09-09-1976 VC REG-M f MINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 9, 1976 Present: Mervin H. McIntyre, Vice Mayor V. A. Marks, President Pro Tem Donald J. Kazimir, Councilman M. C. Love, Jr., Councilman Al C. Moore, Councilman Paul J. Nicoletti, Village Manager Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Vice Mayor McIntyre called the Regular Meeting to order ROLL CALL at 7:3~ p.m. All members of the Council were present. Councilman Love gave the invocation and Councilman Marks INVOCATION & led the Council and the public in the Pledge of Allegiance PLEDGE OF to the Flag. ALLEGIANCE Council proceeded with its reorganization following the COUNCIL RE- Special Election held on September 7, 1976 to fill the ORGANIZATION vacancy in the office of Councilman, Group 5. Councilman Marks stated he had a written legal opinion COUNCILMAN from Mr. Gildan indicating it is not actually required MARKS REMARKS by our Charter that we reorganize. He stated that it RE COUNCIL doesn't make any difference (to him) if we reorganize _ REORGANIZATION or not. He said it is in the minutes, and he just wanted to say that this was the opinion of Mr. Gildan. Councilman Moore moved that we reorganize the Council MOTION PASSED at this time. The motion was seconded by Councilman TO REORGANIZE Love and all present voted aye, COUNCIL Vice Mayor McIntyre asked the Council not to place his VICE MAYORTS name in nomination for Mayor, since he is running for REQUEST THAT HIS the County Commission and has resigned from the Village NAME NOT BE Council effeetive November 16, 1976. PLACED IN NOMINATION Councilman Moore moved that M. C. Love, Jr. be nominated MOTION DIED for the office of Mayor of the Village of North Palm FOR LACK OF A Beach. The motion died for lack o£ a second. SECOND Councilman Kazimir moved that Al C. Moore be nominated COUNCILMAN for the office of Mayor of the Village of North Palm MOORE DECLINES Beach. The motion was seconded by Councilman Love. NOMINATION FOR Councilman Moore declined the nomination. MAYOR Vice Mayor McIntyre retracted the statement he had made VICE MAYOR MC- that he would not accept the office and stated that INTYRE RETRACTS in order to break the deadlock, if necessary, he would PRIOR STATE- accept the office of Mayor until the day he resigned. MENT Councilman Moore moved that M. C. Love, Jr. be nominated M. C, LOVE, JR. -- for the office of Mayor of the Village of North Palm NOMINATED AS Beach. The motion was seconded by Councilman Kazimir MAYOR and all present voted aye. FOR LACK OF A The motion died for lack of a second. SECOND Vice Mayor McIntyre passed the gavel to President Pro Tem V. A. MARKS Marks and moved that V. A. Marks be nominated for the NOMINATED AS office of Vice Mayor of the Village of North Palm Beach. VICE MAYOR The motion was seconded by Councilman Kazimir and all present voted aye. President Pro Tem returned the gavel to Vice Mayor McIntyre. Councilman Love moved that Al Moore be nominated for AL MOORE the office of President Pro Tem of the Village of NOMINATED AS North Palm Beach. The motion was seconded by Council- PRESIDENT man Marks and all present voted aye. PRO TEM Council then instructed the Village Clerk to place the PLACEMENT OF names of M. C. Love, Jr. as Mayor; V. A. Marks as NAMES ON Vice Mayor; and Al C. Moore as President Pro Tem on PROPOSED RES. proposed Resolution No. 67-76. 67-76 On motion of Councilman Love, seconded by Councilman RES. 67-76 Marks, all present voting aye, proposed Resolution No. ADOPTED 67-76 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING CERTAIN OFFICERS FOR SUCH VILLAGE was read in full and adopted as read as Resolution No. 67-76. Vice Mayor McIntyre turned the gavel over to Mayor M. C. Love, Jr. -- The Village Clerk then administered the Oath of Office OATHS OF to Mayor Love, Vice Mayor Marks and President Pro Tem OFFICE AD- Moore. These oaths shall be spread upon the minutes MINZSSERED ' of the Council. On motion of Vice Mayor Marks, seconded by Councilman APPROVAL OF Moore, all present voting aye, the Minutes