01-13-1977 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JANUARY 13, 1977 1 Present: M. C. Love, Jr., Mayor V. A. Marks, Vice Mayor Al C. Moore, President Pro Tem Donald J. Kazimir, Councilman Herbert A. Watt, Councilman Alan Ciklin, Village Attorney Paul J. Nicoletti, Village Manager Dolores R. Walker, Village Clerk Mayor Love called the Regular Session to order at 7:33 p.m. All members of the Council were present. Vice Mayor Marks gave the invocation and Councilman Kazimir led the Council and the public in the Pledge of Allegiance to the Flag. On motion of Councilman Moore, seconded by Councilman Watt, all present voting aye, the minutes of Regular Session held Tuesday, December 21, 1976 were approved as written. On motion of Councilman Kazimir, seconded by Vice Mayor Marks, all present voting aye, the following minutes were accepted by the Council: Minutes of North Palm Beach Library Board Meeting held July 15, 1976 Minutes of North Palm Beach Library Board Meeting held September 16, 1976 Minutes of North Palm Beach Library Board Meeting held November 18, 1976 Minutes of Regular Meeting of Country Club Advisory Board held December 15, 1976 Minutes of Regular Meeting of Community Appearance Board held January 4, 1977 On motion of Vice Mayor Marks, seconded by Councilman Moore, all present voting aye, Bill No. 261 entitled: ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINTjTES ACCEPTANCE OF MINUTES BILI~ 261 PLACED ON 2ND READING _ AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, CREATING A UNIFORM MAXIMUM PENALTY WHICH MAY BE IMPOSED FOR ANY VIOLATION OF MUNICIPAL ORDINANCES, EXCEPT WHERE EXPRESSLY PROHIBITED BY STATE LAW, BY MAKING THE PENALTY FOR ALL OFFENSES AGAINST THE ORDINANCES A FINE NOT TO EXCEED FIVE HUNDRED DOLLARS OR IMPRISONMENT NOT TO EXCEED SIX MONTHS, OR BOTH SUCH FINE AND IMPRISONMENT was placed on second reading and read by title alone. On motion of Councilman Kazimir, seconded by Vice Mayor BILL 261 ADOPTED Marks, all present voting aye, Bill No. 261 was adopted AS ORD. 1-77 as Ordinance No. 1-77. Minutes of Regular Session Held Thursday, January 13, 1977 Page 2 On motion of Councilman Watt, seconded by Councilman BILL 262 Moore, all present voting aye, Bill No. 262 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING PORTIONS OF ORDINANCE N0. 15-75, AS AMENDED, THE BUDGET ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH FOR THE FISCAL YEAR 1975-76 was placed on second reading and read by title alone. On motion of Vice Mayor Marks, seconded by Councilman BILL 262 Kazimir, all present voting aye,-Bill No. 262 was ADOPTED AS adopted as Ordinance No. 2-77. ORD. 2_77 On motion of Councilman Moore, seconded by Councilman BILL 263 Kazimir, all present voting aye, Bill No. 263 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 45-36 (F) OF THE VILLAGE OF NORTH PALM BEACH CODE BY PROHIBITING HOME OCCUPATIONS TO BE CARRIED ON IN ANY DWELLING STRUCTURE was placed on first reading and read by title alone. On motion of Councilman Moore, seconded by Vice Mayor RES. 1-77 Marks, all present voting aye, proposed Resolution ADOPTED No. 1-77 entitled: ' A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE PLANNING AND ZONING ADVISORY BOARD OF THE VILLAGE OF NORTH PAIM BEACH was read in full and adopted as read as Resolution No. 1-77. On motion of Councilman Watt, seconded by Councilman RES. 2-77 Kazimir, all present voting aye, proposed Resolution ADOPTED No. 2-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM _ BEACH, FLORIDA, ACCEPTING THE BID OF BOOTH CON- STRUCTION COMPANY FOR-PAVING, STRIPING AND BUMPER STOPS - NORTH PALM BEACH COUNTRY CLUB MAINTENANCE FACILITY - IN THE AMOUNT OF $16,090.00 FROM ACCOUNT N0. [F-156 was read in full and adopted as read as Resolution No. 2- 77. Councilman Kazimir moved that we approve the amendments to the agreement between the Village of North Palm ' Beach and Richard Cavanah, Pool Professional, for the fiscal year 1976-77. The motion was seconded by Vice Mayor Marks and all present voted aye. Vice Mayor Marks moved that we appoint Councilman Herbert A. Watt to the Palm Beach County Areawide Advisory Group. The motion was seconded by Council- man Moore and all present voted aye. AMENDMENTS TO R. CAVANAH'S AGREEMENT APPROVED H. WATT APPOINT- ED TO P. B. CTY. AREAWIDE AD. GROUP Minutes of Regular Session Held Thursday, January 13, 1977 Page 3 Vice Mayor Marks moved that we approve the request of Ellen Cannon for a refund on her tennis membership. The motion was seconded by Councilman Kazimir and passed 4 to 1, with Councilman Watt opposed. Vice Mayor Marks moved that we not approve the request ' of Mr. Vince Fazio far a rebate on pool membership fees at the North Palm Beach Country Club. The motion was seconded by Councilman Moore and all present voted aye. TENNIS MEMBER- SHIP REFUND - E_CANNON POOL MEMBERSHIP REBATE_ FOR TZ. FAZIO NOT APPROV- ED Vice Mayor Marks moved that we place on the agenda at NON-AGENDA ITEM this time the policy for rebates and refunds for member- PLACED ON AGENDA ships at the North Palm Beach Country Club. The motion was seconded by Councilman Kazimir and all present voted aye. Councilman Moore moved that we do not. make any rebates on country club memberships to persons who have signed a contract for one year and could be held responsible for it. The motion was seconded by Councilman Watt and all present voted aye. Councilman Kazimir moved that we place on the agenda at this time an item concerning a letter being sent to the Palm Beach County School .Board requesting them to keep the Adult Proficiency Level-Exam at a grade of 70 and urging them not to lower this grade. The motion was seconded by Vice Mayor Marks and all present voted aye. Councilman Kazimir moved that Mayor Love write a letter to the Palm Beach County School Board in- dicating-that the Adult Proficiency Level Exam ' be kept at a grade of 70. The motion was seconded by Vice Mayor Marks and all present voted aye. There being no further business to come before the Council, on motion of Councilman Razimir, seconded by Vice Mayor Marks, all present voting aye, the meeting adjourned at 8:55 p.m. Minutes recorded by: Dolores R.
