07-22-1976 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JULY 22, 1976 1 Present: Mervin H. McIntyre, Vice Mayor V. A. Marks, President Pro Tem M. C. Love, Jr., Councilman Al C. Moore, Councilman Herbert A. Watt, Councilman Alan Ciklin, Village Attorney Paul J. Nicoletti, Village Manager Dolores R. Walker, Village Clerk Vice Mayor McIntyre called the Regular Session to order at 7:30 p.m. All members of the Council were present. Councilman Love gave the invocation and Councilman Watt led the Council and the public in the Pledge of Allegiance to the Flag. On motion of Councilman Marks, seconded by Councilman Love, all present voting aye the following minutes were approved as written: Minutes of Public Hearing held Thursday, July 8, 1976 Minutes of Regular Session held Thursday, July 8, 1976 _ ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES Mr. John LaCerda, President, Yacht Club Civic Associ- ation, presented a dissertation to the Council concern- ing the lack of water on the higher floors of the condo- miniums and also the turbid quality of the water. He also expressed alarm concerning fire hazards in high rise buildings due to the lack of water pressure. Mr. William Friday, 753 Eagle Way, brought with him two glasses of water, which were of very poor quality. He advised the Council that he was not well physically and toas apprehensive about drinking the water for fear that it would be injurious to his health. Mr. Nicoletti stated that he had talked with officials of the utility company and they assured him that even though the water has sedimentation in it, it is fit to drink and it does not contain bacteria and it would not poison one if they drank the water. Mrs. Blanche Lang, 414 Driftwood Road, stated that the water pressure was very low and that the water was rusty. She also stated she felt this was definitely a health hazard and should be corrected. COMPLAINTS OF RESIDENTS RE PALM BEACH CTY UTILITIES CO. Mr. John Hasler, counsel for Bankers Life and Casualty, - was present at the meeting as the representative for Palm Beach County Utilities Company. The Council posed several questions to Mr. Hasler regarding the serious water __ problems. Mr. Hasler was unable to answer some of the -- questions, but indicated he would check with the utility company tomorrow to obtain the answers and pass the in- formation on to Mr. Nicoletti. The Council agreed that they would recess this regular session tonight and reconvene on Monday, July 26, 1976 because of the problems the Village was experiencing with the utility company. They instructed the Village Manager to contact the proper authorities at the utility company to find out what the situation is and advise the Council accordingly. On motion of Councilman Moore, seconded by Councilman ACCEPTANCE Love, all present voting aye, the following minutes OF MINTJTES were accepted by the Council: Minutes of Bicentennial Committee Meeting held June 29, 1976 Minutes o£ Regular Meeting of Community Appearance Board held July 6, 1976 Minutes of North Palm Beach Library Board Meeting held May 27, 1976 and the following minutes were rejected: REJECTION OF MINUTES Minutes of North Palm Beach Library Board Meeting held July 15, 1976 On motion of Councilman Lode,'seconded by Councilman CC AD. BD. Marks, all present voting aye, that we decline the RECOMMENDATION recommendation of the Country Club Advisory Board DECLINED that the Council acquire a restaurant license for the North Palm Beach Country Club. On motion of Councilman Marks, seconded by Councilman Love, all present voting aye, Bill No~, 252 entitled: BILL 252- PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR FISCAL YEAR 1975-76 BY TRANSFERRING FUNDS FROM ACCOUNT N0. 40-500, RESERVE ACCOUNT, TO ACCOUNT N0. 32-245, ENTERTAINMENT, IN THE AMOUNT OF $1,000.00 was placed on second reading-and read by title alone. On motion of Councilman Marks, seconded by Councilman BILL 252 Love, all present voting aye, Bill No. 252 was adopted ADOPTED AS_ as Ordinance No. 15-76. ORD.- 15=76 Councilman Love moved that Resolution No. 55-.76 MOTION TO entitled: ADOPT RES. 55-76 A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, REQUESTING ALL APPLICABLE STATE AND FEDERAL AUTHORITIES, INCLUDING BUT NOT LIMITED TO THE -.- UNITED STATES COAST GUARD, STATE ROAD DEPARTMENT OR -_ THE DEPARTMENT OF TRANSPORTATION, AND THE NAVIGATION ---- DISTRICT, ET AL. TO SCHEDULE THE OPENINGS OF PARKER BRIDGE ON U. S. HIGHWAY N0. 1 AT THE INTRACOASTAL WATERWAY IN NORTH PALM BEACH, FLORIDA, SO AS TO -___- EQUITABLY BALANCE THE NEEDS OF THE BRIDGE FOR VEHICULAR AND PEDESTRIAN TRAFFIC WITH THE NEEDS OF THOSE PERSONS USING THE WATERWAY BELOW THE BRIDGE be adopted. The motion was seconded by Councilman Marks. Councilman Love moved that we amend Resolution No. 55-76 RES. 55-76 by deleting the reference to the PGA Boulevard bridge. AMENDED The motion was seconded by Councilman Moore-and all present voted aye. Minutes of Regular Session Held Thursday, July 22, 1976 Page 3 Thereafter Council voted on the main motion which passed unanimously. Therefore, Resolution No. 55-76 was adopted as amended. ' On motion of Councilman Moore, seconded by Councilman Marks, all present voting aye, that we approve the pur- chase of one 55-gallon drum of Malathion for mosquito control on a state contract basis in the amount of $822.25 to be expended from Account No. 14-327. On motion of Councilman Moore, seconded by Councilman Marks, all present voting aye, that we authorize the repayment of $61,740.00 to Account No. 05-500 (Council Contingent) at the rate of 6% per annum from November 1, 1975 to July 23, 1976, a total repayment of $64,477.00 to be made from the proceeds of the Improvement Revenue Bond§,Series 1975. There being no further business to come before the Council, on motion of Councilman Marks, seconded by Councilman Moore, all present voting aye, the meeting was recessed until Monday, July 26, 1976 at 7:30 p.m. The meeting was recessed at 8:25 p.m. ' Minutes recorded by: Dolores R.
