02-23-1978 VC SP-MMINUTES OF SPECIAL SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, FEBRUARY 23, 1978 1 J Present: M. C. Love, Jr., Mayor V. A. Marks, Vice Mayor Al C. Moore, President Pro Tem William H. Brown, Councilman Donald J. Kazimir, Councilman Herbert L. Gildan, Village Attorney Paul J. Nicoletti, Village Manager Dolores R. Walker, Village Clerk Mayor Love called the Special Session to order at 7:00 p.m. All members of the Council were present except Vice Mayor-Marks who arrived at 7:04 p,m. The purpose of this Special Session is to consider en- actment of Bill No. 288, which had been placed on second reading at the Village CouncilTs Regular Session of Thurs- day, February 9, 1978. Councilman Brown moved to adopt Bill No. 288 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY REZONING THE FINGER OF LAND IMMEDIATELY NORTH OP THE PARADISE HARBOUR COND0I~IINIUMS FROM ZONING DISTRICT R-2 TO ZONING DISTRICT R-1; BY REZONING THE AREA ON THE WEST SIDE OF U. S. #1 FROM SOUTH ANCHORAGE DRIVE TO EBBTIDE DRIVE FROM ZONING DISTRICT CA TO ZONING DISTRICT CB; BY REZONING THE EAST SIDE OF U. S. i~kl FROM THE EARMAN RIVER NORTH TO THE EXTENSION OF EBBTIDE DRIVE FROM ZONING DISTRICTS CA AND R-1 TO ZONING DISTRICT CB; AND BY DIRECTING THE VILLAGE CLERK TO REFLECT SAID CHANGES UPON THE OFFICIAL ZONING MAP as Ordinance No. 3-78. The motion was seconded by Council- man Kazimir. ROLL CALL PURPOSE OF SPECIAL SESSION MOTION TO ADOPT BILL 288 AS ORD. 3-78 Councilman Brown moved to amend Bill No. 288 as follows: BILL 288 That we delete the west side of U_ S. #1 from the CB Zone AMENDED until a study can be made of the rest of U. S. Highway #l. The motion cvas seconded by Councilman Kazimir and passed 3-2, with Vice Mayor Marks and Councilman Moore opposed. Thereafter Council voted on the main motion which passed 3-2, with Vice Mayor Marks and Councilman Moore opposed, Therefore Bill No. 288 was adopted as amended as Ordinance No. 3-78. ' Vice Mayor Marks stated for the record that he voted against the amended Bill No. 288 because he felt that it is strip zoning. It is not according to the way we usually do things in the Village Councilman Kazimir stated he would like to explain his vote also. He said: "I think these people are wrong. I donTt agree with them at all. At least we can get the other side done now, and possibly we can get this part done later if we can convince them that we are right." Councilman Brown stated he would like the record to show that he agrees with Councilman Kazimir.
