08-25-1977 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD -- THURSDAY, AUGUST 25, 1977 Present: V. A. Marks, Vice Mayor Al C. Moore, President Pro Tem William H. Brown, Councilman ' Donald J. Kazimir, Councilman Charles R. OTMeilia, Acting Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Absent: M. C. Love, Jr., Mayor Vice Mayor Marks called the Regular Session to order at ROLL CALL 7:30 p.m. All members of the Council were present except Mayor Love. Councilman Kazimir gave the invocation and Councilman INVOCATION & Brown led the Council and the public in the Pledge of PLEDGE OF Allegiance to the Flag. ALLEGIANCE Vice Mayor Marks stated he would like to ask God BLESSING AND for a special blessing for former Councilman Bill COMMENTS ON Greeley who had recently suffered from a severe FORMER COUNCIL- stroke. Councilman Brown informed the Council that MAN BILL GREELEY he had visited Bill Greeley yesterday afternoon and that he was doing great. He said he was in a great mood, starting to walk with a walker, and the doctor ' reports that Bill is going to come out of it without any adverse effects. On motion of Councilman Moore, seconded by Councilman APPROVAL OF Brown, all present voting aye, the Minutes of Regular MINUTES Session held Thursday, August 11, 1977 were approved as written. Vice Mayor Marks read and signed Proclamation on PROCLAMATION - "Jerry Lewis Muscular Dystrophy Telethon Weekend" - "JERRY LEWIS September 4 and 5, 1977. MUSCULAR DYSTROPHY TELETHON WEEKEND" Councilman Moore moved that we eliminate the stacking MOTION DIED FOR lane by the SamboTs restaurant on U. S. 1 and create LACK OF A SECOND a stacking lane in front of the Village Hall and then signalize that intersection such that there will be a green arrow for a left-hand turn for southbound motor- ists. The motion died for lack of a second. Councilman Kazimir moved that we request the State REQUEST FOR LEFT- to allow a stacking lane and left-hand turn signal for HAND TURN SIGNAL traffic heading south at the intersection of U. S. 1 FOR TRAFFIC HEAD- and South Anchorage Drive at no cost to the Village. ING S0. AT U. S. The motion was seconded by Councilman Brown and all 1 & S0. ANCHORAGE ' present voted aye. Councilman Brown moved that the Council write a letter LETTER_RE VILLAGE to all of our State Representatives and the local media, BEING TAKEN INTO with a copy to the Department of Transportation, under CONSIDERATION the signature of the Mayor or Vice Mayor, whoever is WHEN APPLICATIONS here at the time, complaining about the Village not FOR PERMITS TO being taken into consideration when these things MODIFY STATE & (applications for permits to modify state or federal FEDERAL HIGHWAY highway medians) are done and painting out our fears MEDIANS ARE CON- and worries about this particular case (the median SIDERED Minutes of Regular Session Held Thursday, August 25, 1977 Page 2 cut north of the Earman River bridge on U. On motion of Councilman Brown, seconded by Councilman Kazimir, all present voting a.ye, the following minutes were accepted by the Council: Minutes of Special Meeting of Planning Commission held August 16, 1977 Minutes of Regular Meeting of North Palm Beach Country Club Advisory Board held August 16, 1977 Concerning the recommendation of the Planning Com- mission regarding the inclusion of a Landscape Archi- tect/Nurseryman as a regular member, Councilman Moore moved that we table this recommendation and send it back to the Planning Commission for them to clarify why they want to add a Nurseryman, who they want to change on the Commission, which classification we have, and give us a whole recommendation instead of a partial recommendation. The motion was seconded by Councilman Brown and all present voted aye. On motion of Councilman Brown, seconded by Councilman Moore, all present voting aye, Bi11 No. 276 entitled: ' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDINr, ARTICLE