10-13-1977 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, OCTOBER 13, 1977 Present: M. C. Love, Jr., Mayor V. A. Marks, Vice Mayor Al C. Moore, President Pro Tem William H. Brown, Councilman Donald J. Kazimir, Councilman Paul J. Nicoletti, Village Manager Herbert L. Gildan; Village Attorney Dolores R. Walker, Village Clerk Mayor-Love called the Regular Session to order at 7:00 ROLL CALL p.m. All members of the Council were present except - Vice Mayor Marks who arrived at 7:33 p.m. Councilman Kazimir gave the invocation and Councilman INVOCATION & Brown led the Council and the public in the Pledge of PLEDGE OF Allegiance to the Flag. ALLEGIANCE On motion of Councilman Brown, seconded by Councilman APPROVAL OF Moore, all present voting aye, the Minutes of Regular MINUTES Session held Thursday, September 22, 1977 were approved as written. Councilman Kazimir moved to accept the recommendation PLANNING COMM. of the Planning Commission that Section 41-19 (8) (a) RECOMMENDATION and (b) of Ordinance No. 14-71 be amended to apply to ACCEPTED ' all zoning districts. The motion was seconded by Vice Mayor Marks and all present voted aye. Councilman Kazimir moved to accept the recommendation PLANNING COMM. of the Planning Commission that the Council appoint RECGMMENDATION as an alternate member to the Planning Commission ACCEPTED a person with a landscape background. The motion was °_ seconded by Councilman Brown and all present voted aye. On motion of Councilman Moore, seconded by Councilman BILL 280 PLACED Kazimir, all present voting aye, Bill No. 280 entitled: ON FIRST READING AN ORDINANCE OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 6-34 OF THE VILLAGE CODE BY REQUIRING ALL MATTERS UPON WHICH THE VILLAGE COMMUNITY APPEARANCE BOARD MUST ACT TO BE SUBMITTED AT LEAST FOURTEEN (14) DAYS PRIOR TO THE REGULARLY SCHEDULED MONTHLY MEETING OF THE BOARD was placed on first reading and read by title alone. On motion of Vice Mayor Marks, seconded by Councilman BILL 281 PLACED Kazimir, all present voting aye, Bill No. 281 entitled: ON FIRST READING ' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR THE FISCAL YEAR 1976-77 BY APPROPRIATION TRANSFERS was placed on first reading and read by title alone. __ On motion of Councilman Brown, seconded by Councilman - BILL 282 PLACED Kazimir, all present voting aye, Bill No. 282 entitled: ON FIRST READING Minutes of Regular Session Held Thursday, October 13, 1977 Page 2 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING PORTIONS OF ORDINANCE N0, 19-76, THE BUDGET ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH FOR THE FISCAL YEAR 1976-77 was placed on first reading and read by title alone. ' On motion of Councilman Brown, seconded by Vice Mayor RES. 43-77 Marks, all present voting aye, proposed Resolution ADOPTED No. 43-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, REPEALING RESOLUTION NO. 36-77 AND ACCEPTING BID OF KING S NURSERY FOR 160,000 SQUARE FEET OF CERTIFIED TIFWAY 419 BERMUDA SOD IN THE AMOUNT OF $19,200.00 (12¢ PER SQUARE FOOT) FROM ACCOUNT N0. 71-411.12 was read in full and adopted as read as Resolution No. 43-77. On motion of Councilman Brown, seconded by Councilman RES. 44-77 Kazimir, all present voting aye, proposed Resolution ADOPTED No. 44-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, REPEALING RESOLUTION N0. 37-77 AND ACCEPTING THE BID OF JENKINS LANDSCAPE, INC. FOR 71 MAHAGONY TREES IN THE AMOUNT OF $4,970.00 FROM ACCOUNT N0. 71-405.30 was read in full and adopted as read as Resolution No. 44-77. On motion of Vice Mayor Marks, seconded by Councilman RES. 45-77 Brown, all present voting aye, proposed Resolution No. __ ADOPTED. X45-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF RIVIERA GENERATOR SERVICE FOR 78 HEAVY-DUTY WET STORAGE BATTERIES FOR GOLF CARTS IN THE AMOUNT OF $2,145.00 FROM ACCOUNT N0.-471-84.11 was read in full and adopted as read as Resolution No. 45-77. Councilman Moore moved to bring up Item 12 (c) under ITEM MOVED UP Miscellaneous Business before Item 12 (a). The motion ON AGENDA was seconded by Vice Mayor Marks and all present voted aye. Councilman Brown moved that we table the .item on the MOTION TO TABLE provision of Public Services Department labor to the FAILED North Palm Beach Country Club. The motion was second- ed by Councilman Kazimir and failed 2-3, with Mayor ' Love, Vice Mayor Marks and Councilman Moore opposed. The Council further discussed the subject of pro- MOTION TO TABLE viding Public Services Department labor to the Club, PASSED and during the discussion Vice Mayor Marks moved that this item be tabled. The motion was seconded _ by Councilman Kazimir and passed 4-l, with Councilman Moore opposed. Minutes of Regular Session Held Thursday, October 13, 1977 Page 3 Councilman Moore moved that we table Item 12 (a) under Miscellaneous Business until we have clarified Item 12 (c). The motion was seconded by Vice_Mayor Marks and failed 2-3, with Mayor Love, Councilman Brown and Councilman Kazimir opposed. Councilman Brown moved that we approve the allocation of 1975-76 North Palm Beach Country Club net income in the amount of $7,824.96 to the Reserve Operation Fund as required by Section 3 of Ordinance No. 69-61. The motion was seconded by Councilman Kazimir and passed 3-2, with Vice Mayor Marks and Councilman Moore opposed. Vice Mayor Marks moved that we approve those certain agreements between the Village of North Palm Beach and Club Professionals for the fiscal year 1977-78. The motion was seconded by Councilman Brown and all present voted aye. Vice Mayor Marks moved that we approve the schedule of 1977-78 holidays for Village employees. The motion was seconded by Councilman Moore and all present voted aye. A copy of this schedule shall be spread upon the minutes of the Council. 1 1 Councilman Moore moved that we not accept the incom- plete budget for fiscal year 1977-78. The motion was seconded by Vice Mayor Marks and failed 2-3, with Mayor Love, Councilman Brown and Councilman Kazimir opposed. There being no further business to come before the Council, on motion of Councilman Brown, seconded by Councilman Moore, all present voting aye, the meeting was adjourned at S:~F8 p.m. Minutes recorded by: Dolores R.
