10-27-1977 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, OCTOBER 27, 1977 LJ Present: M. C. Love, Jr., Mayor V. A. Marks, Vice Mayor Al C. Moore, President Pro Tem William H. Brown, Councilman Donald J. Kazimir, Councilman Paul J. Nicoletti, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Mayor Love called the Regular Session to order at 7:30 p.m. All members of the Council were present. Vice Mayor Marks gave the invocation and Councilman Kazimir led the Council and the public in the Pledge of A]legiance to the_Flag. On motion o£ Councilman Moore, seconded by-Vice Mayor Marks, all present voting aye, the following minutes were approved as written: ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES Minutes of Regular Session held Thursday, October 13, 1977 t Minutes of Public Hearing held Tuesday, October 18, 1977 On motion of Councilman Brown, seconded by Councilman Kazimir, all present voting aye, the following minutes were accepted by the Council: ACCEPTANCE OF MINUTES Minutes of Regular Meeting of Planning Commission held October 4, 1977 Minutes of Special Meeting of Planning Commission held October 12, 1977 Minutes of Zoning Board of Adjustment Meeting held October 11, 1977 ~~ Concerning the recommendation of the Country Club Ad- visory Board that no daily fee in lieu of membership be offered at the pool, Councilman Brown moved that we send this back to the board for consideration of use of the pool one day per week,that would be most applicable for a daily fee,during the summertime. The motion was seconded by Councilman Kazimir and passed 4-l, with Mayor Love opposed. On motion of Vice Mayor Marks, seconded by Councilman Moore, all present voting aye, Bill No. 280 entitled: COUNTRY CLUB AD. BD. RECOM- MENDATION BILL 280 PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 6-34 OF THE VILLAGE CODE BY REQUIRING ALL MATTERS UPON WHICH THE VILLAGE COMMUNITY APPEARANCE BOARD MUST ACT TO BE SUBMITTED AT LEAST FOURTEEN (14) DAYS PRIOR TO THE REGULARLY SCHEDULED MONTHLY MEETING OF THE BOARD Minutes of Regular Session Held Thursday, October 27, 1977 Page 2 was placed on second reading and read by title alone. On motion of Councilman Brown, seconded by Councilman Moore, all present voting aye, Bill No. 280 was adopted as Ordinance No. 19-77. On motion of Councilman Kazimir, seconded by Vice Mayor Marks, all present voting aye, Bill No. 281 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR -- THE FISCAL YEAR 1976-77 BY APPROPRIATION TRANSFERS was placed on second reading and read by title alone. BILL 280 ADOPTED AS ORD. 19-77 BILL 281 PLACED ON 2ND READING On motion of Councilman Kazimir, seconded by Councilman BILL 281 ADOPTED Brown, all present voting aye, Bill No. 281 was adopted __-_ AS ORD. 20-77 as Ordinance No. 20-77. On motion of Councilman Brown, seconded by Councilman Kazimir, all present voting aye, Bill No. 282 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING PORTIONS OF ORDINANCE N0. 19-76, THE BUDGET ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH FOR THE FISCAL YEAR 1976-77 L was placed on second reading and read by title alone. On motion of Councilman Brown, seconded by Councilman Kazimir, all present voting aye, Bill No. 282 was adopted as Ordinance No. 21-77. Councilman Brown moved that we authorize the Mayor to execute the Agreement between the Village of North Palm Beach and Community Hospital of the Palm Beaches, Inc. after it has been amended by deleting the second, third, fourth and fifth "Whereas", leaving the balance of the Agreement as is. The motion was seconded by Councilman Moore and all present voted aye. AGREEMENT - NPB & COMMUNITY HOSPITAL Councilman Brown moved that we authorize the Village 15% GRATUITY AT staff to implement the fifteen percent gratuity in the NPBCC bar and the dining room at the North Palm Beach Country Club. The motion was seconded by Vice Mayor Marks and passed ~4-l, with Councilman Moore opposed. Vice Mayor Marks moved that we allow the tapes (of re- POLICY RE TRANS- corded meetings) to be listened to by anybody in the CRIPTS OF RECORD- Village or outside of the Village under the proper ED MEETINGS scrutiny, but at any time when a transcript is re- - quested outside of official Village personnel that a charge be made for same. The motion was seconded by Councilman Brown and all present voted aye. Councilman Moore moved that we pay the bills of the MOTION DIED FOR Country Club (for the provision of Public Services LACK OF A SECOND Department labor) to the Village. The motion died for lack of a second. BILL_282 PLACED ON 2ND READING BILL 282 ADOPTED AS ORD. 21-77 Minutes of Regular Session Held Thursday, October 27, 1977 Page 3 C CI Vice Mayor Marks moved that for accounting purposes, the Finance Department account for the fact that Public Works labor has been used at the North Palm Beach Country Club, which should be debited against that account to reflect what the Council believes is an accurate reflection of income and expenses at the North Palm Beach Country Club, both for setting up Reserve Operation Funds and for ad- wising the Council and the public as to the profit situ- ation at the Country Club. -The motion was seconded by Councilman Moore and failed 2-3, with Mayor Love, Council- man Brown and Councilman Kazimir opposed. Councilman Moore moved that we place on the agenda at this time the appointment of an Acting Village Manager. The motion was seconded by Vice Mayor Marks and all present voted aye. Councilman Moore moved that we approve the designation of Mr. Charles OTMeilia as Acting Village Manager for _ the period October 29 through November 13, 1977. The motion was seconded by Councilman Brown and all present voted aye. There being no further business to come before the Council, on motion of Councilman Moore, seconded by Vice Mayor Marks, all present voting aye, the meeting was adjourned at 8:50 p.m. Minutes recorded by: Dolores R.
