Moore, President Pro T~ Mayor Love called the meeting to order at 7:35 p.m. All ROLL CALL members of the Council were present except Coincilman Moore. On motion of Councilman McIntyre, seconded by Cotncilman ACCEPTANCE OF Kazimir, all present voting aye, the Minutes of Regular MIIVUTES Meeting of Crmrm mity Appearance Board held September 7, 1976; and the Minutes of Cotmtry Club Advisory Board ~tciigl held Sept®ber 1.5, 1976 were accepted by the On motion of Vice Mayor Marks, seconded by Councilman BILL 256 McIntyre, all present voting aye, Bill No. 256 entitled: PLACID ON SECOND READIT]G AN ORDINANCE OF THE VTf 7.A(;F' OF NORTH PATS'[ BEACH, FLORIDA, AMENDING CHAPTER 22 OF THE VTTTA(;F' OF NORTH PALM BEACH CODE BY CHANGING THE NOISE CONTROL NEAS[TRII~'1II~T STANDARDS OTHER THAN MOTOR VEHICLE NOISE STANDARDS AND BY AMEPIDING STANDARDS CONCERNING CONSTRUCTION ACTIVITIES was placed on second reading and read by title alone. Vice Mayor Marks moved that Bill No. 256 be adopted as MOTION ID ADOPT Ordinance No. 17-76. The motion was seconded by Council- BILL 256 AS ORD. man M~Tntyre• I7-76 Vice Mayor Marks moved that Bill No. 256 be amended as M®TIODI DIED FOR follows: LACK OF A SECOND That in Section 1 (1) we ci~ge the dBA to 60 during the day and 55 at night; and that in Section 1 (3) we change the d&~ from 60 to 55 and strike out (4) and (5) completely: The motion died for lack of a second. Minutes of Regular Session Held Thursday, September 23, 1976 Page 2 Councilman Kazimir moved that Bill No. 256 be amended AMENDMENT TO in Section 1 (5) by adding the words "measured at the BILL 256 source" after the word sound. The motion was seconded by Councilman McIntyre and all present voted aye. Vice Mayor Marks moved that Bill No. 256 be amended by striking out Section 1 _(3) in total. The motion AMENDMENT TO BILL 256 was seconded by Councilman Kazimir and passed 3 to 1, with .Councilman McIntyre opposed. Thereafter Council voted on the main motion which BILL 256 passed 3 to 1, with Councilman McIntyre opposed. ADOPTED AS Therefore, Bill No. 256 was adopted as amended AMENDED AS as Ordinance No .- 17-76. ORD. 17-76 On motion of Vice Mayor Marks, seconded by Councilman BILL 257 Kazimir, all present voting aye, Bill No. 257 entitled: PLACED ON 22dD READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING PORTIONS OF ORDINANCE N0. 15-75, THE BUDGET ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH FOR THE FISCAL YEAR 1975-76 was placed on second reading and read by title alone. Vice Mayor Marks moved that Bill No. 257 be adopted MOTION TO as Ordinance No. 18-76. The motion was seconded ADOPT_BILL by Councilman Kazimir. 257 AS ORD. 18-76 Vice Mayor Marks moved that Bill No. 257 be amended by adding Revision 1 to Exhibit A and by adding AMENDMENT TO BILL 257 Revision 2 to Exhibit C. The motion was seconded by Councilman Kazimir and all present voted aye. Thereafter Council voted on the main motion which BILL 257 passed unanimously. Therefore, Bill No. 257 was ADOPTED AS adopted as amended as Ordinance No. 18-76. AMENDED AS ORD. 18-76 On motion of Councilman Kazimir, seconded by Vice BILL-258 Mayor Marks, all present voting aye, Bill No. 258 PLACED ON entitled: 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, LEVYING A TAX ON REAL AND PERSONAL PROPERTY LOCATED WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF NORTH PALM BEACH FOR THE YEAR ENDING DECEMBER 31, 1976, FIXING THE TOTAL VALUATION THEREON AND THE TAX MILEAGE RATE THEREON FOR SAID YEAR; ADOPTING A FISCAL --- BUDGET FOR THE FISCAL YEAR OCTOBER 1, 1976 TO SEPTEMBER 30, 1977, BOTH INCLUSIVE, FOR THE GENERAL GOVERNMENT AND DEBT SERVICE OF THE VILLAGE OF NORTH PALM BEACH AND FOR THE PARTICULAR USE OF THE NORTH PALM BEACH COUNTRY CLUB; APPROPRIATING FUNDS FOR EXPENDITURES AND REPEALING ALL ' ORDINANCES IN CONFLICT WITH THIS ORDINANCE was placed on second reading and read by title alone. ORD. 19-76 Mayor Love instructed the Village Clerk to include STATEMENT the following statement for the record in the minutes FOR THE ' of this meeting: RECORD The Council is including in the budget a proposed revision sent to them on September 3, 1976 and included in the first reading on September 9, 1976 and they agree with it. On motion of Councilman Kazimir, seconded by Council- BILL 259 man McIntyre, all present voting aye, Bill No. 259 PLACED ON entitled: 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE 1975-76 VILLAGE BUDGET BY TRANSFERRING THE SUM OF $2,000.00 FROM BUDGET ACCOUNT N0. 34-314.1 (FERTILIZER) TO ACCOUNT NO. 34-334 (EQUIPMENT REPAIR PARTS) was placed on second reading and read by title alone. On motion of Councilman McIntyre, seconded by Vice BILL 259 Mayor Marks, all present voting aye, Bill No. 259 ADOPTED AS was adopted as Ordinance No. 20-76. ORD. 20-76 On motion of Councilman McIntyre, seconded by Councilman RES. 69-76 Kazimir, all present voting aye, proposed Resolution ADOPTED No. 69-76 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPT:CNG THE BID OF ALBATROSS SUPPLY FOR IRRIGATION PIPE AND FITTINGS IN THE AMOUNT OF $1,482.90 FROM ACCOUNT N0. 14-405.2 was read in full and adopted as-read as Resolution No. 69-76. Vice Mayor Marks moved that we accept the resignation RESIGNATION of Everett R. Miller, Jr. from the Country Club OF MR. MILLER Advisory Board.
