07-28-1977 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JULY 28, 1977 1 Present: M. C. Love, Jr., Mayor V. A. Marks, Vice Mayor Al C. Moore, President Pro Tem William H. Brown, Councilman Donald J. Kazimir, Councilman Paul J. Nicoletti, Village Manager Herbert L. Gildan, Village-Attorney Dolores R. Walker, Village Clerk Mayor Love called the Regular Session to order at 7:30 p.m. All members of the Council were present. Councilman Kazimir gave the invocation and Councilman Moore led the Council and the public in the Pledge of Allegiance to the Flag. On motion of Councilman Brown, seconded by Councilman Kazimir, all present voting aye, the following minutes were approved as written: Minutes of Public Hearing on Proposed Usage of 1977-78 Federal Revenue Sharing Entitlement Funds held Thursday, July 14, 1977 i Minutes of Regular Session held Thursday, July 14, 1977 On motion of Councilman Moore, seconded by Vice Mayor Marks, all present voting aye, the following minutes were accepted by the Council: ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES ACCEPTANCE OF MINUTES Minutes of Regular Meeting of North Palm Beach Country Club Advisory Board held July 19, 1977 Minutes of Special Meeting of Planning Commission held July 19, 1977 Vice Mayor Marks moved that we approve the recommendation CC AD. BD. of the Country Club Advisory Board to allow one free family REC~IMENDATION swim at the North Palm Beach Country Club in August; one APPROVED free family tennis in September and one free family golf in October (golf carts not included). The motion was seconded by Councilman Brown and all present voted aye. On motion of Councilman Brown, seconded by Vice Mayor Marks - 4 to 1, with Councilman Moore opposed - pro- posed Resolution No. 35-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM ' BEACH, FLORIDA, ADOPTING PERSONNEL REGULATIONS. APPLYING TO PERSONS EMPLOYED BY THE VILLAGE OF NORTH PALM BEACH RES. 35-77 ADOPTED was read in full and adopted as read as Resolution No. 35-77. Minutes of Regular Session Held Thursday, July 28, 1977 Page 2 1 Councilman Moore stated that his primary reasons for opposing Resolution No. 35-77 were that the Personnel Regulations, in his opinion, did not contain a clear definition of salaried employees and hourly employees, and that there were no grievance provisions for Village department heads. On motion of Vice Mayor Marks, seconded by Councilman Kazimir, all present voting aye, proposed Resolution No. 36-77 entitled: COUNCILMAN MOORETS PRIMARY REASONS FOR OPPOSING RES. 35-77 RES. 36-77 ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF KING'S NURSERY FOR 105,000 SQ. FT. OF CERTIFIED TIFWAY 419 BERMUDA SOD IN THE AMOUNT OF $20,299.00 (12~ PER SQ. FT.) FROM ACCOUNT N0. 71-4ll.10 i was read in full and adopted as read as Resolution No. 36-77. Before Resolution No. 37-77 was adopted, Vice Mayor Marks VICE MAYOR advised the Village Council that the Jenkins' are his _MARKST STATE- patients, but that this will not affect his vote. He MENT FOR THE stated this for the record only. RECORD On motion of Councilman Brown, seconded by Councilman RES. 37-77 Kazimir, all present voting aye, that we accept the bid _ ADOPTED for trees to be planted on Lighthouse Drive per Resolu- tion No. 37-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF JENKIN$ LAND- SCAPE, INC. FOR 71 MAHOGANY TREES IN THE AMOUNT OF $5,000.00 FROM ACCOUNT N0. 71-405.03 which was adopted as read. Councilman Moore moved that we place the Swale tree NON AGENDA policy on the agenda at this time. The motion was ITEM PLACED seconded by Councilman Kazimir and passed 3 to 2, with ON THE AGENDA Vice Mayor Marks and Councilman Brown opposed. Councilman Moore moved that the Village policy on re- VILLAGE SWALE placing trees formerly planted by the Village in Swale TREE POLICY areas is that when these trees are missing for any reason, the Village will not automatically replace and the property owner at his discretion may them , replace the tree at his own cost provided that the tree is o£ the same species as was originally planted by the Village and is placed in the same location. The motion was seconded by Councilman Kazimir and passed 4 to 1, with Mayor-Love opposed. On motion of Vice Mayor Marks, seconded by Councilman RES. 38-77 Brown, all present voting aye, proposed Resolution No. ADOPTED 38-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING AN EASEMENT OVER THE EAST FIVE (5} FEET OF LOT 27, BLOCK D, VILLAGE OF-NORTH PAIM BEACH, PLAT ~4,FRCM ROBERT W. CARTER FOR WATER SERVICE LINE FROM LIGHTHOUSE DRIVE TO NEW OSBORNE PARK BUIS~DING was read in full and adopted as read as Resolution No. 38-77. Minutes of Regular Session Held Thursday, July 28, 1977 Page 3 i Councilman Moore moved that we bring Item 4 (a) from the ITEM BROUGHT workshop agenda (Resolution on Palm Beach County Sheriff's FROM .WORKSHOP Road Patrol) to the regular agenda at this time. The AGENDA TO motion was secon ded by Vice Mayor Marks and all present REGULAR AGENDA voted aye. On motion of Councilman Brown, seconded by Councilman -RES. 39-77 Moore, all present voting aye, proposed Resolution No. ADOPTED 39-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NbRTH PALM BEACH, FLORIDA REQUESTING THAT THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF PALM BEACH ADOPT A BUDGET FOR THE PALM BEACH SHERIFF'S DEPARTMENT WHICH DOES NOT SPREAD THE COST OF THE SHERIFFS ROAD PATROL TO PROPERTIES LYING WITHIN PALM BEACH COUNTY MUNICIPALITIES MAINTAINING THEIR OWN POLICE DEPARTMENTS CIS was read in full and adopted as read as Resolution No. 39-77. Councilman Kazimir moved that when suitable, permanent MOTION RE quarters are available, the Recreation Department shall OAKES BLDG. vacate the Oakes Building. The motion was seconded by FAILED Vice Mayor Marks and failed 2-3, with Mayor Love, Councilman Moore and Councilman Brown opposed.
