree- ment should address, but not be limited to, the ideas expressed in sections 1-3 of this letter. If you agree to the need for an interlocal agreement please direct, by motion, your Manager and Attorney to negotiate said agreement and return a draft for your consideration within thirty days. We have so directed Messrs. Nicoletti and Gildan at our Special Session of July 19, 1979. Please understand that our sole interest in urging your timely considera- tion of this matter is to provide quality utility service to all of our residents at the earliest possible time.
