02-19-1976 VC SP-MMINUTES OF SPECIAL SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, FEBRUARY 19, 1976 Present: M. C. Love, Jr., Mayor Ronald L. Heraty, Vice Mayor William A. Greeley, Councilman Dr. V. A. Marks, Councilman Mervin H. McIntyre, Councilman Herbert L. Gildan, Village Attorney Paul J. Nicoletti, Village Manager Dolores R: Walker, Village Clerk Mayor Love called the Special Session to order at 7:31 ROLL-CALL p.m. All members of the Council were present. On motion of Vice Mayor Heraty, seconded by Councilman REGULAR MEETING McIntyre, all present voting aye, that at all Special FORMAT AT ALL Meetings of the Village Council_there be a_Regular Meeting SPECIAL COUNCIL format. MEETINGS On motion of Vice Mayor Heraty, seconded by Councilman BILL 240 Greeley, all present voting aye, Bill No. 240 entitled: PLACED ON 2IdD READING AN ORDINANCE OF THE VILLAGE OF NORTH PAIN BEACH, FLORIDA, PURSUANT TO CHAPTER 166, FLORIDA STATUTES, - ADOPTING AMENDMENTS TO THE CHARTER OF THE VILLAGE; PROVIDING THAT THIS ORDINANCE OF AMENDMENT SHALL BE SUBMITTED TO THE ELECTORS OF THE VILLAGE AT THE ' NEXT GENERAL ELECTION TO BE HELD IN THE VILLAGE IN THE FORM OF A PROPOSITION ON THE REFERENDUM ELECTION BALLOT; SAID PROPOSITION BEING, SHALL THE AMENDMENTS TO THE CHARTER OF THE VILLAGE OF NORTH PALM BEACH AS SET FORTH IN SECTION 1 OF THIS ORDINANCE BE ADOPTED; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF was placed on second reading and read by title alone. Councilman Greeley moved that Bill No. 240 be adopted as MOTION TO ADOPT Ordinance No. 1-76. The motion was seconded by Councilman BILL 240 A S Marks. _ ORD. 1-76 Councilman Marks moved that Bill No. 240 be amended as AMENDMENT TO follows: In Article III, Section 2, the first sentence BILL 240 FAILED shall read on the second Tuesday in March of each year a general election shall be held to elect members of the Village Council. The motion was seconded by Councilman McIntyre and failed 3 to 2, with Mayor Love, Vice Mayor Heraty and Councilman Greeley opposed. Councilman Marks moved that Ordinance No. 1-76 be tabled. MOTION TO TABLE The motion was seconded by Councilman McIntyre and failed ORD. 1-76 3 to 2, with Mayor Love, Vice Mayor Heraty and Councilman FAILED Greeley opposed. ., .., 1 Minutes of Special Session Held Thursday, February 19, 1976 Page 2 Vice Mayor Heraty moved to amend Article III, Section of Bill No. 240 as follows: The Council may determine the annual salary of council members by ordinance, but the compensation of an elected officer which has been so fixed shall not be increased during his term of office. The motion died for lack of a second. 4, MOTION TO -AMEND BILL 240 DIED FOR LACK OF A SECOND Councilman McIntyre moved to amend Bill No. 240 as -BILL 240 follows: Change the first sentence of Article IV, AMENDED Section 4, to read, "The mayor shall have the power, for sufficient cause, to suspend any village officer or official appointed by the Council." This will then become the second paragraph of Article III, Section 3, and the following section numbers shall be renumbered to run consecutively. The motion was seconded by Vice Mayor Heraty and all present voted aye. The Village Council considers an emergency to exist necessitating the passage of this ordinance with less than fifteen days notice to the public because it deems it important to have it on the next General Election Ballot for March 16, 1976, and to wait the remaining_ advertised time would not give sufficient notice to the public for the election. Thereafter Council voted on the main motion which passed unanimously. Therefore, Bi]1 No. 240 was adopted as amended as Ordinance No. 1-76.
