11-09-1978 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, NOVEMBER 9, 1978 1 Present: Al Moore, Mayor Donald J. Kazimir, Vice Mayor W. H. Brown, President Pro Tem V. A. Marks, Councilman Patsy B. Love, Councilwoman Herbert L. Gildan, Village Attorney Paul J. Nicoletti, Village Manager Dolores R. Walker, Village Clerk Mayor Moore called the Regular .Session to order at 7:30 p.m. All members of the Council were present. Councilman Brown gave the invocation and Councilwoman Love led the Council and the public in the Pledge of Allegiance to the Flag. On motion of Councilman Brown, seconded by Vice Mayor Kazimir, all present voting aye, the Minutes of Regular Session held Thursday, October 26, 1978 were approved as written. Mayor Moore read and signed the following Proclamations Shrine Hospital Day - November 19, 1978 Human Rights Week - December 10-16, 1978 Vice Mayor Kazimir moved that we remove Item 6 (a) (Interlocal Agreement betcaeen Village of North Palm Beach and Palm Beach County - Community Development Act) from the workshop session agenda and place it on the regular session agenda as Item 12 (d). The motion was seconded by Councilman Brown and passed 3-2, with Mayor Moore and Councilman Marks opposed. Councilman Brown moved to place on the regular session agenda as Item 12 (e) discussion of Mayor Moore's letter to Representative Tom Lewis which attempts to corrupt Council's Resolution No. 43-78 regarding signs on State Road 703. The motion was seconded by Vice Mayor Kazimir and passed 3-2, with Mayor Moore and Councilman Marks opposed. On motion of Councilman Marks, seconded by Vice Mayor Kazimir, all present voting aye, the following minutes were accepted by the Council: Minutes of Special Meeting of Planning Commission held October 24, 1978 1 Minutes of North Palm Beach Library Board Meeting held October 24, 1978 Councilman Brown moved that all four items recommended by the Country Club Advisory Board in their meeting of October 17, 1978 be handled positively by the Village Manager and, if for some reason he canTt, he will so advise us. The motion was seconded by Vice Mayor Kazimir and all present voted aye. ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES PROCLAMATIONS READ & SIGNED BY PIAYOR ITEM MOVED FROM WORKSHOP TO REGULAR ITEM PLACED ON REGULAR SESSION AGENDA ACCEPTANCE OF MINUTES RECOMMENDA- TIONS OF CC AD. BD. Minutes of Regular Session Held Thursday, November 9, 1978 Page 2 On motion of Councilman Marks, seconded by Vice Mayor RES. 53-78 Kazimir, all present voting aye, proposed Resolution ADOPTED No. 53-78 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE ANNUAL CONTRACTS LET BY PALM BEACH COUNTY FOR VARIOUS PUBLIC WORKS ' MATERIALS, AND PROVIDING AN EFFECTIVE DATE was read in full and adopted as read as Resolution No. 53-78. Councilman Brown moved that we authorize the purchase of AUTHORIZATION 16 tons of fertilizer from W. R. Grace & Company in the TO PURCHASE amount of $1,800.00 to be expended from Account No. 11.1-- FERTILIZER 52.23. The motion was seconded by Councilwoman Love and all present voted aye. Councilman Brown moved that we approve the submission of SUBMISSION the IPA Grant Application (under the Intergovernmental OF IPA GRANT Personnel Act of 1972). The motion was seconded by Vice APPLICATION Mayor Kazimir and all present voted aye. Councilman Brown moved that we cancel the regular and 11/23/78 workshop sessions of November 23, 1978 in observance of MEETINGS Thanksgiving. The motion was seconded by Councilwoman CANCELLED Love and all present voted aye. Councilman Marks moved that we sign the Community Develop- MOTION TO ment Inter-local Agreement provided that we have control SIGN COMMUNITY over everything they do within 300 feet of our boundaries. DEVELOPMENT ' The motion was seconded by Councilman Brown for discussion INTER-LOCAL only. AGREEMENT WITH CERTAIN PROVISIONS The motioner, Councilman Marks, and the seconder, Council- MOTION RE- man Brown, revised the motion to eliminate from it the VISED 300 feet proviso. Councilman Marks moved that we authorize the Mayor to MAYOR AUTHOR- sign the Community Development Inter-local Agreement IZED TO SIGN to allow them to use the population of the Village COMMUNITY to receive federal funds. The motion was seconded by DEVELOPMENT Councilman Brown and passed 4-1, with Mayor Moore INTER-LOCAL opposed. AGREEMENT Councilman Brown moved to censure Mayor Moore for violat- MOTION TO ing in principle and spirit Article III, Section 3, of CENSURE MAYOR the Village Charter. The motion was seconded by Council- woman Love. Councilman Brown stated that the reason for his censuring the Mayor was that he wrote a letter trans- mitting Resolution No. X43-78 concerning signs on State Road 703, suggesting that it was improper for the Mayor ' to transmit Council action as Mayor and to include in the transmittal his personal opposition to the action of the Council. In addition, Councilman Brown objected to this letter being written on Village letterhead and being signed "A1 Moore, Mayor." Councilman Marks moved that this item be tabled until MOTION DIES Council's next regular session of December 14, 1978. FOR LACK OF The motion died for lack of a second. A SECOND Mayor Moore stated that the only two things he would MAYOR'S apologize for are the use of Village stationery and APOLOGY using the title "Mayor" under his name. He stated that he did not think he had to apologize for the con- tents of the letter. Minutes of Regular Session Held Thursday, November 9, 1978 Page 3 1 1 Mayor Moore advised the Council that he would, on plain white stationery, write a letter to Representative Tom Lewis and ask him to remove the letterhead of the Village of North Palm Beach from the top of the letter and strike through the title "Mayor" at the bottom of the letter, and would send copies of this letter to those persons who received a copy of his original letter. Councilman Brown stated that in view o£ Mayor Moore's apology and his statement that he will send a letter on plain paper and sign it "A1 Moore", or take the letterhead off and the title "Mayor" off of the one that is up there, he would withdraw the motion if his second is so willing. Councilwoman Love agreed to withdraw her second. Therefore, the motion to censure Mayor Moore was withdrawn. There being no further business to come before the Council, on motion of Councilwoman Love, seconded by Councilman Brown, all present voting aye, the meeting was adjourned at 8:45 p.m. Minutes recorded by: Dolores R.
