08-23-1979 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, AUGUST 23, 1979 1 Present: W. H. Brown, Mayor Donald J. Kazimir, Vice Mayor V. A. Marks, Councilman Al Moore, Councilman Herbert L. Gildan, Village Attorney Paul J. Nicoletti, Village Manager Linda J. Staples, Deputy Village Clerk Absent: Patsy B. Love, President Pro Tem Mayor Brown called the Regular Session to order at ROLL CALL 7:30 p.m. All members of the Council were present except President Pro Tem Love. Vice Mayor Kazimir gave the invocation and Councilman Moore led the Council and the public in the Pledge of Allegiance to the Flag. The minutes of Regular Session held Thursday, August 9, 1979 stand as prepared. Councilman Moore moved to postpone action on the Planned Unit Development Ordinance for an indefinite period of time. The motion died for lack of second. Vice Mayor Kazimir moved that the .Planned Unit Development Ordinance be placed on the September 13, 1979 Workshop Agenda. The motion was seconded by ' Councilman Marks and passed 3-1 with Councilman Moore opposed. Councilman Marks moved that we continue the Agreement with other Municipalities not in the County System as recommended by the Library Advisory Board. Vice Mayor Kazimir seconded the motion. Following a brief discussion, Councilman Marks moved to amend the motion to postpone Council action until the Regular Session on September 27, 1979 so that data regarding resident-nonresident usage could be collected by the Library. The_ motion was seconded by Vice Mayor Kazimir and passed 4-0. Thereafter, the main motion passed as amended 4-0. INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OP MINUTES MOTION DIED FOR LACK OF SECOND P.U.D. ORD. PLACED ON WORKSHOP AGENDA MOTION RE: LIBRARY AGREEMENT MOTION AMENDED MAIN MOTION PASSED Councilman Marks asked for an update on the status of UPDATE ON the Seacoast Utilities Acquisition. Since a report had UTILITIES not been received from Palm Beach Gardens, the Village ACQUISITION Manager was requested to contact Palm Beach Gardens for information on the acquisition and report back to Council at its Regular Session on September 13, 1979. On motion of Councilman Moore, seconded by Councilman ' Marks, all present voting aye, Bill No. 333 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY, FLORIDA, AMENDING ARTICLE VII ENTITLED "COASTAL CONSTRUCTION AND EXCAVATION SETBACK" OF CHAPTER 7 ENTITLED "BULKHEAD LINES" OF THE VILLAGE CODE BY ENACTING COUNCIL`S FINDING OF FACTS; EXPRESSION OF INTENT; DEFINITION; DESIGNATION OF WETLANDS BILL N0, 333 PLACED ON FIRST READING Minutes of Regular Session Held Thursday, August 23, 1979 Page 2 1 C_ 1 AS MARINE AND WILDLIFE SANCTUARIES WITHIN THE CORPORATE LIMITS OF THE VILLAGE;AND REQUESTING THE SECRETARY OF COMMERCE TO DESIGNATE WETLANDS WITHIN THE VILLAGE OF NORTH PALM BEACH AS MARINE SANCTUARIES FOR THE PURPOSE OF PRESERVING AND RE- STORING SUCH AREAS FOR THEIR CONSERVATION, RECREATIONAL OR AESTHETIC VALUES was placed on first reading and read by title alone. On motion of Vice Mayor Kazimir, seconded by Councilman Marks, all present voting aye, the Council approved payment for emergency repairs to the garbage packer in the amount of $3,922.94 to be expended from account number 33-534-~F6.10.