of Regular MINUTES Session held Thursday, August 26, 1976 were approved as written. Councilman Marks moved that we continue prayer at our CONTINUANCE Council meetings. The motion was seconded by Council- OF PRAYER AT man Moore and all present voted aye. COUNCIL MEET- INGS Mayor Love read letter of commendation for action LETTER OF on the part of several officers of the Public Safety COMMENDATION Department in the apprehension and arrest of several FOR OFFICERS individuals for possession of marijuana and para- OF PUBLIC phanalia. This apprehension and the resulting arrests SAFETY DEPT. mark the successful conclusion to a case which had been a neighborhood problem which has affected the Village over several months. Minutes of Regular Meeting Held Thursday, September 9, 1976 Page 3 On motion of Councilman Moore, seconded by Councilman ACCEPTANCE McIntyre, all present voting aye, the Minutes of Regular OF MINUTES Meeting of Planning and Zoning Advisory Board held August 25, 1976 were accepted by the Council. The following action was taken by the Council on the COUNCIL ACTION recommendations contained in the Minutes o£ the Country ON REC~IENDA- Club Advisory Board Regular/Special Meeting held August TIONS OF CC 18, 1976: AD. BD. a. Vice Mayor Marks moved that Council approve that a method of charge cards be established for members. The motion was seconded by Councilman McIntyre and all present voted aye. b. Councilman Moore moved that we do not set a minimum fee. The motion was seconded by Vice Mayor Marks and all present voted aye. c. Councilman McIntyre moved that the fee of $6.00 to cover the billing for a year for social with charge memberships b_e amended to $5.00. The motion was seconded by Councilman Moore and all. present voted aye. d. Councilman Moore moved that a charge of $20.00 plus tax be established for non-resident social with charge memberships. The motion was seconded by Vice Mayor Marks and all present voted aye. e. Councilman McIntyre moved that we adopt the fees on the application form for 1976-77, as determined in our workshop sessions, a copy of which form is attached to the minutes of this meeting. The motion was seconded by Councilman Moore and all present voted aye. On motion of Councilman McIntyre, seconded by Vice Mayor BILL 255 Marks, all present voting aye, Bill No. 255 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ARTICLE VII, SECTION 7, OF THE PROVISIONS OF CHAPTER 31481, LAWS OF FLORIDA, EXTRA- ORDINARY SESSION 1956, AS AMENDED, BY CHANGING THE POWER AND AUTHORITY OF THE VILLAGE COUNCIL TO ADOPT A BUDGET FRC4~1 ORDINANCE FORM TO RESOLUTION FORM was placed on second reading and read by title alone. Councilman McIntyre moved that Bill No. 255 be adopted MOTION T9 as Ordinance No. 17-76. The motion was seconded by ADOPT BILL Councilman Kazimir. 255 AS ORD. 17-76 ' During the discussion on Bill No. 255, Councilman MOTION WITH- McIntyre and Councilman Kazimir withdrew their motion DRAWN and second respectively. X Minutes of Regular Meeting Held Thursday, September 9, 1976 Page 5 On motion of Vice Mayor Marks, seconded by Councilman RES. 68-76 McIntyre, all present voting aye, proposed Resolution ADOPTED No. 68-76 entitled: A RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING ' $1,600,000 GENERAL OBLIGATION BONDS OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA TO FINANCE THE COST OF THE ACQUISITION OF LAND FOR RECREATIONAL PURPOSES AND THE CONSTRUCTION AND ACQUISITION OF A RECREATION BUILDING AND RECREATIONAL FACILITIES IN THE VILLAGE; PROVIDING FOR AND CALLING A BOND ELECTION OF THE QUALIFIED ELECTORS RESIDING IN THE VILLAGE TO BB HELD ON NOVEMBER 2, 1976 ON THE QUESTION OF THE ISSUANCE OF SUCH GENERAL OBLIGATION BONDS; AND PROVIDING AN EFFECTIVE DATE was read in full and adopted as read as Resolution No. 68-76. Councilman Moore moved that we adopt the various membership ADOPTION OF and greens fees for the 1976-77 operating year at the North MEMBERSHIP Palm Beach Country Club, a copy of which is attached to & GREENS PEES the minutes of this meeting.
