04-14-1977 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, APRIL 14, 1977 Present: M. C. Love, Jr., Mayor V. A. Marks, Vice Mayor Al C. Moore, President Pro Tem William H. Brown, Councilman Donald J. Kazimir, Councilman Alan Ciklin, Village Attorney Paul J. Nicoletti, Village Mana ger Dolores R. Walker, Village Clerk Mayor Love called the Regular Session to order at ROLL CALL 7:35 p.m. All members of the Council were present. Vice Mayor Marks gave the invocation and Councilman INVOCATION & Moore led the Council and the public in the P1.edge PLEDGE OF of Allegiance to the Flag. ALLEGIANCE On motion of Vice Mayor Marks, seconded by Councilman APPROVAL Moore, all present voting aye, the minutes of Regular OF MINUTES Session held Thursday, March 24, 1977 were approved as written. Mayor Love read and signed Proclamation on "Private PROCLAMATION - Property Week" - April 17-23. "PRIVATE PROPERTY WEEKT' ' Vice Mayor Marks moved that we donate $400.00 to be Council Contingency, expended from Account No. 51-285 DONATION TO NPB BIG LEAGUE , to the North Palm Beach Big League Team. The motion TEAM was seconded by Councilman Moore and all present voted aye . On motion of Councilman Kazimir, seconded by Councilman ACCEPTANCE , Moore, all present voting aye, the following minutes OF MINUTES were accepted by the Council: Minutes of Tennis Advisory Board Special Meeting held March 8, 1977 Minutes of Special Meeting of Planning and Zoning Advisory Board held March 29, 1977 On motion of Councilman Moore, seconded by Councilman BILL 267 Kazimir, all present voting aye, Bill No. 267 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, SETTING FORTH CRITERIA FOR LAND MANAGEMENT AND USE TO COMPLY WITH THE RULES AND REGULATIONS OF THE NATIONAL FLOOD INSURANCE PROGRAM EFFECTIVE DECEMBER 1, 1976 AS REGARDS THE FLOOD PLAIN AREAS AS DELINEATED ON THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, _ SPECIAL FLOOD HAZARD AREA MAP DATED DECEMBER 19, 1975, COMMUNITY N0. 120217, VILLAGE OF NORTH PALM BEACH MAP H-O1-02 was placed on first reading and read by title alone. Minutes o£ Regular Session Held Thursday, April 14, 1977 Page 2 On motion of Vice Mayor Marks, seconded by Councilman Kazimir, all present voting aye, Bill No. 268 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 3 OF THE VILLAGE OF NORTH PAIM BEACH CODE BY PERMITTING THE SALE OF BEER, ALE AND/OR WINE WITHIN 7.,000 FEET OF ANOTHER LICENSED RETAIL SELLER OF ALCOHOLIC BEVERAGES BY ANY BONA FIDE RESTAURANT, AS DEFINED AND LICENSED UNDER FLORIDA STATUTES AS A RESTAURANT WITH FULL KITCHEN FACILITIES, REGARDLESS OF SIZE OR SEATING CAPACITY, WHERE BEER, ALE AND/OR WINE IS SERVED SOLELY AS AN ACCESSORY USE TO THE RESTAURANT AT TABLES ONLY, WITH NO BAR AND ONLY WHEN SUCH RESTAURANT IS OPEN FOR THE SALE AND SERVICE OF FOOD was placed on first reading and read by title alone. On motion of Councilman Moore, seconded by Councilman Brown, all present voting aye, Bill No. 269 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REPEALING SECTIONS 10.5-1 THROUGH 10.5-5 OF THE VILLAGE OF NORTH PALM BEACH CODE, WHICH SAID SECTIONS CREATED THE NORTH PALM BEACH COUNTRY CLUB ADVISORY BOARD AND SET FORTH THE COMPOSITION, OR- GANIZATION, MEETINGS, AND POWERS AND DUTIES OF SAID BOARD was placed on first reading and read by title alone. ' On motion of Vice Mayor Marks, seconded by Councilman Kazimir, all present voting aye, proposed Resolution No. 16-77 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY, FLORIDA, RESPECTFULLY REQUESTING THE FAVORABLE CONSIDERATION OF THE HONORABLE CITY COMMISSION OF THE CITY OF WEST PALM BEACH, PALM BEACH COUNTY, FLORIDA, TO PERMIT THE TRANSPORTATION OF VILLAGE OF NORTH PALM BEACH RESIDENTS BY THE INTER-CITY FIRST AID SQUAD FROM MEDICAL AND/OR NURSING FACILITIES WITHIN THE CORPORATE LIMITS OF THE CITY. OF WEST PALM BEACH, UPON REQUEST OF SAID RESIDENT OR THEIR AGENT was read in full and adopted as read as Resolution No. 16-77. Councilman Brown moved that we authorize the purchase of a 23-channel CB Transceiver base station in the amount of $230.00 to be expended from Account No. 51-285, Council Contingency. The motion was seconded by Vice Mayor Marks and passed 3-2, with Councilman Moore and Council- man Kazimir opposed. ' Vice Mayor Marks moved that we reduce our coverage limits on Village liability insurance to $100,000/300,000. The motion was seconded by Councilman Kazimir and all present voted aye. BILL 268 PLACED ON 1ST READING BILL-269 PLACED ON 1ST READING RES. 16-77 ADOPTED AUTHORIZATION TO PURCHASE CB TRANSCEIVER BASE STATION VILLAGE LIABILITY INSURANCE REDUCED TO $100,000/ 300,000 Minutes of Regular Session Held Thursday, April 14, 1977 Page 3 1 Councilman Kazimir moved that we authorize a payment to MOTION TO Cornelius, Johnson & Clark in an amount not to exceed AUTHORIZE PAY- $20,000 to be expended from Account No. 51-285, Council MENT TO CJC FOR Contingency, for Village liability insurance. 'The motion VILLAGE LIABILITY was seconded by Councilman Brown. INSURANCE Councilman Moore moved to amend the motion as follows: That we not take the funds from Account No. 51-285, Council Contingency, but let the account (08-271, Gen- eral Liability) overrun as we originally agreed on our budgeting policy. The motion was seconded by Vice Mayor Marks and all present voted aye. Thereafter Council voted on the main motion which passed unanimously. Vice Mayor Marks moved that we accept the Village Man- ager's recommendations in establishing a new policy concerning membership fee rebates and excusals from contract requirements at the North Palm Beach Country Club as follows: MOTION AMENDED MAIN MOTION PASSED 5-0 MOTION RE POLICY FOR FEE REBATES - NPBCC 1. Death of a member will release heirs from further financial obligation and rebates will be granted. 1 J 2. Illness or disability of a member for an ex- tended period, as certified by a physician, will be grounds for excusal or rebate. Ex- tended illness or disability will be for a period covering the remainder of the member- ship year. The motion was seconded by Councilman Brown. Councilman Moore moved to amend the motion by adding item 3 stating that rebates shall be made for members who move from the immediate area. The motion was seconded by Vice Mayor Marks and failed 2-3, with Mayor Love, Councilman Kazimir and Councilman Brown opposed. Thereafter Council voted on the main motion which passed 4-1, with Councilman Moore opposed.