VII, SECTION 7, OF THE PROVISIONS OF CHAPTER 31481, LAWS 0£ FLORIDA, EXTRAORDINARY SESSION 1956, AS AMENDED, BY CI-IANG- ING THE POWER AND AUTHORITY OF THE VILLAGE COUNCIL TO ADOPT A,BUDGET FROM RESOLUTION FORM TO ORDINANCE FORM was placed on second reading and read by title alone. ACCEPTANCE OF MINUTES PLANNING COMM- ISSION RECOM- MENDATION TABLED BILL 276 PLACED ON 2ND READING On motion of Councilman Kazimir, seconded by Council- BILL 276 ADOPTED man Moore, all present voting aye, Bi11 No. 276 was AS ORD. 15-77 adopted as Ordinance No. 15-77. On motion of Councilman Kazimir, seconded by Council- BILL 277 PLACED man Brown, all present voting aye, Bill No. 277 entitled: ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR THE FISCAL YEAR 1976-77 BY APPROPRIATION TRANSFERS was placed on second reading and read by title alone. On motion of Councilman Brown, seconded by Councilman Kazimir, all present voting aye, Bill No. 277 was adopted as Ordinance No. 16-77. On motion of Councilman Kazimir, seconded by Council- man Brown, all present voting aye, Bill No. 278 en- titled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR THE FISCAL YEAR 1976-77 BY APPROPRIATION TRANSFERS BILL 277 ADOPTED AS ORD. 16-77 BILL`278 PLACED ON 1ST READING was placed on first reading and read by title alone. .,~ Minutes of Regular Session Held Thursday, August 25, 1977 Page 3 On motion of Councilman Brown, seconded by Councilman Moore - 3 to 1, with Councilman Kazimir opposed - proposed Resolution No. 40-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, REQUESTING THAT PALM BEACH COUNTY CONSTRUCT, MAINTAIN AND CONTROL A TRAFFIC SIGNAL LIGHT AT-THE INTERSECTION OF SOUTHWIND DRIVE AND NORTHLAKE BOULEVARD, AT NO COST TO THE VILLAGE OF NORTH PALM BEACH was read in full and adopted as read as Resolution No. 40-77. 1 1 Councilman Kazimir moved that we approve fiscal year 1977-78 membership dues, rates and daily fees for the North Palm Beach Country Club. The motion was seconded by Councilman Moore. -RES. 40-77 ADOPTED MOTION TO APPROVE FY 1977- 78 DUES, RATES & DAILY FEES FOR NPBCC Councilman Kazimir moved to amend the motion as follows: MOTION AMENDED That we accept the fee schedule with the exception of the pool house guest fee, tennis house guest fee and junior fees for either golf or tennis, which we will discuss at a later date. The motion was seconded by Councilman Brown and all present voted aye. Councilman Moore moved to amend the motion as follows That we change the rate for non-resident, nine hole greens fees for the period October 1 to April 30 to $6.00; and that we change the rate for non-resident, nine hole cart fees for the period October 1 to April 30 to $6.00. The motion was seconded by Councilman Brown and all present voted aye. Thereafter Council voted on the main motion which passed ac~ed~: with Councilman Brown opposed. (Fee schedule att- Councilman Moore moved to approve policies for library charges and operation for non-residents effective Oct- ober 1, 1977 as follows: That people who reside within Palm Beach County, but are non-residents of North Palm Beach, will be charged $15.00 per year for a card to use the North Palm Beach Library, while non-residents of Palm Beach County who visit here for periods not to ex- ceed six months may receive a library card for $7.50 during that period. The motion was seconded by Council- man Brown and all present voted aye. MOTION AMENDED MAIN MOTION PASSED 3 TO 1 POLICIES FOR LIBRARY CHARGES & OPERATION Councilman Brown moved that the Village immediately take RECIPROCAL steps to establish reciprocal borrowing agreements .with __ BORROWING the following municipal libraries: Boca Raton, Boynton AGREEMENTS Beach, Delray Beach, Lake Park, Riviera Beach, West WITH OTHER Palm Beach and Lake Worth. The motion was seconded MUNICIPAL by Councilman Kazimir and all present voted aye.
